STAFF REPORT
Budget Motel Demolition
Since the Budget Motel was closed in 1990 the building has deteriorated into both an eyesore and
a major safety hazard. With an absentee landlord in the form of a corporation the motivation to
correct the situation has been non existent, especially considering the liability against the property in
terms ofliens which have been levied in an attempt by city staff to contain the blight on this major
comer of downtown. The following is a synopsis of action taken to date:
Sept 27, 1990:
Budget Motel closed with an inspection abatement warrant. A 96 count
criminal compliant filed due to substandard and hazardous conditions.
Dec 17,1990:
Five Page notice prepared by Senior Building Inspector Joseph Lease
submitted following inspection listing work to be carried out to correct
deficiencies.
Dec 14, 1992:
Motel secured at a cost of $12,753.10 following numerous complaints of
transients and vagrants sleeping and living in the property
June 4, 1993
Case heard before the Board of Building Commissioners (BBC) to recover
costs of $9,233.29 incurred to board and secure the building.
Oct 11, 1993:
Once again case brought before BBC to recover costs incurred to board and
secure. This time in the amount of$6,417.20
Mar31,1994:
Property Boarded and secured at a cost of$2, 147.90 following complaints by
the Fire and police Departments.
July 12, 1995:
Following numerous complaints of vagrants and transients living at the
property an abatement was done again at a cost of$312.64.
April 4, 1996:
Case heard before BBC for costs incurred of$8,128.79.

confirmed that Shann Brassfield of Golden Resorts Inc. is the only interested
holder in the property. Through his attorney, Jim Morgan, he will give the
city consent to proceed with the demolition on the understanding a lien will
be placed on the property for the cost of the demolition.
Aug 17, 1996
Called for bids. Four bids received. All four bids required a disclaimer and
would not be responsible for asbestos Initial bids for demolition of the
Budget Motel were in the region of $337,000. This was occasioned by the
fact that an asbestos study conducted by Environmental Services Inc. deemed
that there was significant asbestos throughout the building, especially in the
stucco, which would require specialist treatment.
June 1997
A second asbestos study by Advanced GeoEnvironmental, Inc. was
commissioned. This study ,which took samples from each room and every
area of the building, determined that the asbestos element was significantly
less than first reported.
July 17,1997
A bid was sought based on this asbestos report. Action Environmental to do
complete asbestos removal and demolition.
The demolition bid is made up of the following components.
Removal ofasbestos $96,793.00
Demolition $57,050.00
All demolition costs will be

We the citizens df the area Sth & "G" in San Bernardino are inquiring about
the vacant partially secured Budget Motel. We are distraught about the crime it
attracts such as:
1. Drug dealings in broad daylight on the sidewalk.
2. Prostitution.
3. Panhandling & intimidating individuals therein.
It is unsafe because of these crimes and individuals; therefore, we are
inquiring as to what actions can be taken to make this area safer for our family
members, friends, visitors and other residents.

The Building is now vacant, but was formerly used as an economy hotel and rastaurant.
You have advised us that the Building includes asb~stos (the ,. Asbestos") which is. or
may become, friable.

Main Street, Inc. ("Main Street") is a quasi-governmental agel"\OVi'nvolved in the
redevelopment of portions of the City of San Bern~rdino. Main Street has requested
that it be given authority to demolish the Building (t~e "Demolition"). which Demolitioif
shall include, without limitation. proper removal an~ disposal of the Asbestos. Golden
Resorts is willing to grant such authority subject tp the following conditions:

1. The Demolition shall be conducted in strict compliance with all
governmental rules and regulations applicabfe thereto and in strict conformance
with all industry standards for safety and workmanship in connection with similar
demolition projects; :
2. The Demolition will be acconlPlished by a reputable demolition
contractor (the "Demolition Contractor") whIch shall: (i) be approved by Golden
Resorts; and (ii) have sufficient licenses; bonding capacity and financial
wherewithal to perform the Demolition in accordance herewith;

3. The Demolition Contractor shall perform the Demolition pursuant to
a contract between Main Street and the Demolition Contractor (the "Demolition
Contract"'. The Demolition Contract shall De approved by Golden Resorts and
shall provide, among other things, that' the Demolition Contractor shall:
(i) indemnify Main Street and Golden Resort~ from any liability resulting from the

Demolition; and (Ii) maintain adequate insl.lrance and cause Main Street and
Golden Resorts each to be named as additio:nal insureds and loss payees under
such insurance. Golden Resorts shall no~ have any liability (contingent or
otherwise) under the Demolition Contract: <!nd
4. The Demolition shall be cOfT]menced. if at all, no later than
October'5. 1995. After the Demolition has been commenced. completion
thereof shall be pursued, at all times. with due diligence.
This letter shall be of no force or effect unles,s a copy hereof is executed by Main
Street. and returned to Golden Resorts. on or before August 25. 1997. as evidence of
Main Street's agreement to the terms and condit,ions set forth herein. Main Street
represents that all conditions which are a prerequIsite to itS authority to execute and
deliver this letter have been satisfied. '
