SUBJECT:
Resolution of the Mayor and Common Council of San Bernardino authorizing an
amendment to the agreement and purchase order to Bryan A. Stirrat & Associates
(BAS) for permits, design, and equipment acquisition to complete installation of gas
treatment system for the Waterman Landfill site.
BACKGROUND:
From 1950 to 1959 the City leased the approximately 19-acre property along Vanderbilt
and Carnegie and used the location as a municipal landfill. The location is commonly
referred to as the Waterman Landfill. Since 1961 Waterman has been in private
ownership. The current owner is the Glenborough Realty Trust. Until 1995
Glenborough performed the monitoring activities at the landfill site. In 1995 the City
accepted a greater role in the groundwater monitoring and landfill gas monitoring of the
site because the City was responsible for the trash buried at the site. Since that time
the City has acted in response to the regulatory requirements of the Regional Water
Quality Control Board and the Air Quality Management District. These agencies have
joint responsibility for the proper capping and monitoring of closed landfills.
In 2004 the City entered into an agreement with BAS to design and construct a landfill
gas collection system at Waterman Landfill. Since that time the City has made
incremental steps to finalize system installation. A permanent engineered soil cap has
been designed, installed and accepted by the Regional Water Quality Control Board.
Landfill gas collection pipes have been installed and a three-month temporary gas
treatment study completed. BAS utilized study results to develop a permanent
treatment facility design and submitted permit applications to the Air Quality
Management District for the system installation. Our permit will be issued any day and
staff is looking forward to the completion of the construction portion of this project.
Last fiscal year the City authorized a $200,000 increase in the purchase order to BAS
for required regulatory permits from the AQMD, for design, and to purchase long lead-
time items for the permanent treatment facility. At that time staff stated the remaining
facility costs would be budgeted in FY 2006/07. The attached spreadsheet details
$478,411.24 in final equipment acquisition and installation costs. Staff recommends a
second amendment to the 2004 Agreement to incorporate this staff report, letter and
cost estimate from BAS. This action would raise the purchase order totals amount from
$1,196,227 to a not to exceed total of $1,674,639 to complete final system installation.
Glenborough plans to construct a high rise building adjacent to the closed landfill and
plans to construct a parking lot on a portion of the northern section of the closed landfill.

collection system.
FINANCIAL IMPACT:
BAS has identified final construction costs of $478,41124 and has submitted the
attached letter and program cost listing. This amount is budgeted in Account 527-415-
5505.

INSTALLATION OF GAS TREATMENT SYSTEM FOR WATERMAN LANDFILL.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCil OF THE CITY OF SAN BERNARDINO AS FOllOWS:
SECTION 1. Bryan A. Stirrat & Associates provides design and construction
engineering support services relative to the Waterman Landfill cover improvement
construction. On January 12, 2005 the Mayor and Common Council approved a first
amendment with, and the issuance of a purchase order to, Brian A. Stirrat and
Associates for the design and construction of a landfill gas collection and treatment
system and improvements to the Waterman Landfill cover system in a total amount of
$996,22700
SECTION 2. City staff has identified final construction project costs mandated
by the Air Quality Management District. The final costs are pursuant to the staff report
dated October 9, 2006 as presented to the Mayor and Common Council at their
regular meeting held on November 6, 2006. The Mayor is hereby authorized to
execute the attached Agreement Modifying Contract authorizing an increase of
$478,411.24 to a total not to exceed purchase price of $1 ,674,639.00.
SECTION 3. The Purchasing Manager is hereby authorized to increase a
purchase order that shall incorporate by reference this Resolution No. 2006-_, and
the Purchase Order shall read, "Bryan A. Stirrat & Associates, design and construct
landfill gas collection; and cover system improvements - Waterman Landfill: Second
27 Amendment in accordance with the staff report dated October 9, 2006. Not to exceed
28 a total cost of $1 ,674,639.00.

AGREEMENT MODIFYING CONTRACT
This Agreement is entered into this day of 2006, by and
between BRYAN A STIRRAT & ASSOCIATES (BAS) ("CONSULTANT") and the City
of San Bernardino ("CITY" or "San Bernardino").
RECITALS
A. On May 6, 2004, Bryan A Stirrat and the City of San Bernardino entered into
written contract entitled "Proposal To Provide Services Related to Closure of the
Waterman Landfill" dated March 30, 2004, for the design and construction of a gas
collection system at the Waterman Landfill for a not to exceed amount of $784,604.00,
a copy of which is attached hereto as Exhibit A" and incorporated by this reference.
B. Thereafter, on January 11, 2005, the City authorized an increase of
$211,623.00 of the contract to pay for project design and landfill cover.
C. Thereafter, on May 19,2006, the City authorized an increase of $200,000 to pay
for regulatory permits and purchase of long lead items.
D. The CITY and CONSULTANT now desire to alter the contract to increase the
amount of the contract $478,411.24, to a total not to exceed purchase price of $1 :6114,
639.00.
AGREEMENT
In consideration of the mutual promises contained in the Agreement, the parties
agree as follows:
1. The total contract price shall be increased by $478,411.24, to a not to
exceed purchase price of $1,674,639.00.
2. The other provisions of the written contract are reaffirmed as originally.

