STAFF REPORT
SUBJECT:
Public Hearing 10:00 A.M., and Resolution creating Underground Utility District No. 26, Mill Street.
BACKGROUND:
The proposed formation of Underground Utility District No. 26, located along portions of Mill Street between
Lena Road and Tippecanoe A venue, Lena Road between Mill Street and Tennis Court Lane and Tippecanoe
A venue between Central A venue and Benedict Road, was recommended by the Underground Utility District
Committee at the July 2, 1998 meeting.
Southern California Edison Company is required by rule 20 of the Public Utilities Commission to set aside certain
portion of its revenues to finance the cost of undergrounding overhead facilities within districts established by
local agencies. Each agency is allocated a certain amount of funds based upon the total number of overhead
services within the agency's boundaries. The Underground Utility Committee reviews and designates areas
proposed for the establishment of a district.
Underground utilities improve the appearance of a street by removing a clutter of overhead utility poles and lines.
It also eliminates the hazard from lines falling to the ground, which is a result from windstorms and earthquakes
and thunderstorms.
Property owners within the district will be required to complete the undergrounding from their property lines to the
service points at their own cost. No City funds will be required for this project. A public Hearing will be
scheduled September 8, 1998 at 10:00 a.m., in the Council Chambers and all property owners within the proposed
district will be notified by mail of the proposal. There are approximately six parcels that will need to convert their
utility service from overhead to underground.
The formation of this district was proposed as a result of the proposed widening of Mill Street, which would
require the utility lines and poles be relocated to accommodate construction. The formation of this district would
allow the utilities to be placed underground using Rule 20 allocations, in lieu of relocation.
On August 3, 1998, authorization to proceed was granted and Resolution No. 98-232 was adopted, setting a public
hearing for September 8, 1998. All affected property owners and utility companies were given notice by mail.
There are approximately 7 parcels that will need to convert their utility services from overhead to underground.
The cost for these conversions will be paid for by the property owners, and the City will not incur any cost.
The boundaries of the district have been changed to exclude certain parcels not affected by this project and an
amended map, drawing No. 9848A, is on file in the office of the City Clerk. A reduced copy is also attached.

RECOMMENDATION:
We recommend that the hearing be closed and that the attached Resolution Creating Underground District No. 26
be adopted.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF

GENERALLY LOCATED ALONG PORTIONS OF MILL STREET, BETWEEN LENA
4 ROAD AND TIPPECANOE AVENUE, LENA ROAD BETWEEN MILL STREET AND
5 TENNIS COURT LANE AND TIPPECANOE AVENUE BETWEEN CENTRAL
AVENUE AND BENEDICT ROAD.

WHEREAS, a public hearing was held on September 8, 1998 at 10:00 a. m. or as soon
thereafter, at the Council Chambers, 300 North "0" Street, San Bernardino, California, to
9 determine whether the public necessity, health, safety or welfare required the formation of an
10 Underground Utility District No. 26 located along portions of Mill Street between Lena Road
11 and Tippecanoe Avenue, Lena Road between Mill Street and Tennis Court Lane and Tippecanoe

Avenue between Central Avenue and Benedict Road, San Bernardino, California; and
WHEREAS, notice of said hearing has been given to all affected property owners as
shown on the last equalized assessment roll and to all utilities concerned in the manner and for
the time required by law; and

WHEREAS, said hearing has been duly and regularly held and all persons interested
18
have been given an opportunity to be heard.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. It is hereby found and determined pursuant to Chapter 13.36 of the San
22
23 Bernardino Municipal Code of the City of San Bernardino, and to definitions contained therein
24
that the public necessity, health, safety and welfare require the formation of an underground
25 utility district, located along said public streets as described herein, in order to remove utility
26
poles, overhead wires and associated structures and to underground utilities along said portions
27
of said streets.

SECTION 2. An underground utility district to be known as Underground Utility
5 District No. 26 is hereby established in that area located along portions of Mill Street between
6 Lena Road and Tippecanoe Avenue, Lena Road between Mill Street and Tennis Court Lane and
7 Tippecanoe Avenue between Central Avenue and Benedict Road, and more particularly shown

on amended Drawing No. 9848A by the Enginering Division, Department of Public Works, City
of San Bernardino, on file in the office of the City Clerk's office of the City of San Bernardino.

SECTION 3. All poles, overhead wires and associated overhead structures shall be
11
12 removed and underground installations made in said underground utility district within the
13

following times:
a. Underground installation by utility companies and property owners and
construct reconnections not later than June 30, 1999.
b. Removal of poles, overhead wires and other associated structures not
later than August 31, 1999
SECTION 4. The City Clerk is hereby directed to mail or cause to be mailed a copy
hereof and a copy of Chapter 13.36 of the San Bernardino Municipal Code at the City of
San Bernardino, to all affected property owners as shown on the last equalized
assessment roll and to all affected utilities within ten (10) days after the adoption of this
