Home My WebLink About2006-290 1 2 RESOLUTION NO. 2006-290 RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS 3 INTENTION TO ORDER THE VACATION OF THE NORTH-SOUTH ALLEY, WEST OF MOUNT VERNON AVENUE, NORTH OF 5TH STREET. 4 5 6 7 8 9 10 11 12 13 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council of the City of San Bernardino hereby declares its intention to order the vacation of the north-south alley, west of Mount Vernon A venue, north of 5th Street as depicted on the attached map marked as Exhibit "A" and described herein as follows: A portion of land being a portion of the Tompkins Subdivision per plat recorded in Book 5, page 98 of Maps in the office of the County Recorder of the County of San Bernardino, State of California, described as follows: Beginning at a point of intersection of the north line of Lot 6, with a line that is 1.40 feet 14 west of and parallel with the east line of said Lot 6, Block I of said Tompkins Subdivision; thence south along said parallel line across said Lot 6, and Lots 7, 8, 9, and 10 of said Tompkins 15 Subdivision to a point on the south line of said Lot 10; thence east along a straight line, a 16 distance of 18.6 feet, to the southwest corner of Lot I, Block I of said Tompkins Subdivision; thence north along the west line of said Lot I, and Lots 2, 3, 4, and 5 of said Tompkins Subdivision to the northwest corner of said Lot 5; thence west along a straight line to the Point of Beginning. 17 18 19 20 21 22 23 24 25 26 27 SECTION 2. That the Mayor and Common Council of the City of San Bernardino, in vacating the above described portion of said alley, elects to proceed under and in accordance with the provisions of the "Public Streets, Highways, and Service Easements Vacation Law", being Division 9, Part 3, of the Streets and Highways Code ofthe State of California. SECTION 3. That the hour of 4:00 p.m., on Tuesday, September 18, 2006, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California, is fixed as the time and place when and where all persons interested in or objecting to the proposed vacation may appear before the Mayor and Common Council and offer evidence in relation thereto. 28 08/14/06 I 2006-290 RESOLUTION OF INTENTION: VACATION OF THE NORTH-SOUTH ALLEY, WEST OF MOUNT 1 VERNON A VENUE, NORTH OF 5TH STREET. 2 For further particulars as to the proposed vacation, see that map marked "Plan No. 11664", 3 4 5 6 7 8 9 10 approved by the Mayor and Common Council on February 21,2006, attached and incorporated herein as Exhibit 'A'. SECTION 4. Nothing in this Resolution shall in any way affect or disturb any existing easements for public utility purposes belonging either to the City of San Bernardino or to any public utility; and there is hereby specifically reserved to Southern California Edison and its successors and assigns an easement to construct, place, operate, inspect, maintain, repair, replace 11 and remove any overhead or underground electrical transmission and/or distribution structure 12 consisting of wires, cables, conduits, poles, pole anchors and guy wires, manholes markers and 13 necessary fixtures and appurtenances and said easement shall include rights of ingress and egress; 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 and there is specifically reserved for Time Warner Telecom and its successors and assigns an easement to construct, place, operate, inspect, maintain, repair and replace underground and overhead structures consisting of wires, cables and necessary fixtures and appurtenances and said easement shall includes rights of ingress and egress; and there is specifically reserved for Adelphia and its successors and assigns an easement to construct, place, operate, inspect, maintain, repair and replace underground and overhead structures consisting of wires, cables and necessary fixtures and appurtenances and said easement shall includes rights of ingress and egress; and there is specifically reserved for the City of San Bernardino and its successors and assigns an access easement over the proposed area to be vacated for refuse service. SECTION 5.