Dear Mr. Merrill:
Pursuant to your request, Bryan A. Stirrat & Associates (BAS), with our affiliate
geotechnical firm, Geologic Associates (GlA), and subcontractor, The Regenesis Group
(TRG) is pleased to provide the City of San Bernardino (City) the following scope of work
and fee estimates to provide services related to the closure of the Waterman landfill
(Project).
The Project involves the design and construction of a landfill gas collection and treatment
system (lFG system) and improvements to the landfill cover system. The plans and
specifications for the cover system have been previously prepared by BAS and submitted
to the City. The plans and specifications for the lFG system will be developed by BAS as
part of this project.
Due to budget and time constraints, the City prefers that the project be completed using
only City forces and BAS forces in lieu of putting the project out to bid. The proposed
tasks to be provided by BAS are described in the Scope of Work (SOW) below. The
SOW is divided into two sections. The first section describes services related to the
landfill cover, and the second section describes services related to the lFG system.
SCOPE'OF WORK
. SECTION 1 - SERVICES RELATED TO THE lANDFIll COVER
TASK 1.1
ATTEND MEETINGS
Several meetings will be required during the course of the project. These meetings
include, but are not limited to meetings with reguiators, progress meetings with the City,
and meetings with material/equipment suppliers.
BAS' proposed budget includes estimated hours by staff category during the course of the
project. BAS will bill under this task for meeting costs including time and expenses.

TASK 1.2
CONSTRUCTION ENGINEERING SUPPORT
BAS will provide construction engineering support which will consist of coordination with
the City Superintendent, the cover soil supplier, and the CQA staff during the project to
assist in achieving the construction that conforms to the Project Plans, Specifications, and
applicable regulatory approvals. In addition, BAS will review the construction and
contract-related documentation.
A brief summary of tasks to be performed as a part of t~e engineering support follows:

Construction Services
The following section outlines the scope of work anticipated during the construction:
Corrective Action Items
BAS will document in Weekly reports, any deficiencies noted in the construction activities
or in material delivered to the site. These deficiencies will be brought to the City's
attention immediately so that corrective action can be taken as soon as possible to
minimize the impact on the overall constructian schedule.

appraved by the Design Engineer and, if applicable, the CQA Officer.

minimum the fallawing issues will be cavered:

BAS will document all discussions at the progress meetings and will prepare meeting
minutes for distribution to all attendees prior to the next scheduled meeting.

Proiect Close-out
The record drawings will be reviewed for accuracy and conformance with BAS' records.
The record set will be used to update a design drawing set and will be supplemented by
additional survey. As the City's Design firm, the project plans will already be in our
AutoCAD system thus providing for timely and efficient issuance of record drawings.
When record drawings have been finalized, one reproducible set of drawings, and the
selected AutoCAD file, will be transmitted to the City.

Upon completion of BAS' review and completion of all "punch list" items, a final close out
report will be prepared which will detail recommendations as to the acceptability of the
work and its conformance to the intent of the plans and specifications. Once construction
is complete, and the City has submitted their redlined mark-up of the construction
drawings, the BAS Project Manager will review the Project Record Drawings and finalize
to the City with appropriate comments.
TASK 1.3
SURVEY
BAS will provide construction survey (control staking) for the City's construction crews. It
is anticipated that one day per week will be utilized to set control stakes. The City may
have to provide a grade checker to establish intermediate grades. This will be necessary
for two reasons. The first is to verify that the cover thickness meets the regulatory
requirements. The second is that this information will be used in the Final Close Out
Report to show existing grades, proposed grades and final grades, and allow for
certification of the Close Out Report in compliance with the approved plan. If the City
crew wishes to supplement this survey with additional information, the Crew Chiefs can
coordinate.
TASK 1.4
PROJECT ADMINISTRATION/PREPARE FINAL REPORT
This task is comprised of the following activities:

CONSTRUCTION QUALITY ASSURANCE MONITORING.
GLA will complete a borrow source evaluation study to assess the adequacy of soils
proposed for the cover repair project by the City or its subcontractor. The borrow
study will involve mobilization of a hollow-stem drill-rig to excavate exploratory
boreholes at the borrow site, retention of soil samples for laboratory analyses, and
,
computer modeling to simulate the transient flux of moisture that may infiltrate cover
soils in the future.
As shown on Table 1, GLA expects that the drill rig will be employed for
approximately 3 days (30 hours total) at.up to 3 potential borrow sites in the area.
During this period, GLA will provide an experienced geologist who will log the
borings and retain samples for subsequent laboratory analyses. Following
confirmation that the soils have appropriate gradation and permeability
characteristics, modeling will be completed to verify that the moisture flux through
the cover soils will be at acceptable levels.
Approximately one week after the modeling work is completed, a memorandum will
be prepared for City and RWQCB review that details the borrow evaluation work that
was completed and which substantiates the suitability of the proposed borrow soils
for use in the Waterman Landfill Cover Repair Construction work.
TASK 1.6
CQA SE~VICES
GLA will provide field technicians to observe and test the cover fill soils to assure
compliance with the Project Specifications. It is our understanding that fill material
will be selectively excavated at the off-site borrow source(s), moisture conditioned as
necessary, and placed as compacted fill to form the monolithic final cover.
The following summarizes GLA's scope of work for CQA services:
1. Periodic visits and inspections of the borrow excavation to visually observe soils
exposed in the excavation and to obtain soil samples for laboratory testing.
2. Laboratory testing of borrow soils to assure their suitability for the cover repair
project.
3. Monitoring and compaction testing of the reprocessed and recompacted upper
6 inches of the existing foundation layer material.

