RESOLUTION NO.
87-135
RESOLUTION OF THE CITY OF
REQUEST TO THE STATE OFFICE OF
TIME EXTENSION TO COMPLETE THE
SAN BERNARDINO SUPPORTING THE
PLANNING AND RESEARCH FOR A
GENERAL PLAN.
4 BE IT RESOLVED THAT the City of San Bernardino requests
5 from the State Office of Planning and Research an extension of
6 time pursuant to Government Code Section 65361 to update the
7 following mandatory elements: Land Use, Circulation,
8 Conservation, Open Space, Noise and Safety.
9 The period of time requested is for two years from the
10 date granted by the Director of the State Office of Planning
11 and Research. Although the proposed work program requires
12 only 18 months, the additional time requested will allow the
13 City to permit additional public review and comment, if
14 warranted.
15 THIS REQUEST IS BASED UPON THE FOLLOWING FACTS:

Previously the City has relied in part on land use
17 data from the Assessor of the County of San Bernardino. The
18 City further relies on the County of San Bernardino for the
19 coordination of data regarding forecasts of population,
20 traffic, new housing starts and employment from the Southern
21 California Association of Governments. The County of San
22 Bernardino is presently engaged in a comprehensive general
23 plan update which will result in the generation of substantial
24 new data of relevance to the city of San Bernardino's General
25 Plan. Further, that information is not scheduled to be
26 available for about 90 days, and the information directly
27 relates to the general plan requirements applicable to the
28 City of San Bernardino, a charter city.

(2) Recent amendments to the state Planning and Zoning
Law have expanded the scope of local general plans, and the
existing General Plan needs to be evaluated for conformity
with the new requirements, including, but not limited to,
Chapter 82 (Stats. 1986); Chapter 1383 (Stats. 1986); Chapter
574 (Stats. 1986); and Chapter 2948 (Stats. 1986).

Recent project approvals, based on the existing

General Plan, have generated substantial public controversy,
including litigation.

Based on
this controversy, the Council feels it is appropriate to

reassess the continuing viability of the goals and policies
13
contained in the current General Plan.
In addition, it has

been several years since the City has undertaken a

I comprehensive general plan review. Accordingly, neither the

current Council nor the citizenry are familiar with the
procedures to be followed in a comprehensive general plan
update.
A general plan extension would assist the City in
preparing and adopting a complete and adequate general plan by

2 (5) The General Plan does not include the data
3 requirements of the Alquist-Priolo Special Studies Zones Act.
4 (However, the State Guidelines have been incorporated into the
5 environmental review process.)
6' (6) The City has initiated an l8-month comprehensive
7 update and revision of its General Plan in order to comply
8 with changes in the State law and guidelines since the
9 adoption of its original General Plan. A time extension would
10 allow concentration of staff resources and assist in the
11 preparation of a complete, integrated and internally
12 consistent revised General Plan.
13 BE IT FURTHER RESOLVED THAT the Common Council finds as
14 follows:
15 (1) Data required for the General Plan shall be provided
16 by another agency, and it has not yet been provided; and
17 (2) Other reasons exist that justify the granting of an
18 extension, so that the timely preparation and adoption of a
19 General Plan is provided.
