Subject:
Authorization for the director of Development Services to execute Contract Change Order No. One to
the contract with Oak Engineering, Inc. for Traffic Signal Improvements at 5th Street and "F" Street
(TC04-16); 30th Street and "E" Street (TC04-17); Highland Avenue and "E" Street (TC04-21), per
Project Plan No. 11176.
Background:
On August 7, 2006, the Mayor and Common Council allocated funds as part of the FY 2006/07 Capital
Improvement Program (ClP) for Traffic Controls for the above locations.
On August 21, 2006, the Mayor and Common Council awarded a contract to Oak Engineering, Inc. in
the amount of $354,050.00 for Traffic Signal Improvements at 5th Street and "F" Street (TC04-16);
30th Street and "E" Street (TC04-17); Highland Avenue and "E" Street (TC04-21), per Project Plan
No. 11176.
During construction, the signal foundation for the southeast corner of Highland Avenue and "E" Street
was found to be in conflict with existing utilities. It was necessary for the contractor to remove the
existing pole and install a temporary signal pole while the new foundation was constructed.
On the southwest corner of Highland Avenue and"E" Street, a waterline was accidentally broken due
to incorrect Underground Service Alert (USA) markings. Due to technical problems, the San
Bernardino Municipal Water Department (SBMWD) was unable to turn off the water for four hours.
The continual flow of water caused significant roadway damage.. The contractor is requesting
compensation for delay incurred awaiting the water line repairs. SBMWD agreed to reimburse the
City in the amount of$5,000 as its share of the cost of the delay and repairs.
At 5th Street and "F" Street, an existing pedestrian pushbutton was identified for repair. However, due
to previous damage and precise field measure, the pedestrian pushbutton had to be relocated to comply
with new ADA regulations.
At 30th Street and "'E" Street, the existing signal poles and foundations were found to need
replacement due to previous base-plate damage. Also, elevations had to be adjusted to avoid
underground utility conflicts with the new ADA ramps being installed.
Change Order No. One, in the amount of$32,929.90, consists of the following changes:

Replace (2) I-A poles and install new foundations at the southwest corner of 30th
Street and "E" Street.

Financial Impact:
The FY 2006-07 CIP budget included funding in Acct. Nos. 250-370-5504"7430, 7431 & 7432 for this
project. This funding will be adequate to cover the cost of this change order and all other costs for this
project as indicated in the attached spreadsheet.
The estimated project costs are as follows:

Contract change Order No. One $ 32,929.90
Revised Construction Cost $ 386,979.90
This change order represents an increase of 9.3% in the contract amount.
The cost of construction engineering and inspection is estimated to be approximately $5,000, bringing
a total cost of change order to be $37,900. The Water Department will reimburse the City $5,000,
bringing a net cost of change order to $32,900.
Recommendation:
Authorize the Director of Development Services to execute Change Order No. One in the amount of
$32,929.90 to contract with Oak Engineering, Inc. for Traffic Signal Improvements at 5th Street and
"F" Street (TC04-16); 30th Street and "E" Street (TC04-17); Highlan~ Avenue and "E" Street (TC04-
21), per Project Plan No. 11176.

Install Temporary I-A Pole
At the southeast corner of Highland Ave & "E" Street, it was necessary to place the new
traffic signal pole in the same location as the existing pole, because of conflict with
I-I numerous utilities at the same intersection. It was necessary for the contractor to remove
the existing pole and wire a temporary pole to support the mast arm and signal heads
, during removal of the existing foundation and construction of a new foundation for the
I permanent signal pole. I

Delav due to Water Line Repair I
During conslruction, a water main, which had been incorrectly marked, and was damaged
by the conlractor's conduit boring operalions_ The waterline began leaking and, due to I
Item 1-2 technical problems, could nol be shut down for 4 hours. During this period, the force of
No. the water caused the roadway, curb & guller, and sidewalk to be undermined. This item is I
to compensate the contractor for delays incurred while waiting for the line to be shul
down and repaired. The Water Department has agreed 10 reimburse Ihe Cily $5,000 for its i
share of the cost of delay and repairs.
Repair of Asphalt Roadwav, Curb & Gutter, and Sidewalk
Item 1-3 The waterline break described in Item No, 1-2 above caused significant damage to the
No. roadway, curb & gutter, and sidewalk. This item is to compensate the contractor for
repair of the damaged areas of the street, curb & gutter and sidewalk.
Item Install a Pedestrian Push Button at 5'. Street & "F" Street
No. 1-4 It was necessary to relocate the pedestrian push button for compliance with ADA
regulations. Installation of a new foundation with anchor bolts was required.
Replace (2) I-A Poles and Install new Foundations at 30'. Street & "E" Street on the
Southbound Median Island and 30'. Street & "E" Street at the Southwest Corner
Item Two new I-A poles had to be replaced, The I-A pole at the southwest comer of 30'.
No. 1-5 Street & "E" Street had to be reconstructed to match the new grades for the handicapped
ramp_ The I-A pole at the median island at 30'. Street & "E" Street had to be replaced
after the contractor found that the anchor bolts, which had been sheared off in a prior
accident, had been reD laced bv others using unacceptable methods.
