BACKGROUND: As a result of recent development proposals within San Bernardino International Airport (former Norton Air Force Base) along the south side of 3rd Street, the widening ofJrd street will be necessary pursuant to the requirements of the proposed industrial development and Circulation Element of the City's General Plan. Presently, the common corporate boundaries between the City of San Bernardino and the City of Highland in this area run along the south side of 3rd Street between Tippecanoe A venue and a point approximately 232 feet east of Shirley Avenue, with the exception of the area between Del Rosa Drive and Del Rosa A venue, south of Court Street. The City of Highland has jurisdiction over the entire portion of 3rd Street for this area, except as noted above. Currently, the City of Highland would need to process any permits for street improvements, including curb cuts for driveways, that would occur as a result of development in the airport, which is under the jurisdiction of the City of San Bernardino. The City of Highland has requested this realignment of boundaries to minimize any dual jurisdiction involvement for development that occurs along this portion of the airport. Additionally, Highland is recommending a change of boundaries for a portion along the north side of 3rd Street, lying between Del Rosa Drive and Del Rosa Avenue, south of Court Street, since the portion along 3rd Street, between Tippecanoe Avenue and just east of Shirley Avenue is within Highland's jurisdiction. A vicinity map and a map depicting the present and proposed boundary change is attached. Under this Reorganization proposal, no parcels would be annexed to the City of San Bernardino; Eleven parcels would be de-annexed from the City and annexed by the City of Highland. The present land use of the area to be de-annexed is a combination of residential, commercial, vacant and public facility. More specifically, there are 4 vacant parcels; 2 parcels contain a well site for East San Bernardino County Water District; 3 residential parcels and 2 commercial parcels, one of which is a boarded up market, and the other appears to be an auto repair facility. As part of the proceedings, Highland will contact the property owners within the area proposed to be annexed to the City of Highland. The formal proceedings to be conducted by LAFCO will include mailed notices to the property owners within the area to be annexed and a public hearing will be conducted by LAFCO. If a majority protest is made by the property owners, the Reorganization could be modified to exclude this area and address only the issue of realigning the boundary along the centerline of 3rd Street. If the Reorganization is approved as proposed, the property tax revenue, which is estimated to be approximately $600 per year to the City of San Bernardino, would go to the City of Highland. Actual tax revenue dollars will be calculated as part of the proceedings. Since the area is within the Inland Valley Redevelopment Agency's (IVDA) boundary, most of any increases in property tax revenue (tax increment dollars) as a , , result of new development or redevelopment of this area, would go to the IVDA regardless of which City has jurisdiction of this area. The benefit to the City of San Bernardino for this Reorganization would be a more orderly development of the airport along this portion of 3'd Street, since the permit process for street improvements would be handled by one City, rather than two. The de-annexation of the block between Del Rosa Drive and Del Rosa Avenue from the City of San Bernardino and annexation to the City of HigWand would benefit the area by a more efficient delivery of services, including Police, Fire and Code Enforcement, since the area is bounded on three sides by the City ofHigWand and would reduce the confusion of public safety calls and have consistency ofland use regulations on all properties on the northerly side OD'd Street. The area containing the eleven privately owned parcels contains approximately 2.75 acres (including adjoining streets). This small peninsula of eleven parcels protruding north above 3'd Street into the City of HigWand was annexed in 1976 to the City of San Bernardino, prior to the incorporation of Highland in 1987. The perimeter of this block is approximately 1400 feet (measured along the centerlines of the adjoining streets). Currently, the City of San Bernardino would be responsible for maintenance of any existing curbs, gutters and sidewalks. If de-annexed from San Bernardino, future responsibility for such street improvements would be HigWand's. The area presently receives water distribution from East Woods Farms Community Water and maintenance of sewer lines is under the jurisdiction of East Valley Water. Water and sewer services would remain the same after this reorganization. Attached is a summary of pros and cons relative to the annexation of this