S T A F F R E P 0 R T TO: Honorable M:aor and Members ~hJ.'7;~ vL/oz/ Bar ara Dillon, Director of of the Common Council FROM: Personnel DATE: January 12, 1993 Results of Decertification/Recognition Election _ General Employees Bargaining Unit RE: ---------------------------------------------------------------- Prooosed Action Receive and file the attached Results of Representation Election submitted by the State Mediation and Conciliation Service for the secret ballot election held on the decertification/recognition question between the American Federation of State, County and Municipal Employees (AFSCME) Local 122, AFL-CIO, and the San Bernardino Public Employees Association (SBPEA), and certify the San Bernardino Public Employees Association (SBPEA) as the General Employees Bargaining Unit. Backaround Information In October 1992, the San Bernardino Public Employees Association (SBPEA) challengad the incumbent organization, the American Federation of State, County and Municipal Employees (AFSCME). Pursuant to the Rules and Regulations Implementing Employer- Employee Relations and provisions governing "Decertification/Recognition" of Bargaining Units, a secret ballot election was conducted to resolve the questions as to which employee organization shall be accorded exclusive representation rights on matters affecting employees' wages, hours, and other terms and conditions of employment. A secret ballot election was conducted under the supervision of the State of California Mediation and Conciliation Service. A total of 551 general unit employees were eligible to vote. The Notices of Election were properly posted between December 11 and December 16, 1992 and ballots were mailed to all eligible employees on December 28, 1992. Assisting Mr. Mrvichin were Tom McCarthy and Douglas Thompson of the State Mediation and Conciliation Service. Also present on behalf of the City were: Barbara Dillon, Director of Personnel; Diane Roth, Depu";:y City Attorney; Rachel Clark, City Clerk; Melanie Vale, Deput:y City Clerk; and Brenda Wilder, Personnel Assistant. Of the 551 general unit employees eligible to participate in the election, 392 voted. The attached Results of Representation Election dated January 12, 1993 provides a detailed report on the number of ballots challengedjreject:ed; the number of valid ballots; and, the final result:s of votes cast. The Results of Representation Election have been duly signed by Draza Mrvichin of the California State Mediation and Conciliation Service and by the respective observers. RECOMMENDED FORM MOTION: That the Mayor and Common Council acknowledge receipt of the Results of Representation Election dated January 12, 1993 and certify the San Bernardino Public Employees Association (SBPEA) as the General Employees exclusive bargaining unit agent. RESOLUTION OF THE CITY OF SAN BERNARDINO CERTIFYING SAN BERNARDINO PUBLIC EMPLOYEES' ASSOCIATION AS THE EXCLUSIVE BARGAINING UNIT FOR GENERAL EMPLOYEES. WHEREAS, an election has been conducted pursuant to the requirements of City of San Bernardino Resolution Nos. 10585 and 12634 to determine the majority representative of the General Unit employees; and, WHEREAS, the Designated City Representative has determined pursuant to such election that the San Bernardino Public Employees' Association represents a majority of the employees in the General Unit; and, WHEREAS, the Designated City Representative has determined pursuant to such election that the American Federation of State, County and Municipal Employees Local #122 no longer represents a majority of the employees in the General Unit. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 18 SECTION 1. Receipt of the results of the General Employees' 19 representation election, dated January 12, 1993, is hereby 20 acknowledged. 21 SECTION 2.