4. laboratory and field testing to evaluate the in-place characteristics of fill
materials.
5. Informing City and the Construction Manager of any soil related conditions that
are non-conformant with the Project Specifications.
6. Observation and monitoring during construction of civil improvements.
7. Preparing a final report summarizing the results qf CQA observation and testing.

gradation and hydraulic conductivity criteria as set forth in the Project Specifications
and Earthwork-Quality Assurance Plan and at a minimum will be evaluated based on

During the construction period, GlA's field technician will regularly visit the landfill
and borrow excavation(s) to visually observe the work, perform field testing. and to
obtain samples for laboratory analyses_ While the contractor's excavation and fill
placement rates will govern the time required of the field technician, for proposal
purposes, GlA anticipates that the technician may be required for 5 or 6 hours each
working day_
During construction, GLA will submit to the City a summary of field and laboratory
test results approximately every other week. Approximately one month after the
completion of construction, GlA will submit a Draft Report of CQA Services for City
review. This report will summarize construction activities and laboratory and field test
results, and provide certification by a State of California Certified Engineering
Geologist that construction was performed in accordance with the minimum
requirements of the Project Specifications. A final report of CQA Services will be
submitted approximately one week after receipt of City comments to the Drafi report.
FEE ESTIMATE FOR TASK 1
The anticipated fee estimate to complete Task 1 is provided in Attachmentl. The totals
listed in Attachment 1 for geotechnical laboratory testing are consistent with the testing
frequency identified in the CQA Plan and listed above. The fee estimate provided is for
budget purposes and work will be billed at the rates indicated on our current rate
schedules, copies of which are also attached. ,

BAS and GLA will commit to the project the necessary manpower to meet the City's
schedule and provide responsible construction services throughout the duration of the
project. This fee estimate was based on the following assumptions, our past experience
with similar projects, and the anticipated duration of construction.

. Construction is based on a 65-day working schedule.

SECTION 2 - SERVICES RElATED TO THE lFG SYSTEM
TASK 2.1
ENGINEERING SUPPORT SERVICES
Task 2.1.1

In this task, BAS will develop construction drawings (the level of details is intended for a
design/build type of project) for the lFG system including the following:

. LFG treatment system process piping diagram
As part of the design process, BAS will perform the calculations necessary to estimate lFG
flow rates and extraction system pipe sizes. BAS will provide the City with a preliminary
set of drawings for comment, and include City comments on the final, wet stamped set.
Deliverable: One set of preliminary lFG system drawings on bond, and one set of final
lFG system drawings on Mylar.
Task 2.1.2
SCAQMD Permit Application
In this task, BAS will prepare applications for South Coast Air Quality Management District
(SCAQMD) Permits to Construct/Permits to Operate. Up to three (3) separate permits
may be required; lFG extraction system, treatment facility, and condensate management
system. Each permit will include a cover letter, the appropriate SCAQMD standard forms,
calculations, preliminary drawings, and a check for the application fee (the costs
a;sociated with any permit fees are not included in our cost estimate, and it is our

assumption that these fees will be provided by the City), The treatment facility permit
application package will include all necessary health risk calculations for the chronic and
acute assessment, as well as the "one in a million calculation." BAS will submit the
application to SCAQMD on behalf of the City. Processing oJ the permit application by
SCAQMD can take several months, but if necessary, the City can expedite the process by
paying additional overtime fees to SCAQMD.
Deliverable: One copy of each permit application.
Task 2.1.3

Following completion of the 'LFG extraction system, and after allowing the system to
stabilize, BAS will test the quality and quantity of the LFG for the purpose of selecting the
app'ropriate treatment technology. Potential treatment technologies include enclosed
ground flare, thermal oxidizer, and activ~ted carbon. The selected technology will be
dependent on methane content and flowrate.
This test will involve extracting LFG for a period of four weeks using a rented trailer-
mounted thermal oxidizer. BAS will monitor LFG flowrates, methane content, and
condensate levels in the sumps and the City will pump and disposed of condensate during
the tf'st if necessary.
Deliverable: One copy of LFG quality test report.
Task 2.1.4
LFG Treatment System Equipment Procurement Specifications
Based on the results of the LFG quality and quantity test, BAS will prepare technical
specifications to be used by the City to procure a LFG treatment facility. The
specifications will include requirements for equipment performance, warranty, startup,
testing. and operating manual. The City will attach this specification with City
procurement documents and send to bidders.
Deliverable: One copy of specifications.
Task 2.1.5
Source Test LFG Treatment System
In this task, BAS will procure the services of a source testing firm and air lab, coordinate
with SCAQMD, supervise and oversee the source test, and submit the report to
SCAQMD.