block to the City of Highland. The City of HigWand has offered to act as lead agent for the Reorganization. HigWand will pay the necessary filing fees. If this proposal to initiate proceedings is approved, the City of HigWand will prepare the necessary documents needed to be filed with the Local Agency Formation Commission (LAFCO). The final documents will be submitted to the City of San Bernardino for review and approval prior to being filed with LAFCO. FINANCIAL IMPACT: The City of Highland will pay any LAFCO fees for this proposal. Estimated tax revenues of $600 per year will go to the City of HigWand, however, they will also assume the responsibility of street maintenance, police and fire protection and other related municipal services for this area. RECOMMENDATION: Adopt Resolution , ' ATTACHMENT A SUMMARY OF PROS AND CONS OF DEANNEXATION OF THE BLOCK OF ELEVEN PARCELS PROTRUDING NORTH ABOVE 3RD STREET · Reduction of the City of San Bernardino's responsibility to maintain approximately 1400 linear feet of street improvements. . Increased clarity of the boundaries of the City limits of the two cities. · Loss of approximately $600 in annual property tax revenue to the City of San Bernardino · The cost of services (such as Police Department, Fire Department, Code Enforcement, Public Services Department, etc.) appears to exceed revenues to the City of San Bernardino. However, in the event that a significant sales tax revenue generator would locate in this block in the future, the revenue would go to the City of Highland. · The annexation to Highland would benefit the area by a more efficient delivery of services since the block is currently bounded on three sides by the City of Highland. SUMMARY OF PROS AND CONS OF REALIGNING CITY LIMITS BOUNDARY ON 3RD STREET CENTERLINE . The City of San Bernardino would become responsible for maintaining the street improvements extending from the existing boundary north approximately 50 feet to the centerline OO'd Street. . The City of San Bernardino would gain jurisdiction and process permits over the street improvements (including curb cuts for driveways) serving future industrial development on the airport properties. . In addition, the Subcommittee considered the inclusion in the annexation/detachment between the two Cities, that portion of the City of San Bernardino on the north side oD'" Street be conveyed to the City of Highland. It is the Subcommittee's opinion that such a exchange in territory would be beneficial (i.e., both the southerly side of 3'" Street and that portion north of 3'" Street) to both Cities in that it would assist the public and property owners in understanding the jurisdictional lines of the two Cities, reduce the confusion of public safety calls, and have consistency of land use regulations on all properties on the northerly side oD'" Street. An "Area Map" is attached depicting the areas to be considered for the annexation/detachment between the two Cities. Ine. 1987 Fred Wilson City Administrator City of San Bemardino 300 North D Street San Bemardino CA 92410 Dear Fred: On April 30, 2001 the Highland City Engineer and City Planner met with representatives from your Planning and Traffic Departments to discuss the design of and access to Third Street relative to a proposed project known as Norton Tech Park, This project will be located south of Third Street between Tippecanoe and Del Rosa Drive within the IVDA project area. The nature of the project is primarily warehousing with some office use. Since Highland's city limit boundaries extend beyond the south side of Third Street, San Bernardino staff suggested that both cities enter into an agreement so that San Bernardino could maintain the southerly half of Third Street. This would also Include allowing San Bernardino to be responsible for plan checking, permitting and Inspection of any necessary street work south of the Third Street center line, which would be within the city limits of the City of Highland. Third Street is the only area where the city limit boundary that abuts another city is not at the centerline. We do not know why LAFCO allowed an annexation that would not be to the ~nterllne. . .. . I have discussed this maller with the Highland Public Works Subcommittee and they asked me to talk to you regarding a possibility of detaching the area on the south side of Third Street from Tippecanoe to approximately 232 feet east of Shirley Avenue. Further, we believe in an effort to clean up the area that is a small portion of land north of Third Street between Del Rosa Drive and Del Rosa Avenue should detach from San Bernardino and be annexed to Highland. Such actions would require LAFCO approval for detachment and annexation and would make good business sense In cleaning up the situation along Third Street. These actions would allow the Norton Tech Park Project to go forward without undue bureaucratic paper work and agreements.
