Synopsis of Previous Council Action:
10117/2005
Resolution No. 2005-273 adopted ordering the vacation of a portion of the east/west street
lying between "0" Street and Stoddard A venue.
Resolution No. 2005-338 adopted establishing fair market value and minimum sale price for
vacated city owned property, located between "0" Street and Stoddard A venue, and public
hearing set for November 21,2005.
Resolution Nos. 2005-389 and 2005-390 adopted authorizing execution of Agreements -
Sale of City Property, located between "0" Street and Stoddard A venue, north of 29th Street
and south of State Route 210.

Subject:
Resolution awarding a contract to Environmental Project Services, Inc., for Cul-de-sac Street
Improvements on Loop Street from Stoddard Avenue to "0" Street (SS-C 2006/07), per Project Plan
No. 11643
Background:
On August 7, 2006, the Mayor and Common Council allocated funds, as part of the FY 2006/07
Capital Improvement Program (C1P) for street safety improvements at various locations.
Loop Street was constructed by Caltrans between Stoddard Avenue and "0" Street in the 1970's as
part of the Route 30 Freeway project. Upon completion of construction, Caltrans relinquished Loop
Street to the City for operation and maintenance. Since that relinquishment, problems such as
dumping, auto theft, prostitution, graffiti, loitering, and illegal drug use have been attributed to the
uncontrolled access provided by Loop Street to this isolated area.
On August 1,2005, the Mayor and Common Council, at the request of local residents, determined that
Loop Street was not needed for present or future circulation and ordered it vacated. Caltrans
relinquished the property presently occupied by Loop Street to the City in fee. Fee ownership of
vacated Loop Street was sold in November of 2005 to the adjacent property owners; however,
sufficient right-of-way was retained in the vicinity of Stoddard Avenue and "0" Street to construct the
turnaround improvements. To address security issues resulting from the vacation, the City agreed to
provide turnaround improvements at both Stoddard Avenue and "0" Street. The turnaround
improvements have been designed with driveways to allow for acces~ to utilities that have easements.
Wrought iron fencing and gates will be installed to secure the vacated area.
This construction project consists of the following:
1. Milling and removing asphalt concrete pavement.
2. Construction of asphalt pavement, sidewalk, driveway access for the turnarounds.
3. Installation of wrought iron gates and fencing.
4. Replacement of roadway improvements.
The plans and specifications for this project have been completed and the project was opened to public
bidding on October 31, 2006. The project was advertised locally in the San Bernardino County Sun
Newspaper, F. W. Dodge, Construction Bid Board, High Desert Plan Room, San Diego Daily
Transcript, Sub-Hub Online Plan Room, Reed Construction Data, Bid America Online, Construction
Bid Source, Bid Ocean, the City's web site, and with the San Bernardino Area Chamber of Commerce.

Based on review of the sealed competitive bids received, staff has determined that Environmental
Project Services, Inc. of San Bernardino, CA., the apparent low bidder, has met the minimum
requirements of the specifications and bid guidelines; and, therefore, recommends that the Mayor and
Common Council award the referenced contract to Environmental Project Services, Inc.

If approved, this project is expected to begin construction in January of 2007 and be completed by
February of2007.
Financial Impact:
Adequate total funding for this project is available from the FY 2006/07 CIP from Acct. No. 129-367-
5504-7156 (SS-C) "Street Safety Improvements at Various Locations."
Recommendation:
Adopt Resolution.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Environmental Project Services, Inc., 1585 S. '"D" Street, Suite #203,

San Bernardino, CA
92408, is the lowest responsible bidder for Cul-de-sac Street
Plan No. 11643.
A contract is awarded accordingly to said bidder in a total amount of
$49,855.00, with a contingency amount of$ 7.478.00, but such contract shall be effective only
upon being fully executed by both parties. All other bids, therefore, are hereby rejected. The
Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy
of the contract is on file in the office of the City Clerk and incorporated herein by reference as
fully as though set forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shall be

obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