Task 2.1.6
Construction Manal(ement and Start-Up of LFG System
In this task, a BAS construction manager will be onsile full-time during construction in
order to supervise and oversee work conducted by City staff. BAS will photo log

construction activities, log wells, and document man-hours, equipment hours, and daily
work in place and work in progress. BAS will redline construction drawings, and produce
as-builts for the project. The budget for this task is based on 65 working days construction
duration. BAS will also document the end of construction byway of a construction
certification report.
Following construction of the LFG System, BAS will perform startup activities. Startup
activities include shakedown, troubleshooting, and performance testing of the treatment
facility, monitoring the boundary probes, and balancing the wellfield. These activities
typically require approximately 1 month at which time the system should be stable and
the probes should be in compliance. .
Deliverable: Construction Certification Report, Photo Log.
Task 2.1.7
LFG System Routine Operation and Maintenance
Following startup, BAS will perform routine Operation and Maintenance (O&M) activities
on the System for a period of one year, beginning after startup activities are complete.
Routine O&M includes the following activities:
. Prepare a site specific ope'ration and maintenance manual for operation of the
well field and treatment facility.
. Monitor wells every two weeks, and adjust as necessary.
. Monitor condensate holding tank and call for pump-out as necessary. City will pump
and dispose of condensate. (City should investigate connection to sewer system).
. Monitor, adjust and maintain the treatment facility weekly.
. Perform SCAQMD 1150.1 compliance monitoring:
1_ Boundary probe sampling and analysis (monthly)
2. Integrated surface sampling (monthly)
3. Instantaneous surface monitoring (quarterly)
4_ LFG sampling and analyses at treatment system (monthly)
5. Ambient air sampling (monthly)
6_ Submit 1150_1 reports to SCAQMD (quarterly)
BAS can, as an optional task, prepare an application to SCAQMD for an Alternative
Monitoring Plan (AMP) which, if approved by SCAQMD, would result in less stringent
1150.1 monitoring requirements for the site_
Non-routine activities, and emergency O&M are also available on a time and expense
basis at the request of the City.
Deliverable: Monthly O&M reports and quarterly 1150.1 reports.

. Construction is based on a 6s-day working schedule.
TASK 2.2
CONSTRUCTION SERVICES
BAS construction forces will work with City construction forces to construct the LFG
System. BAS estimates that the LFG collection system will consist of thirty (30) twenty five
foot deep wells installed approximately 50-feet inside from the edge of the waste
perimeter, a 6" LFG header buried around the outside perimeter of the waste, 12
pneumatic condensate sumps, and all associated piping. The LFG treatment system will
be either .l flare, thermal oxidizer, or activated carbon system, and will include a
compressed air system. The estimated construction duration is 65 days. If the
construction period were to exceed the 65 days estimate, services will be rendered on
time and expense basis in accordance with the BAS standard rates schedule. A brief
description of proposed work is as follows:
. BAS will install LFG wells complete with wellheads and wellhead boxes, ready for
connection to well laterals using hose clamps. The City will supply dumpster and
dispose of well cuttings.
. BAS will supply and weld (using butt-fusion welding) the LFG header pipes, lateral
pipes, air pipes and condensate pipes in sections with flanged end connections (air
and condensate piping is supplied in rolls). The City will dig the pipe trenches, install
the piping in the trenches, and backfill/compact the trenches.
. BAS will supply condensate sumps. The City will dig the sump holes and place the
sumps in the holes. BAS will connect the sumps to the header, air, and condensate
piping. The City will backfill and compact the sumps.
. The City will construct the treatment system site, including concrete, electrical, fencing.
etc., and supply and install the treatment system under the direction of BAS. BAS will
connect the LFG header to the treatment system, and start-up the system.

RECITALS
BAS shall indemnify, defend and hold free and harmless the City, its officers, and its
employees from all claims, damages, costs, expenses, and liability, including. but not
limited to attorney's fees, imposed upon them for any alleged infringement of patent rights
or copyrights of any person or persons in consequence of the use by City, its officers,
employees, agents, and other duly authorized representatives, of programs or processes
supplied to City by BAS under this Agreement.
The prevailing party in any legal action to enforce or interpret any provisions of this
Agreement will be entitled to reCover from the losing party all reasonable attorneys' fees,
court costs, and necessary disbursements in connection with that action. The costs, salary,

BAS shall maintain insurance policies meeting the minimum requirements set forth herein.
All insurance maintained by BAS shall be provided by insurers satisfactory to the City.
Certificates evidencing all insurance coverage required herein shall be delivered to the
City prior to BAS performing any of the services under this Agreement. All insurance
certificates required herein shall name the City as an additional insured and provide for
thirty-(30) days written notice from the insurer to the City prior to cancellation of any
insurance policy of BAS.
Comprehensive Generalliabilitv and Automobile Insurance
BAS shall maintain comprehensive general liability and automobile liability
insurance with a combined single limit of not less than One Million Dollars
($1,000,000.00) per occurrence.
Worker's ComDensation Insurance
BAS shall maintain worker's compensation insurance in accordance with the laws
of the State of California for all workers employed by the Vendor.
LIMITATIONS
The work proposed herein will be performed in accordance with sound engineering and
construction practices. However, implementation of the proposed services does not
guarantee regulatory compliance of the site. As with any mitigation plan, environmental
monitoring may indicate the need for additional measures in the future.
BAS will not be responsible for air emissions from the site, subsurface LFG migration from
the site, groundwater contamination from the site, or any other environmental
consequences resulting from the construction and/or operation and maintenance of the
mitigation measures described in this proposal.

