Staff Report
SUBJECT:
Authorization to Proceed - Sale of City Water Department property located northwesterly of
Bonita Vista Drive, south of 40th Street and west of Del Rosa Avenue and Resolution setting fair
market value and a public hearing.
BACKGROUND:
In 1978, the City of San Bernardino Water Department acquired the service area and the real
property assets of Dills on Mutual Water Company, including a 9 foot by 12.5 foot parcel ofland
located northwesterly of Bonita Vista Drive, south of 40th Street and west of Del Rosa Avenue
(Vicinity Map attached). There is a well site located on the property; however, the well was
abandoned at the time the Department took over the service area of Dillson Mutual Water
Company. The site is not used as a source of water supply and the Water Department has no
plans to use this site in the future. Recently the Water Department removed the pump house
located on the property, including the required abatement of all lead based paint.
The parcel is located on a larger parcel of land owned by Alfred M. Sessions (Parcel Map
attached). Mr. Sessions has requested to purchase this parcel since it is surrounded by his
property. Staff has determined the fair market value of this parcel to be a nominal $500 based on
the following criteria: I) The parcel is no longer needed by the City or the Water Department for
its intended use nor any other City use; 2) Due to its size and location, the highest and best use
of the property is to the surrounding property; and 3) The added value to the surrounding
property is of minimal value since the parcel is not needed for access to the surrounding parcel,
but does allow for a more unrestricted use of the surrounding property. Comparable sales would
not be applicable to this parcel based on the above stated issues.
On November 7,2006, the Board of Water Commissioners declared this portion of property to
be surplus land and approved the sale of this property. Attached is a memo outlining the action
taken by the Board. Also attached is a Resolution that sets the fair market value of the parcel of
land at $500, and sets a public hearing for Monday, January 8, 2007. Section 2.65.030 of the San
Bernardino Municipal Code states that property valued at less than $25,000 may be sold without
the need for competitive bid as long as the sales price is not less than the fair market value of the
property.
All affected City departments will be given notice ofthe sale for potential conflicts and the
property will be posted as required by law. A Quitclaim Deed will be prepared and submitted for
action at the time of the public hearing.
FINANCIAL IMPACT:
All net sales proceeds will go to the Water Department. The buyer will pay any recording costs
associated with the sale of this property.
RECOMMENDATION:
Staffrecommends that the authorization to proceed with the sale of the property be given and
that the attached resolution be adopted.

1.
Declare a portion of APN 0155-021-06-0000 (Old Dillson Mutual Water Company Well
Site) as surplus to the needs of the Department and set a nominal value of $500 as the fair
market value of the property; and
2. Approve the Quitclaim Deed for a portion of APN 0155-021-06-0000 (Old Dillson Mutual
Water Company Well Site) to Alfred M. Sessions; and
3. Recommend that the Mayor and Common Council approve the Quitclaim Deed for a
portion of APN 0155-021-06-0000 (Old Dillson Mutual Water Company Well Site) to
Alfred M. Sessions.

RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING FAIR
MARKET VALUE AND MINIMUM SALE PRICE FOR A CERTAIN CITY WATER
DEPARTMENT OWNED PARCEL OF REAL PROPERTY GENERALLY LOCATED
NORTHWESTERLY OF BONITA VISTA DRIVE, SOUTH OF 40TH STREET AND
WEST OF DEL ROSA AVENUE, AND SETTING A PUBLIC HEARING TO CONSIDER
SAID SALE.
WHEREAS, the City of San Bernardino Water Department, a municipal corporation, is
the owner of the hereinafter described parcels of real property, generally located northwesterly of
Bonita Vista Drive, south of 40th Street and west of Del Rosa Avenue in the City of San
Bernardino, State of California, consisting of one parcel, Assessor's Parcel Number 0155-021-
12 06, and more fully described as follows:
That portion of Lot 12, S. W. Little Tract, as recorded in Book 9 of Maps, Page 12,
records of the County of San Bernardino described as follows: Commencing at a point on the
east line of said Lot 12, said point being South 000 04' East, a distance of 135.80 feet from the
northwest corner of said Lot 12; thence west 118.87 feet to the True Point of Beginning; thence
south 12.5 feet; thence west 9 feet; thence north 12.5 feet; thence east 9 feet to the Point of
Beginning.
Total Area: Approximately 112.5 square feet
WHEREAS, the Mayor and Common Council of said City find and determine that there
is no necessity for the City's ownership of said real property; and
WHEREAS, the Mayor and Common Council of said City believe it is in the best
interest of the City that said parcel of real property be disposed of at fair market value; and
WHEREAS, City staff have estimated a fair market value of the parcel at Five Hundred
Dollars ($500.00); and
WHEREAS, the adjacent property owner to this parcel has expressed a desire to

WHEREAS, pursuant to Section 2.65.030 of the San Bernardino Municipal Code, City

7 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The public interest and convenience require the sale of City owned real

Del Rosa Avenue in the City of San Bernardino and same is hereby declared as surplus real
property.

SECTION 2. It is therefore the intention of the Mayor and Common Council ofthe City
of San Bernardino to sell said real property to the adjacent property owner.
SECTION 3. The Mayor and Common Council do hereby find and determine that the
Fair Market Value of this parcel is Five Hundred Dollars ($500.00).
SECTION 4. The Mayor and Common Council of the City of San Bernardino do hereby
set a public hearing to be held on January 8, 2007, at 4:30 p.m or as soon thereafter as the matter
can be heard, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino,
California, relative to the proposed sale.
23 SECTION 5. Notice of the public hearing shall be published in The San Bernardino
24 County Sun, a newspaper of general circulation, at least once prior to the public hearing and shall
be posted in at least 3 conspicuous places on the property at least (10) days prior to the hearing.

SECTION 6. Written and oral protest to such sale may be submitted and shall be
received at or prior to the public hearing. Written protests may also be submitted to the City
Clerk's Office, City Hall, 300 N. "D" Street, San Bernardino, California, prior to the public
hearing.
SECTION 7. It is the intent of the Mayor and Common Council to consider and
approve said sale at the public hearing, said property more particularly described herein.
