Synopsis of Previous Council ection:
July 20, 1992, the hearing was continued for 6 months to resolve outstanding
items, apply for a General Plan Amendment and complete repairs to the motel.
Recommended motion:
That the hearing be continued to April 5, 1993 to allow completion of
General Plan No. 92-11, completion of the necessary improvements and
issuance of Certificates of Occupancy.

Appeal of the Hearing Officer's Statement
regarding the revocation of Conditional
Permit No. 262, the Golden Eagle Motel.

The request before the Mayor and Common Council on January 20, 1993
is to continue the appeal hearing until April 5, 1993.
BACKGROUND
The full background is contained in the staff report to the Mayor
and Common Council dated April 21, 1992 for the May 4, 1992
meeting. Briefly, the city initiated revocation proceedings
against the Golden Eagle Motel. A series of hearings were held,
and the Hearing Officer issued a Statement of Decision on March 10,
1992. The CDP was not revoked, but certain conditions were added.
The decision was appealed to the Mayor and Common Council and was
continued several times. At their meeting of July 20, 1992 the
Mayor and Common Council continued the hearing for six months to
resolve outstanding items including the submittal of a general plan
amendment application and the completion of necessary repairs to
the motel.
General Plan Amenament No. 92-11 was submitted on September 10,
1992 and is being processed. It is scheduled for review by the
Planning Commission on February 2, 1993, with review by the Mayor
and Common Council on March 1, 1993.
A continuance of the appeal of the Hearing Officer's Statement of
Decision hearing will enable staff to complete the general plan
amendment process. It will also allow the applicant to complete
the necessary repairs so that certificates of Occupancy may be
issued, and the matter resolved.
Attached is a letter from Henry Empeno, Deputy City Attorney, to
Kenneth Nydam, attorney for the owners of the Golden Eagle Motel.
The letter confirms support of the continuance of the hearing to
April 5, 1993.

Dear Mr. Nydam:
This letter is to confirm our telephone conversation on January 5,
1992, in which you agreed to request that the Mayor and Council
continue the above-referenced Hearing from January 20, 1993 to the
Council Meeting on Monday, April 5, 1993.
You requested this continuance in order to allow the Planning
Commission and the Mayor and Council to act upon your clients'
pending application for General Plan Amendment No. 92-11, currently
scheduled for the February 2, 1993 Plan~ing Commission meeting and
the March 1, 1993 Council Meeting. In our telephone conversation,
you stated that after the City approves General Plan Amendment No.
92-11 and the City issues Certificates of Occupancy for the Golden
Eagle Motel, your clients will withdraw their appeal of the Hearing
Officer's Statement of Decision.