BAS has 20 years experience in the design and construction of landfill gas management
systems, and in landfill closure engineering and construction. The City's approach to the
Waterman Landfill project, with its use of both consultant and City forces during the .
construction phase, differs significantly from the standard ~'design/build" approach. While
BAS supports the City in its non-traditional approach, we respectfully request that our
liability be limited to only those activities conducted by BAS and its subcontractors. It Is
also important to note that construction cannot take place until a permit to construct is
issued from SCAQMD.

Pursuant to our discussions, Bryan A. Stirrat & Associates (BAS) is pleased to present the
costs associated with the construction of the landfill gas (LFG) treatment facility located at
the Waterman Landfill. As we discussed, pilot testing conducted at the Waterman Landfill
has indicated that LFG at the site contains specific contaminants which require a higher
level of treatment than a normal carbon system. In particular, reported levels of vinyl
chloride and hydrogen sulfide, along with other toxic constituents, require additional
methods for adsorption. As such, in addition to the "special" activated carbon needed,
potassium permanganate will also be needed to increase the system's adsorption
efficiency for treatment of vinyl chloride and hydrogen sulfide.
In the process of evaluating the permit application, the South Coast Air Quality
Management District (SCAQMD) determined that the following additional items are now
required in order to grant a permit to construct:
. An increase in the number of Carbon Canisters from three to four;
· Upgrade media from Activated Carbon to Carbon Coconut Shell Media in two
canisters;
· Upgrade media from Activated Carbon in the third canister to Impregnated Potassium
Permanganate;
e
· Add impregnated Potassium Permanganate to the new fourth canister;
· Additional valves and ancillary piping to connect the new fourth canister;
· Posting of area signs indicating the health risks associated from being near the landfill
and no smoking signs; and
· Sound enclosures for the gas blowers to reduce decibel level to 72db.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Bryan A. Stirrat and Associates provides construction engineering
support services relative to the Waterman Landfill cover improvement construction. On
May 3, 2004 the Mayor and Common Council approved Resolution 2004-116
authorizing an Agreement with, and the issuance of a purchase order to, Brian A.
Stirrat and Associates for the design and construction of a landfill gas collection and
treatment system and improvements to the Waterman Landfill cover system in a total
amount of $784,604.00.
SECTION 2, City staff has identified additional unanticipated project costs as
well as a change in the project approach which requires increasing the scope of
services and costs of the contract with Bryan A. Stirra!. The changed scope of work
and the increased costs amounting to $211,623.00 which includes a $30,000:00
contingency, are pursuant to the staff report dated December 27,2004 as presented to
the Mayor and Common Council at their regular meeting held on January 10, 2005.
The Mayor is hereby auth'orized to execute an amendment to said Agreement for
additional project costs, attached and incorporated herein as Exhibit A.

Dear Mr. Morford,

During our meeting on November 18th, we discussed various ways to complete the above captioned
project while providing an increased scope of work. One of the ways suggested was to temporarily
reallocate budgeted funds from Line Item 2.1.7 - LFG System Routine Operation and Maintenance.
This line item currently has a budget of$162,869. It was felt that this might be an appropriate line item
to modify to cover additional project costs, and that this item could be re-budgeted in the next fiscal
year.
Based on the current progress on the project, we do not anticipate completing the installation ofthe
cover material until late January. Upon completion of the cover placement, the construction of the LFG
extraction system is scheduled to commence. However, construction of the LFG system cannot begin
until the appropriate permits are obtained from the South Coast Air Quality Management District
(SCAQMD). Once construction begins, we anticipate that the LFG system construction will take
approximately 5 weeks. The completion of the entire system - LFG extraction, collection and treatment
components is dependent upon but not limited to the following:
e
1. Determination of the type.of LFG treatment required. Additional testing of the LFG may be
needed in order to determine the type of treatment necessary. This testing cannot be completed
until the LFG extraction system is installed.
. 2. Submission and approval of the following Permit packages to South Coast Air Management
District (SCAQMD):
a. LFG Treatment System;
b. Condensate Management System; and
c. Risk Analysis
3. The timeline required by the SCAQMD to proc.ess, review, and approve the various Permit
packages yet to be submitted.
4. Funding by the City to complete the project, such as:
e
a. LFG treatment facility installation;
b. Site hydroseeding:
c. . Site security - fencing; and
d. Installation of utilities to the LFG treatment facility.
it is probable that the time required to obtain the above data, prepare the Permit Application Packages,
and receive approval from the SCAQMD may push the completion of the project into the late spring or
early summer of 2005, not taking into account any funding problems for the outstanding construction
items to be completed. If this is the case, the need for LFG system routine operation and maintenance
funding may not be necessary until the 2005 budget year, beginning in July. However, BAS wishes to
point out that if the system is placed in operation before new funds can be budgeted, it will be necessary
for the City to temporarily fund these activities.
I have prepared a summary of the additional project costs that we have discussed. This includes
providing operated and maintained earthworking equipment; providing additional out of scope services;
and updating the LFG extraction and collection system construction costs utilizing the selected LFG
system contractor for a turn-key system construction instead of utilizing City resources for the LFG
system construction.
ADDITIONAL WORK/SERVICES TO BE PROVIDED:
e
I. Provide additional out-of-scope consultant services such as full time grade checking, setting of
working grade control, direction of fill placement, survey as-builts of the LFG system, and an
allowance for additional working days due to administrative and weather related delays.
a. Construction Manager: 180 hours at $128 hour; $23,040.00
b. Division Engineer: 6 hours at $147 hour; $882.00
c. Chief Engineer: 20 hours at $137 hour; $2,740.00
d. Survey: 12 hours at $150.00 hour; $1,800.00
Total: $28,462.00
2. Provide experienced heavy equipment operators (2) for the D6 dozer and 826 compactor/120
motor grader. Services provided on November 22, 23, and 24.
2 operators for 35 man hours at $57.00 per hour. Total: $1,995.00
3. Payment of permit fees to the SCAQMD for the LFG Extraction System Permit Application
Package.
Permit Fee: $3,174.31
4. Provide turn-key LFG extraction system construction not utilizing any City personnel or
equipment except as noted in Assumption B.

