At the council meeting on August 4, 1997, Mayor Tom Minor asked the City Council, in the
wake of the tragic Hemlock fire, to ban the sale of all fireworks in the City of San
Bernardino.
The City Council, by a vote of 4-1 (2 absent) directed the City Attorney to draft an
ordinance banning the sale and discharge of fireworks within the City of San Bernardino.
That ordinance is attached.
Chapter 15 of the San Bernardino Municipal Code, presently bans the sale and use of
fireworks subject to certain exceptions for public displays by permit in Chapter 15 and so-
called "safe and sane" in Chapter 8.
This ordinance repeals the exemption for "safe and sane" fireworks, those sold at fireworks
stands, in Chapter 8.
The ordinance retains the permit process by the Fire Chief for public displays conducted
by competent operators approved by the Fire Chief for public agencies, fair associations,
and amusement parks, other organizations or trade artisans.
The ordinance makes it a violation of law for anyone to sell, "give, use, possess, discharge
or explode any fireworks." It also makes it a violation of law for a parent or guardian to
allow, permit or suffer a minor child to discharge any fireworks.
This ordinance has been reviewed and approved by the Fire Chief.

code or the San Bernardil10 Municipal Code, it shall be unlawful for any
person to store, offer f~ sale, expose to sale, sell at retail, give, use,
possess, discharge, or e;Ki>lode any fireworks. Notwithstanding any other
provision in this cod~' a violation of this section is an infraction which,
upon conviction ther~'bf, is punishable in accordance with the provisions

7801.3.2 .I Permits. It shall be unlawful for any person to
display or cause .the public display of fireworks without a permit for same
issued by th~ire Chief. The Fire Chief shall have power to adopt
reasonable rul and regulations for the granting of permits for supervised
public displ of fireworks by a public agency, fair association,
amusement nark, other organization, or for the use of fireworks by artisans
in pursuit oitheir trade. Every such use or display shall be handled by a
competent. operator approved by the Fire Chief or his designated
representa ve, after proper investigation, not to be hazardous to property
or to end, ger any person. A violation of this section is a misdemeanor
whic,h~ upon conviction th~reof, is punishable in accordance with the
proVIS\OfS of 1.12,010 of this code.

parent, uardian or other person having the legal care and custody of any
child un r the age of eighteen years who allows, permits or suffers such
child to fire, shoot, discharge, set off or explode any torpedo, rocket,
firecracker, squib or blank cartridge, or any fireworks whatsoever, or
anything containing any portion of cWoride of potash, mixture of sulphur
or saltpeter, or any substance of any explosive nature, except party
poppers, snap caps, and paper caps as defined in section 7801.3.4 ofthis

RE: NATIONAL FIREWORKS-RELATED FIRE AND INJURY STATISTICS

Pcr your request, the purpose of this letter is to provide you and members of the City Council with a brief
response to the above-referenced Interoffice Memorandum from ChiefPitter.
While I recognize that you and some members of the City Council may be familiar with the "national
statistical data" discussed in Chief Pitzer's memo, [ suspect that you may not be familiar with how the
information is collected as well as what "firework" items are included in these statistics.
If T may, let me present you v,ith a little background. The United States Consumer Product Safety
Commission (CPSC), created with the 1972 passage of the Consumer Product Safety Act (CPSA), is
charged with protecting the consumer from "unreasonable risks" of injury from consumer products. Before
the Commission can concern itself with reducing the risk from a consumer product, the Commission must
first identify and quantify the risk.
The CPSC has regulatol)" powers effecting aU manufacturers, importers, distributors, and retailers of
consumer products sold for use in the United States. It is essential that the CPSC's decisions be based on
accurate, timely, and comprehensive data. Since there was no national system available to measure
consumer product-related injury problems, the National Commissioo 00 Product Safety, a study group
whose final report led to the creation of the CPSC, designed a surveillance network to monitor acute
injuries treated in hospital cmergeney rooms. That surveiUance network has involved into what is now
known as the National Electronic Injury Surveillance System (NEISS).
NEIS S data and NEIS S estimates are based upon injuries treated in hospital emergency rooms that
oatients sav are related to oroducts. NEISS's estimates on these consumer product-related injury
problems arc I!ener.ilized estimates based upon data input by the "designated coder" (person responsible for
filling out the fonns) at each of the approximately 66 hospitals throughout the country where NEISS has its

