Synopsis of Previous Council Action:
On May l,2006 the Mayor and Council approved the reclassification and re-organization ofthe Workers'
Compensation Division of the Human Resources Department.
On November 27,2006 Personnel Committee recommended this item for Mayor and Common Council approval.

Salary adjustments for the Workers' Compensation Adjuster, Risk Management Specialist, Risk
Manager, Workers' Compensation Manager and Human Resources Supervisor in the Human
Resources Department.
Background•
Salary Adiustment for Workers Compensation Adiuster
The City of San Bernardino's workers' compensation program is self-insured and self-
administered. The Workers' Compensation Manager is responsible for managing this division
which currently has two (2) Workers' Compensation Adjusters and two (2) Workers'
Compensation Medical-Only Adjusters. On March 21, 2005 Mayor and Council approved a
reclassification and salary adjustment for the Workers' Compensation Adjuster classification of
36%, at the time the position was 45%below market.
AB 1252 requires the City to fill this vacancy in order to meet standards required to continue to
self-administer our program. In an effort to fill this position a classification/compensation study
was once again completed. The study indicates that this position continues to be 10.2%below
market. Staff is recommending a 10% increase to the Workers' Compensation Adjuster
classification.
Salarv Adiustment for Risk Mana�ement Specialist
The City of San Bernardino's Risk Management Division is responsible for the operation of the
City's self-insured liability insurance coverage,property, loss recovery, employee safety and loss
control programs. The Risk Manager is responsible for managing this division which currently
has only one other position, the Risk Management Specialist. The Risk Management Specialist
assists the Risk Manager with liability issues and coordinates the City's safety program.
On March 21, 2005 the Liability Claims Adjuster was reclassified to Risk Management
Specialist to more accurately reflect the duties. At that time the position was not provided a
salary adjustment. Since then the position has been filled twice with both incumbents leaving the
City for a greater salary. Once again we are in the recruitment process with no qualified
candidates. In an effort to fill this position a classification/compensation study was completed.
The study indicates that this position is 19.8% below market. Staff originally requested a 10%
increase to the Risk Management Specialist classification due to internal compaction issues.
At the Personnel Committee meeting on November 27, 2006, Committee members asked staff
what additional funds would be needed to address the compaction issues and bring the Risk
Management Specialist salary up to market. Staff responded that approximately $10,000 more
would be required to address these issues. The Personnel Committee members asked that the
staff report be amended to incorporate into the recommended motions the changes needed to
address the compaction issue and increase the Risk Management Specialist classification salary
up to market.

The cost for the remainder of FY 2006-07 is approximately $21,500. Annual cost for the
proposed changes is approximately $42,400. The Human Resources Department will absorb the
cost for FY 2006-07 through salary savings and future costs related to this change will be added
to the Human Resources Budget in FY 2007-08. Ongoing General Fund cost will be
approximately$6,400.
Recommendation:

SUMMARY DESCRIPTION
Under general supervision, examines and adjusts claims for Workers' Compensation benefits; monitors
claim expenditures; communicates with physicians, supervisors, employees and attorneys regarding
illnesses or injuries related to employment; and performs related work as required.
ORGANIZATIONAL RELATIONSHIPS
The class of Workers' Compensation Specialist is a professional-level claims adjusting class in the Risk
Management Division. Supervision is received from the Risk Management Coordinatar.
REPRESENTATIVE DUTIES
The following duties are typical for positions in this classification. Any single position may not perform
all of these duties and/or may perform similar related duties not listed here:
1. Provides courteous and expeditious customer service to the general public and City department staffs.
2. Performs specialized duties involved in the coordination and control of Workers' Compensation
procedures; reviews and records injury claims of City employees which have occurred in the
performance of duties for the City; makes recommendations regarding the processing of work injury
claims by employing departments; examines claims to determine if they comply with applicable laws,
rules and regulations of the State of California; reviews injury reports for completeness and
consistency.
3. Develops documentation by requesting substantiating reports from physicians, deparhnents and
wifiesses; resolves discrepancies in data; requests investigations to verify questionable claims data;
informs employees injured on the job of their rights and benefits under the Warkers' Compensation
laws; advises departments regarding procedures and reporting deadlines involving work injuries.
4. Maintains financial control on open files; monitors medical treatment; establishes case reserves based
on judgment and experience; reviews all physicians' reports, analyzing medical diagnoses and
prognoses; confers with physicians, hospital officials, attorneys, departments and employees to
determine status of cases.
5. Authorizes payment of inedical bills, temporary disability, permanent disability and death benefits;
coordinates with payroll, return to work and absentee information involving employees absent due to
an on-the job injury or illness; supervises clerical employees engaged in processing work injury
claims; maintains permanent files and records of claims data and benefits issued.
6. Prepares cases for litigation; arranges special investigative medical examinations; attends Workers'
Compensation Appeals Board hearings; researches pertinent statutes as necessary; and rates
permanent disability claims in accordance with the Labor Code, the Schedule for Rating Permanent
Disability and case law.
7. Provides assistance to various human resources staff in answering phones, providing information
regarding job openings and distributing job applications.
8. Routinely adheres to and maintains a positive attitude towards City and Department goals; and
performs related work as required.

Minimum Oualifications:
• Graduation from high school or GED Five (5) of the last eight (8) years on-the job claims
handling, worker's compensation claims or supervising claims adjusters handling worker's
compensation experience. Successfully completing the Self-Insurance Exam written examination
and have either (1) worked as a claims adjuster or supervisor of workers' compensation claims
continuously since passing the examination, or (2) passing the exam within the previous five
years.
• Must complete 30 hours of training every two(2)years.
Post-Designation Training–Continuin�Ed�ucation(CE) Hours Requirement• Claims Adjusters
must complete 30 hours of training every two (2)years.
License or Certificate:
Possession of a valid Class"C"California Driver's License is required.
Must possess a Self-Insurance Administrator's Certificate issued by the State of California within one
(1)year of employment.

4. Advise departments on CAL/OSHA and Federal/OSHA regulations.
5. Advise managers, supervisors, and employees on accident prevention and elimination of unsafe
working conditions.
6. Participate as a member of a City-wide safety committee.
7. Performs a variety of administrative tasks in the City's self-insurance and insurance programs to
include the maintenance of records.
8. Assists Risk Manager in investigating larger exposure claims.
9. Conducts field investigations, takes photographs,records statements, and prepares diagrams.
10. Gathers data for preparation of insurance applications and budget allocations.
11. Analyzes accident and damage reports for potential subrogation actions and liability exposure.
12. Represents the City in small claims court actions.
13. Responds to questions from the public related to risk management matters.
14. Routinely adheres to and maintains a positive attitude towards City and Departments goals.
15. Performs related work as required.
GENERAL QUALIFICATIONS

Must be able to carry a pager and respond to emergency service calls on nights and weekends.
License or Certificates:
Possession of a valid Class `C' California Driver's License.