Additional cost added to Attachment 3: $ 81,926.52
New total: $362,362.02
NOTE: Please be advised that we have been notified by the LFG system contractor that there
will be a 15 to 20% increase in the cost of HDPE pipe by the manufacturer on the first of the

year. BAS would like to authorize the contractor to purchase the affected materials prior to the
price increase with your concurrence in an effort to reduce the cost to the City. If authorization is
received, the order will be placed prior to the price increase. Once the material is received, the
City will be invoiced for the materials.
The LFG Extraction System Permit Application Package was submitted to the SCAQMD on
December 1, 2004. The Permit Application Package contained a drawing showing a conceptual
system layout. This drawing is conceptual in the sense that the SCAQMD reserves the right to
request modifications to the plans for regulatory compliance. Any changes to the drawing
requested by SCAQMD may increase the system cost.
ASSUMPTIONS
The cost for the construction of the Waterman Landfill LFG System and associated drilling is
based on the following assumptions:

a. Pressure testing of the gas headers is not included.
b. Drill cuttings and trench spoils (both non-hazardous and hazardous) to be properly
disposed of at a facility of their choice. The City will provide a dump truck and driver to
transport the spoils to the disposal facility.
No construction Permits of any kind are included in this cost, with the exception of the
LFG Extraction Permit Application Package which has been submitted.
Soil compaction and testing will be completed by others.
All process equipment to be purchased, installed and warranted by others.
Material price is valid for 20 days. A 15' to 20% material price increase is scheduled for
the 1st of the year. Materials must be ordered prior to 12/29/04.

SECTION 1. As authorized by Municipal Code Section 3.04.075, Emergency
approval was granted by the City Administrator to rent a Caterpillar 825 Compactor
from ECCO Equipment Company for a two-month period beginning November 5, 2004
at a cost of $24,900. Additionally, a one-month emergency extension was recently
granted at a cost of $12,000.
SECTION 2. The Mayor and Common Council of the City of San Bernardino
hereby ratifies the emergency approval of a three-month rental agreement with ECCO
Equipment Company in the amount of $36,900 for a Caterpillar 825 Compactor to be

Subject:
Resolution authorizing the execution of a purchase order to Bryan A Stirratt &
Associates to design and construct a landfill gas collection and treatment system and
improvements to the landfill cover system.
Background: ,
The City of San Bernardino operated a sanitary landfill for municipal solid waste
between 1950 and 1960 on 19 acres of leased private property along the south bank of
the Santa Ana River, east of Waterman Avenue and north of Vanderbilt Way and
Carnegie Drive. Landfill operations ceased in 1961 and the site was turned back over
to the property owner at that time.
e
Under state law, the owner and operator of the site are responsible for maintenance and
corrective actions relating to releases of landfill gas (methane) and potential
contaminants to groundwater through leachate percolation. The operator of the site
bears primary responsibility; the owner bears ultimate responsibility in the event that the
operator is no longer available to perform these functions and meet regulatory
requirements. Currently, Glenborough owns the site. The City entered into a Limited
Access Easement Agreement with Glenborough in order for the City to perform required
maintenance activities on the former site. In this case, the City as the operator is the
responsible party. The work performed at the site by the City includes on-going ground
water sampling and monitoring, grading and cover maintenance and repairs to prevent
surface water infiltration, and landfill gas monitoring and corrective action.
Iii January 2003, the City was noticed by the San Bernardino County Environmental
Health Department, the Local Enforcement Agency (LEA) for the California Integrated
Waste Management Board that the City and Glenborough were not in compliance with
the applicable landfill gas monitoring requirements, and that a Notice and Order were
proposed to be issued in order to bring this site into compliance. Both the City and
Glenborough were successful in negotiating a work plan with the LEA that required the
City to assume a greater responsibility for landfill gas monitoring, including the
installation and testing of new landfill gas probes at the site. As a result of the
installation of these probes, it has been determined that landfill gas is present in
quantities that exceed regulatory limits. As a result, the LEA has determined that a
landfill gas collection system is required.

