CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
Staff Report
Subiect:
Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the
Mayor to execute Amendment No. 6 to the Agreement with the San Bernardino City Unified
School District to provide contractual services for seventeen (17) CAPS before & after-school
programs at school district sites for the period October I, 2006 through June 30, 2007, and
ratifying all action taken between July 1,2006 and the approval of the Resolution.

The Children's After-School Program for Success (CAPS) is a grant funded program
administered by the San Bernardino City Unified School District to provide before & after-
school programs at school sites. The city has been a sub-contractor to the school district in this
program since 1999. Each school site provides teachers and aides to lead educational and
tutorial programs. The Parks, Recreation and Community Services Department provides various
recreational activities to youth in the program. Amendment No.3 covered the term July 1,2006
through September 30,2006 and Amendment No.5 covered the term October I, 2006 through
June 30, 2007 for a total amount of $459,095.
Amendment No.5 covered the balance of this fiscal year from October I, 2006 through
June 30, 2007. The need for Amendment No.6 is due to one school site requiring additional
funding for staff and materials to complete the school year. This increase is $6,792 bringing the
budget total for all 17 school sites to $465,887.
Financial ImDact:
Amendment No.6 will cover staffing costs incurred during the contract period July I, 2006
through June 30, 2007. The authorizing resolution also ratifies all action taken between July I,
2006 and the approval of the Resolution. The grant award will be increased by $6,792 from
$459,095 to $465,887.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
9 SECTION 1. The Mayor of the City of San Bernardino is hereby authorized to execute
10 Amendment NO.6 to the Agreement with the San Bernardino City Unified School District to
11
provide contractual services for seventeen (17) CAPS before & after-school recreation programs
12

at school district sites for the period July I, 2006 through June 30, 2007, a copy of said
13
Amendment No. 6 to the Agreement is hereby attached hereto, marked Exhibit "A", and
14
15 incorporated herein by reference as fully as though set forth at length.
16 SECTION 2. The term of Amendment is July I, 2006 through June 30, 2007; therefore,
17 any action taken between July I, 2006 and the date that this Resolution is executed is hereby
18 ratified.

SECTION 3. The authorization granted hereunder shall expire and be void and of no
further effect if the agreement is not executed by both parties and returned to the Office of the

22 City Clerk within one hundred twenty (120) days following effective date of the resolution.

AGREEMENT FOR CONSULTANT SERVICES IN
COLLABORATION WITH DISTRICT FOR
THE CREATIVE BEFORE AND AFTER SCHOOL PROGRAM FOR SUCCESS (CAPS)
THE AGREEMENT made and entered into the 18th day of July, 2005, by and between the SAN
BERNARDINO CITY UNIFIED SCHOOL DISTRICT, hereinafter referred to as the
"DISTRICT', and CITY OF SAN BERNARDINO PARKS, RECREATION AND
COMMUNITY SERVICES DEPARTMENT, hereinafter referred to as the
"CONSULTANT" is hereby amended this 8th day of November, 2006, hereinafter Amendment
NO.6.
RECITALS
WHEREAS, the DISTRICT is authorized by Section 53060 of the California Government Code
to contract with and employ any persons for the furnishing of special services and advice in
financial, economic, accounting, engineering, legal, or administrative matters, if such persons are
specially trained and experienced and competent to perform the special services required; and,
WHEREAS, the CONSULTANT itself is, or those hired by the CONSULTANT are, specially
trained, experienced and competent to render the special services required by the DISTRICT,
and such services are needed on a limited basis; and,
NOW, THEREFORE, in consideration of the covenants and conditions hereinafter set forth, the
DISTRICT and the CONSULTANT mutually agree to amend this agreement as follows:
L CHANGES TO THE AGREEMENT:
Pal!e 3. Article IV. Consultant's Fee and Payment Thereof, Paragraph A is amended by
deleting the following language from amendments No.3 and No.5:
From Amendment NO.3.
For the period July I, 2006, through September 30, 2006, the DISTRICT agrees to
compensate the CONSULTANT for services rendered in a total amount not to
exceed $110,494.00 (One Hundred Ten Thousand Four Hundred Ninety-
Four Dollars and zero cents).

From Amendment No.5.
For the period October I, 2006, through June 30, 2007, The DISTRICT agrees to
compensate the CONSULTANT for services rendered in a total amount not to
exceed $348,601.00 (Three Hundred Forty-Eight Thousand Six Hundred One
Dollars and zero cents), except that, in the event that CONSULTANT's services
exceed or are less than the not-to-exceed amount of $110,494.00 for the period
July 1 - September 30, 2007, such overage or underage may be applied to the
period of this Amendment No.5, subject to a total not-to-exceed of $459,095.00
(Four Hundred Fifty-Nine Thousand Ninety-Five DoUars and zero cents) for
the full school yearJuly 1,2006 through June 30, 2007.
And replacing it with the following language, which includes additional funding in the
amount of$6,792.00:
For the period July I, 2006, through June 30, 2007, the DISTRICT agrees to
compensate the CONSULTANT for services rendered in a total amount not to
exceed $465,887.00 (Four Hundred Sixty-five Thousand Eight Hundred
Eighty-seven Dollars and zero cents)
IL AMENDMENT CONDITIONS:
Any prior Amendment to this Agreement is hereby revoked to the extent it is inconsistent
with this Amendment. All other terms and conditions will remain in full force and effect.
IN WITNESS WHEREOF, the parties have executed this Amendment NO.6 in duplicate as set
forth below.
