STAFF REPORT
Bids on this project were opened at 2:00 p.m. on November
21, 1989.
A total of 5 bids were received ranging between a low of
$51,981.00 and a high of $69,201.00. The low bid was 13% below
the Engineer's estimate of $60,000.00.

RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO PAUL GARDNER CORPORATION FOR TRAFFIC SIGNAL
3 MODIFICATION AND HIGHWAY LIGHTING AT MEDICAL CENTER DRIVE AND
NINETEENTH STREET.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:
6 SECTION 1. Paul Gardner Corporation is the lowest
7 responsible bidder for Traffic Signal Modification and Highway
8 Lighting at Medical Center Drive and Nineteenth Street, in
9 accordance with Plan No. 7641, for the total amount of
10 $51,981.00, and a contract is awarded to said bidder accordingly,
11 but such award shall be effective only upon the contract being
12 fully executed by the parties; all other bids therefore are
13 hereby rejected; and the Mayor is hereby authorized and directed
14 to execute said contract on behalf of the City; a copy of the
15 contract is attached hereto, marked Exhibit "A" and incorporated
16 herein by reference as fully as though set forth at length.

SECTION 2. This contract and any amendment or modifica-
18 tions thereto shall not take effect or become opera.tive until
19 fully signed and executed by the parties and no party shall be
20 obligated hereunder until the time of such full execution. No
21 oral agreements,
amendments, modifications or waivers are
22 intended or authorized and shall not be implied from any act or
23 course of conduct of any party.

SECTION 3.
This resolution is rescinded if the parties
25 to the contract fail to execute it within sixty (60) days of the
26 passage of this resolution.