Concurrently, the City had, through it's consultant Bryan A. Stirratt and Associates
(BAS), performed various engineering studies to determine appropriate and required
repairs to the landfill cover as a result of regulatory requirements set forth by the State
Water Resources Control Board, and enforced by the Santa Ana Regional Water
Quality Control Board (SARWQCB). On April2, 2002, SARWQCB approved the
proposed Cover Improvement Plans, and the Special Provisions and Technical

Specifications for the Cover Improvements. Work on installation of the cover repairs by
the City was scheduled to be performed in 2002; however, Glenborough identified a
potential development for this site and requested a delay in order to fully explore this
opportunity. Unfortunately, this opportunity did not materialize as hoped and it was
determined that the cover repairs would need to proceed. This determination was made
in mid 2003.
Both the LEA and SARWQCB have put the City on notice that the Cover Improvements
and Landfill Gas Collection System need to be completed, otherwise enforcement
activities will be commenced. City staff met with the LEA on March 3, 2004 and were
presented with a draft "Stipulated Order of Compliance." Through negotiations, the City
successfully obtained a 50-day delay, subject to the City undertaking the actions
considered within this Staff Report. In the event that the City does not take this action,
the LEA has the ability to levy a civil penalty in an amount not to exceed $10,000 per
day; we anticipate that the SARWQCB could take a similar action.

The City is proposing to execute a multi-phase purchase order with BAS in order to
complete both the installation of the Cover Improvement and the Landfill Gas Collection
system. BAS has performed engineering and technical services on the Waterman
Landfill for the City of San Bernardino since 1995 and is most familiar with the
monitoring, design and engineering issues related to the landfill, as well as providing an
on-going working relationship with both the LEA and SARWQCB. The work being .
proposed here is an extension of the existing engineering work already performed; BAS
is therefore a recommended selected source. BAS has performed significant amount
of engineering and technical studies relating to the County Landfill system and therefore
possesses unique experience and knowledge in this particular area.
Under the proposed scope of work, the City has identified various aspects of the
projects that can be successfully undertaken by City crews and those projects that need
to be handled by BAS. These include:
SECTION 1 Tasks 1.1 throuah 1.6.. Services Related to the Landfill Cover
Including Construction Engineering Support and quality assurance services required to
meet the LEA and SARWQCB requirements. TOTAL Cost: $144,302.00
SECTION 2 Tasks 2.1.1 throuah 2.1.5.. Services Related to the Landfill Gas
System (LFG) .
Including development of construction engineering drawings, permit applications,
testing, equipment installation, system and gas testing and construction management.
Cost $115,495.
SECTION 2 Task 2.1.6 - LFG Construction Manaaement
Provide specialized LFG construction management services to assist city crews in
complying with all construction requirements for the LFG system as well as start up and
final documentation. Cost $81,502.

SECTION 2.2 - LFG System Construction
Construction of LFG collection system, including all piping, fittings and condensate
pumps. Cost $280,436.00
SECTION 2.1.7 LFG System Routine Operation and Maintenance
Once the LFG System is operational, maintain and operate the system for one year,
including South Coast Air Quality Management District 1150.1 compliance monitoring
and reporting. Cost: $162,869.
The work proposed to be performed by BAS is only a portion of the total project cost
and is estimated at $784,604. The City estimates that an additional $600,000 will be
required for the purchase of the engineered soils necessary for the cover, an additional
$150,000 for the purchase by the City of the actual Landfill Gas Pump and Treatment
facility, and approximately $20,000 for miscellaneous hazardous materials disposal from
the various drilling activities needed for installing the LFG. The total project cost is
currently estimated at $1,554,604.00. The cost for this work will be factored into the
proposed Refuse Rate Increase currently under study. It is anticipated that the City will
spend no more than $250,000 on this project in the current fiscal year; the remaining
costs will be included in the FY04-05 Refuse Budget.
The City is proposing to do a significant portion of the grading and trenching work in-
house using the Heavy Equipment Operators within the Street Division as well as City
heavy equipment. This approach will result in significant cost savings over the use of
an outside firm to perform all grading and excavation activities.
Staff is recommending awarding the total purchase order in a not-to-exceed amount of
$784,604 to Bryan A. Stirratt and Associates. Staff is recommending that the
Purchasing Manager be authorized to issue an initial purchase order in the amount of
$250,000 towards this contract during the remainder of FY03-04, with the remaining
amount of $534,604 being included in the FY04-05 Refuse Fund budget. Also included
in the FY04/05 Refuse Budget will be an additional estimated $600,000 for purchase of
engineered soils necessary for the cover, an additional $150,000 for the purchase of the
actual Landfill Gas Pump and Treatment facility, and approximately $20,000 for
miscellaneous hazardous materials disposal.
Financial Impact:
Presently, the Refuse fund is projecting a deficit based on certain assumptior)s this
FY03-04.. Staff is developing a recommendation for a refuse rate increase. Due to the
urgency and potential enforcement action the City faces, staff is recommending that the
work proposed under this agreement be performed, and that the Council authorize staff
to permit the Refuse fund to go into an additional deficit amount of $250,000 for a total
deficit of $473,000 at the end of the fiscal year.
Recommendation:

Dear Mr. Merrill:
Pursuant to your request, Bryan A. Stirrat & Associates (BAS), with our affiliate
geotechnical firm, Geologic Associates (GlA), and subcontractor, The Regenesis Group
(TRG) is pleased to provide the City of San Bernardino (City) the following scope of work
and fee estimates to provide services related to the closure of the Waterman landfill
(Project).
The Project involves the design and construction of a landfill gas collection and treatment
system (lFG system) and improvements to the landfill cover system. The plans and
specifications for the cover system have been previously prepared by BAS and submitted
.to the City. The plans and specifications for the lFG system will be developed by BAS as
part of this project.
Due to budget and time constraints, the City prefers that the project be completed using
only City forces and BAS forces in lieu of putting the project out to bid. The proposed
tasks to be provided by BAS are described in the Scope of Work (SOW) below. The
SOW is divided into two sections. The first section describes services related to the
landfill cover, and the second section describes services related to the lFG system.
SCOPE OF WORK
SECTION 1 - SERVICES RELATED TO THE LANDFILL COVER
TASK 1.1
ATTEND MEETINGS
Several meetings will be required during the course of the project. These meetings
include, but are not limited to meetings with regulators, progress meetings with the City,
and meetings with material/equipment suppliers.
BAS' proposed budget includes estimated hours by staff category during the course of the
project. BAS will bill under this task for meeting costs including time and expenses.

