Recommended motion:
.
1. That the Director of Public Works/City Engineer and the City Clerk are
authorized to proceed with the proposed vacation of a portion of a
North/South alley between 14th Street and Magnolia Street and between "E"
Street and "F" Street.
2.
That Plan No. 7950, showing the proposed vacation of
North/South alley between 14th Street and Magnfry Street
Street and "F" Street, is approved. ~

STAFF REPORT
A request was received from Bobbie Cook on October 12, 1989, to vacate a portion
of a North/South alley between 14th Street and Magnolia Street and between "E"
Street and "r" Street. Subsequent to thi s request, a survey was sent to all of
the adjoining property owners and tenants of the entire alley (see attached
planl, requesting input as to the scope of the proposed vacation: i.e. do you
want all the alley area vacated, none of it vacated or a portion. Over 80% of
the owners and tenants responded to the survey, and the overwhelming result was a
request to close the entire "H" shaped alley. The first reason given by all of
those who wanted the entire alley closed was "drugs" (use and parapherna 11 a l.
However, closing the entire alley is not possible, as one property owner has 7
garages which face into the cross-bar of the alley, and a second property owner
has off-street parking for her tenants in the same area. After discussion with
Councilman, Jack Riley, the decision was finally made to go forward with the
original request for just part of the Northeast leg of the alley, which has been
marked on the enclosed plan.

The petitioner has deposited
the total fee of $400.00.

Mrs. Cook's request is based on several robberies and trespasses. Cook's
Upholstery Supplies plans to fence the area in question, not only to provide
better securi ty for thei r property, but al so to provi de more off-street parki ng
for those customers who would normally park on "E" Street.
