3 RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING AND
SETTING A FAIR MARKET VALUE AND SALES PRICE OF $10,400.00 AND
4 DECLARING THE INTENTION OF THE CITY TO SELL A PORTION OF CITY
5 OWNED PROPERTY GENERALLY LOCATED NORTHEASTERLY OF SCENIC
DRIVE, EASTERLY OF VALLEY VIEW DRIVE, TO THE STATE OF CALIFORNIA
6 RELATIVE TO THE WIDENING OF THE 1-215 FREEWAY AND SETTING A PUBLIC
HEARING TO CONSIDER SAID SALE.

hereinafter described parcel of real property, generally located northeasterly of Scenic Drive,

WHEREAS, the City of San Bernardino, a municipal corporation, is the owner of the
easterly of Valley View Drive, in the City of San Bernardino, State of California, more fully
described as follows:

Lot 23, Block I Scenic Knoll, Tract No. 1963, in the City of San Bernardino, County of
San Bernardino, State of California, as per plat recorded in Book 28 of Maps, page 52,
records of said County; and
WHEREAS, the State of California desires to acquire a portion of said City owned
parcel relative the widening of the 1-215 Freeway, more fully described in Exhibit "A", attached
hereto and made a part hereof, together with a temporary construction and access easement, more
fully described in Exhibit "B" attached hereto and made a part hereof; and
WHEREAS, the Mayor and Common Council of said City believe it is in the best
interest of the City that said parcel of real property be sold to the State of California to facilitate
the widening of the 1-215 Freeway; and
WHEREAS, the State of California has presented the City with an appraisal summary
25 indicating a fair market value of Ten Thousand Four Hundred Dollars ($10,400) for said real
26 property, including improvements consisting of landscaping and appurtenant irrigation, and a

temporary construction and access easement; and

WHEREAS, the Development Services Department, Real Property Section, has

reviewed said appraisal summary and supporting data and concur with the estimation of value

stated therein; and
WHEREAS, pursuant to both Sections 2.65.030 and 2.65.050 of the San Bernardino
Municipal Code, City owned property valued at less than $25,000 may be sold to another public
agency without the need for competitive bid, so long as the sales price is not less than the fair
market value of said real property.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The public interest and convenience require the sale of a portion of City

17 owned real property, with an area of approximately 184 square feet, generally located

northeasterly of Scenic Drive, easterly of Valley View Drive in the City of San Bernardino, more
fully described in said Exhibit "A", and same is hereby declared as surplus real property.
SECTION 2. It is therefore the intention of the Mayor and Common Council of the City
of San Bernardino to sell said real property to the State of California.
SECTION 3. The Mayor and Common Council do hereby find and determine that the
24 Fair Market Value and sales price of said real property is Ten Thousand Four Hundred Dollars
($10,400.00), including improvements consisting of landscaping and appurtenant irrigation, and

26 temporary construction and access easements, as described in said Exhibit "B".

SECTION 4. The Mayor and Common Council of the City of San Bernardino do
hereby set a public hearing to be held on September 5, 2006, at 4:00 p.m. or as soon thereafter as

the matter can be heard, in the Council Chambers of City Hall, 300 North "D" Street, San

SECTION 5. Notice of the public hearing shall be published in The San Bernardino
County Sun, a newspaper of general circulation, at least once prior to the public hearing and shall
be posted in at least 3 conspicuous places on the property at least (10) days prior to the hearing.
SECTION 6. Written and oral protest to such sale may be submitted and shall be
received at or prior to the public hearing. Written protests may also be submitted to the City
Clerk's Office, City Hall, 300 N. "D" Street, San Bernardino, California, prior to the public
hearing.
SECTION 7. It is the intent of the Mayor and Common Council to consider and
approve the sale of said property described herein, at said public hearing.

That portion of Lot 23, Block 1 of Tract No. 1963 Scenic Knolls, situated in
the City of San Bernardino, County of San Bernardino, State of California, as
shown on a Map recorded in Book 28, Page 52 of Maps in the Office of the
County Recorder of said County, described as follows:
BEGINNING at the most Northerly corner of said Lot 23; thence along the
Northwesterly line of said Lot, South 63046'36" West, 5.587 meters (18.33
feet) to the beginning of Course "N'; thence along said Course "~',
South 29008'08" East, 6.145 meters (20.16 feet); thence North 14027'28" East,
8.092 meters (26.55 feet) to the POINT OF BEGINNING.
This conveyance is made for the purpose of a freeway and the grantor hereby
releases and relinquishes to the grantee any and all abutter's rights,
including access rights, appurtenant to grantor's remaining property, in and
to said freeway, over and across said Course "~'.

City of San Bernardino, County of San Bernardino, State of California, as
shown on a Map recorded in Book 29, Page 52 of Maps, in the Office of the
County Recorder of said County, more particularly described as follows:
BEGINNING at a point on the Northwesterly line of said Lot, distant thereon
South 63046'36" West, 5.587 meters (18.33 feet) from the most Northerly
corner of said Lot; thence South 29008'08" East, 6.145 meters (20.16 feet);
thence South 14027'28" West, 31.581 meters (103.61 feet); thence
North 29008'08" West, 30.125 meters (98.84 feet) to said Northwesterly line;
thence along said Northwesterly line, North 63046'36" East, 27.392 meters
(89.87 feet) to the POINT OF BEGINNING.