computer monitoring equipment. NEISS utilizes a surveillance-type reporting system to monitor these
consumer product-related injuries treated in these hospital emergency rooms.
For several yeaxs, CPSC has had NEISS collect data on all iniuries involving aU tvnes of fireworks. These
studies concentrate on identifying the type of firework involved in each injury.
It is important to note that the data NEISS collects for CPSC is for "product-related injuries." CPSC
and NEISS publish a cautionary note on all NEISS data and estimates that are distributed. That
cautionary note states as follows:
"NEISS data and estimates are based on injuries treated in hospital emergency rooms
that patients say are related to products. Therefore, it is incorrect, when using NEISS
data to say the iniuries were caused by the product."
Thus, the product's involvement mayor may not have caused the injury. An obvious example oftbis is the
actual case cited by NEISS where an individual in the Mid-West was perched upon the roof of a structure
to watch a public aerial firewmks display. The roof gave way causing injury to the individual. Under the
NEISS method of reporting, it was reported as a "fireworks-related injury."
Secondly, it is important to note that these NEISS filrures are actuaIIv estimates not the actual number
of injuries. NEISS takes the raw number of reported incidents that have been designated as
"fireworks/product-related injuries" and puts that number through a mathematical formula from which they
then project out that there are a certain number of injuries related to all types of fireworks.
As you can see from the attached sheet prepared by the American Pyrotechnics Association, for 1995 there
were an estimated 11,313 fireworks-related injuries. The breakdown, by type of device, for the injuries
actually reported across the country to the NEISS's system showed that the relative percentage attributed
to items that are illegal in California was at least 95% and the maximum that could have been attributed to
state-approved items ~...as only 5% of all the actual injuries that were represented to be "related to" all typeS
of fireworks.
When Chief Pitzer states "Data in the article is predicted upon all types of fireworks whether defined as
'safe and sane' or otherwise" he is correct. However, what you may not know is the "otherwise" includes
all the items that are illegal throughout California (firecrackers, sky rockets, sparklers, mortars, mines,
shells, roman candles, helicopters, etc.) as well as home made devices, bombs and public aerial displays.
Thus, contrary to what Chief Pitzer suggests, I do think that you can find more statistically significant
information than what was provided in his August U, 1997 memo. I would draw your attention to
the analysis of the San Bernardino City Fire Statistics attached to my letter of August 1, 1997 at
Exhibits E and F. You will note that out of the total of 32 incidents in 1995 and 1996. only one of
those was attributed to state-annroved fireworks and there was nO dollar loss sustained bv this
incident.
Furthermore, I would draw your attention to Exhibit A of that same letter which contains the latest
statistics collected by the California State Fire Marshal for fireworks-related fires. This State Fire
Marshal chart c1earlv show that over 92% of the fire losses each vear are attributed to iIIel!al
fireworks. not state-aOJ)roved fireworks. (For your ease of reference, I am taking the liberty of
attaching copies of Exhibits A, E and F from my August 1,1997Ietter.)
With respect to firework-related injury statistics, there are statistics that are more significant than
those presented to the Council in Chief Pitzer's August 12, 1997 memo. Every year the State Fire
Marshal's office conducts a "Hospital Emergency Room Survey" in California for the period of June

