Recommended Motion:
1. Authorize the Director of Finance to amend the FY 2006/07 Budget by transferring $461,300 from
Account No. 240-379-5504-7620 (SS06-45) "5th Street Pavement Rehabilitation" to Account No.
240-379-5504-7622 (SS06-47) "Date Place Pavement Rehabilitation", and
2. Authorize the Director of Finance to amend the FY 2006/07 Budget by transferring $287,900 from
Account No. 240-379-5504-7616 (SS06-37) "4th Street Pavement Rehabilitation from Mt. Vernon
Avenue to 5th Street" to Account No. 240-379-5504-7623 (SS06-48) "G" Street Pavement
Rehabilitation," and
3. Adopt Resolution.

Subject:
Resolution awarding a contract to Matich Corporation for Pavement Rehabilitation on Date Place from
Del Rosa Drive to the City Limits (SS06-47) and "G" Street from Baseline Street to Highland Avenue
(SS06-48), per Project Plan No. 11796/11806, and authorization for the Director of Finance to amend
the FY 2006/07 Budget.
Background:
On August 7, 2006, the Mayor and Common Council allocated funds, as part of the FY 2006/07
Capital Improvement Program (CIP) for pavement rehabilitation at Date Place (SS06-47) and "G"
Street (SS06-48).
This project consists of the following:
1. Milling and removing damaged asphalt concrete pavement.
2. Construction of curb and gutter, sidewalk, crosswalks, and driveways.
3. Overlay new asphalt pavement full width.
4. Stripe new pavement.
5. Replace loop detectors at intersections.
The plans and specifications for this project were completed and the project was opened to public
bidding on October 31, 2006. The project was advertised locally in the San Bernardino County Sun
Newspaper, F. W. Dodge, Construction Bid Board, High Desert Plan Room, San Diego Daily
Transcript, Sub-Hub Online Plan Room, Reed Construction Data, Bid America Online, Construction
Bid Source, Bid Ocean, the City's web sites, and with the San Bernardino Area Chamber of
Commerce.
Bids have been received and are listed below:

Based on review of the sealed competitive bids received, staff has determined that Matich Corporation
of San Bernardino, the apparent low bidder, has met the minimum requirements of the specifications
and bid guidelines; and, therefore, recommends that the Mayor and Common Council award the
referenced contract to Matich Corporation.
Cored samples of the pavement were taken during the design phase of the project and concrete
pavement was discovered at the "G" Street location, requiring more extensive rehabilitation than
originally proposed. Bids for this project were significantly higher than originally budgeted, due to
recent increases in the cost of construction and the underlying condition of the pavement on "G" Street
and Date Place. The level of deterioration was much worse than estimated during budget preparation,
and a"pulverize-in-place"process needs to be used rather than the normal mill and overlay process.

The estimated project costs are as follows:
Construction Cost(Basic Bid) $ 1,088,333.00
Contract Management and Inspection(Approx. 13.6%) $ 148,417.00
Contingencies (Approx. 15%) $ 163,250.00
Estimated Total Project Cost $ 1,400,000.00
If approved, this project is expected to begin construction in late January of 2007 and be completed by
May of 2007.
Financial Impact:
Approximately $650,800 is available in Account No. 240-379-5504-7622 (SS06-47) "Date Place
Pavement Rehabilitation" and Account No. 240-379-5504-7623 (SS06-48) "G" Street Pavement
Rehabilitation" leaving a funding shortfall of$749,200. Staff is proposing to correct the shortfall by
transferring funds from Account No. 240-379-5504-7620 (SS06-45) "5th Street Pavement
Rehabilitation between Shirley Avenue and Victoria Avenue" and from Account No. 240-379-5504-
7616 (SS06-37) "4th Street Pavement Rehabilitation from Mt. Vernon Avenue to 5th Street."
After transfer of funds as indicated in the spreadsheet marked Attachment 1, adequate funding for the
project will be available in Account No. 240-379-5504-7622 (SS06-47) "Date Place Pavement
Rehabilitation" and Account No. 240-379-5504-7623 (SS06-48) "G" Street Pavement Rehabilitation."
Sufficient funds will remain in Account No. 240-379-5504-7620 (SS06-45) "5th Street Pavement
Rehabilitation between Shirley Avenue and Victoria Avenue" and in Account No. 240-379-5504-7616
(SS06-37) "4th Street Pavement Rehabilitation from Mt. Vernon Avenue to 5th Street" to complete the
design and bid the projects.
Recommendation:
1. Authorize the Director of Finance to amend the FY 2006/07 Budget by transferring $461,300 from
Account No. 240-379-5504-7620 (SS06-45) "5th Street Pavement Rehabilitation" to Account No.
240-379-5504-7622 (SS06-47) "Date Place Pavement Rehabilitation," and

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
3 BERNARDINO AWARDING A CONTRACT TO MATICH CORPORATION FOR

AUTHORIZATION FOR THE DIRECTOR OF FINANCE TO AMEND THE FY
6 2006/07 BUDGET.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
8 CITY OF SAN BERNARDINO AS FOLLOWS:
9 SECTION 1. Matich Corporation, 1596 Harry Sheppard Boulevard, San Bernardino,

CA 92408, is the lowest responsible bidder for Pavement Rehabilitation on Date Place from Del
11
12 Rosa Drive to City Limits (SS06-47) and "G' Street from Baseline Street to Highland Avenue (SS06-
13 48), per Project Plan No. 11796/11806. A contract is awarded accordingly to said bidder in a total
14 amount of$1,088,333.00, with a contingency amount of$163,250.00, but such award shall be
15 effective only upon being fully executed by both parties. All other bids, therefore, are hereby
16 rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of the
17 City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by
18
reference as fully as though set forth at length.

20 SECTION 2. This contract and any amendment or modifications thereto shall not take
21 effect or become operative until fully signed and executed by the parties and no party shall be
22 obligated hereunder until the time of such full execution. No oral agreements, amendments,
23 modifications or waivers are intended or authorized and shall not be implied from any act or
24 course of conduct of any party.

SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
26
27 within sixty (60) days of passage of the resolution.