17 through July 16. Attached hereto please find the most recent statistics (1996) for those injury-
reports, broken down by county. You will note that within all of San Bernardino Countv there were
onlv four reoorted injuries. two caused by legal fireworks and two by illegal fireworks. This figure is
remarkably low when you compare it to counties that do not permit any fireworks (Alameda-13,
Contra Costa-4. MOdterey-3, Yolo-4, etc.).
It is also important to keep a sense of perspective when examining the National NEISS injury estimates the
Chief provided you, particularly when looking at children age 5 to 14. This age group is one of the most
injury prone because they tend to take risks in many of their activities. Attached hereto please find a
comparison of the fireworks-related estimates to other activities which were the cause of injury to this age
group. KeeD in mind that this fireworks-related iniurv estimate includes illetzal fireworks homemade
bombs. Duhlic aerial disDlav. as well as state-aeproved fireworks. Despite this rather broad category or
definition of "fireworks" you can scc that the estimated number of emergency room treatments for this age
group per 100,000 children is lower than such benign items as pens and pencils. Yet, fireworks is the only
category of product for which prohibition instead of education, adult supervision and enforcement is often
urged.

....ireworks Injuries by Type of Device
The U. S. Consumer Product Safety Commission, through the National Electronic Injury
Surveillance System (NEISS), collects data on injuries associated with consumer products,
including fireworks. The data indicate which consumer product was associated with a
particular injury. but do not mean that the product necessarily caused the injury.
Injuries by type of firework have remained fairly constant, on a percentage basis, over the
past decade, and the total number of estimated fJreworks-related injuries has also remained
fairly constant, at approximately 10,000 per year.
For 1995, there were an estimated 11,313 fJreworks-re1ated injuries. The breakdown, by
type of device, for the injuries actually reported to the NEISS System, is:

Injuries to Children Ages 5 - 14
Children from age 5 to 14 are very adventuresome and experimental, and they are likely to
take risks in many of their activities. This age group is the one that is most frequently
involved in frreworks-related injuries, pointing out the need for close adult supervision of
all fireworks activities as well as the need for safety education campaigns specifically
targeted for this age group.
However, frreworks are not the only consumer item or activity for which this age group
occasionally requires medical attention. Many other products are associated with more
injuries than fireworks. Data collected by the U.S. Consumer Product Safety Commission
indicate the extelll to which various age groups incur product-related injuries in numerous
categories, including fireworks.
Figures for various activities (from the 1995 CPSC injury surveillance repon) are given
below in terms of estimated number of injuries per 100,000 children in the age 5 to 14
category. Fireworks is the only category for which prohibition, instead of education and
adult supervision. is often urged.

Dear Sirs:
I represent the parents and family of the students of the San Gorgonio High School Band.
Although not all of the families and students live within the City of San Bernardino, our
students attend San Bernardino City Schools and represent the City of San Bernardino in
various performances, festivals and competitions. Our band attends field competitions in
Fontana, Rialto, Barstow and Hawthorne. Our tall flags also compete in Riverside,
Upland and Yucaipa. The San Gorgonio Band hosts our own field competition each
November. High school bands come to San Bernardino for this competition from
Barstow, Moreno Valley, Fontana, Apple Valley, La Quinta, Bloomington, Banning,
Rialto, Ontario, Walnut, Hawthorne and Reno, Nevada. This field competition supports
businesses in San Bernardino.
The Booster Club raised $14,000 this year through the sale ofsafe and sane fireworks.
This represents 80% of our budget for the year. We use this money to send our band to
field competitions, host our own field competition, buy uniforms, music, and equipment
for the band, host an awards banquet for our hard working band members and employ
instructors to intensively work with our band to produce an award winning field show.
The sale of safe and sane fireworks has allowed our club to support the arts in our school
system. As you know, funding for music and the arts has been drastically cut over the
years. Our Booster Club is proud to be able to fill this void created by lack of School
Board funding. I urge the Mayor and City Council Members to keep the sale of safe and
sane fireworks in the City of San Bernardino to support our children and school programs.