TASK 1.2
CONSTRUCTION ENGINEERING SUPPORT
BAS will provide construction engineering support which will consist of coordination with
the City Superintendent, the cover soil supplier, and the CQA staff during the project to
assist in achieving the construction that conforms to the Project Plans, Specifications, and
applicable regulatory approvals. In addition, BAS will review the construction and
contract-related documentation.

Construction Services
The following section outlines the scope of work anticipated during the construction:
Corrective Action Items
BAS will document in Weekly reports, any deficiencies noted in the construction activities
or in material delivered to the site. These deficiencies will be brought to the City's
attention immediately so that corrective action can be taken as soon as possible to
minimize the impact on the overall construction schedule.
Coordination with CiN
BAS will confer with and advise the City regarding the status of any significant items, and
verify that the appropriate notifications and/or coordination for specific events have taken
place.
Task 1.2.3

Photo Log
BAS will, throughout the construction process, take photographs to document progress,
note unusual or unforeseen conditions, and record events of interest. At the conclusion of a
project, the CD and/or a set of the photographs will be submitted to the City and the
RWQCB as part of the final report.
Weeklv Construction Reports
The narrative portion of the report will include sufficient information to convey to the
Agency the scope of work that occurred on that week and the locations in which the
work occurred. Particular attention will be paid to changed or unforeseen conditions,
deficiencies noted, and when corrective action is required.
Request for Information (RFIl and Design Clarification Log
All responses to RFls and finalization of design clarifications will be reviewed and
approved by the Design Engineer and, if applicable, the CQA Officer.
Weeklv Progress Meeting Minutes
In addition to the above noted documentation, a weekly progress meeting will be
conducted in which many of the above issues will be reviewed and documented. At a
minimum the following issues will be covered:
. Amendments or corrections to previous week's minutes.
. Health and Safety issues.
. Progress and schedule review (two.week look ahead).

BAS will document all discussions at the progress meetings and will prepare meeting
minutes for distribution to all attendees prior to the next scheduled meeting.
Task 1.2.4
Proiect Close-out
The record drawings will be reviewed for accuracy and conformance with BAS' records.
The record set will be used to update a design drawing set and will be supplemented by
additional survey. As the City's Design firm, the project plans will already be in our
AutoCAD system thus providing for timely and efficient issuance of record drawings.
When record drawings have been finalized, one reproducible set of drawings, and the
selected AutoCAD file, will be transmitted to the City.
Upon completion of BAS' review and completion of all "punch list" items, a final close out
report will be prepared which will detail recommendations as to the acceptability of the
work and its conformance to the intent of the plans and specifications. Once construction
is complete, and the City has submitted their redlined mark-up of the construction
drawings, the BAS Project Manager will review the Project Record Drawings and finalize
to the City with appropriate comments.
TASK 1.3
SURVEY
BAS will provide construction survey (control staking) for the City's construction crews. It
is anticipated that one day per week will be utilized to set control stakes. The City may
have to provide a grade checker to establish intermediate grades. This will be necessary
for two reasons. The first is to verify that the cover thickness meets the regulatory
requirements. The second is that this information will be used in the Final Close Out
Report to show existing grades, proposed grades and final grades, and allow for
certification of the Close Out Report in compliance with the approved plan. If the City
crew wishes to supplement this survey with additional information, the Crew Chiefs can
coordinate.
TASK 1.4
PROJECT ADMINISTRATION/PREPARE FINAL REPORT
This task is comprised of the following activities:

CONSTRUCTION QUALITY ASSURANCE MONITORING.
GLA will complete a borrow source evaluation study to assess the adequacy of soils
proposed for the cover repair project by the City or its subcontractor. The borrow
study will involve mobilization of a hollow-stem drill-rig to excavate exploratory
boreholes at the borrow site, retention of soil samples for laboratory analyses, and
,
computer modeling to simulate the transient flux of moisture that may infiltrate cover
soils in the future.
As shown on Table 1, GLA expects that the drill rig will be employed for
approximately 3 days (30 hours total) atup to 3 potential borrow sites in the area.
During this period, GLA will provide an experienced geologist who will log the
borings and retain samples for subsequent laboratory analyses. Following
confirmation that the soils have appropriate gradation and permeability
characteristics, modeling will be completed to verify that the moisture flux through
the cover soils will be at acceptable levels.
Approximately one week after the modeling work is completed, a memorandum will
be prepared for City and RWQCB review that details the borrow evaluation work that
was completed and which substantiates the suitability of the proposed borrow soils
for use in the Waterman Landfill Cover Repair Construction work.
TASK 1.6
CQA SERVICES
GLA will provide field technicians to observe and test the cover fill soils to assure
compliance with the Project Specifications. It is our understanding that fill material
will be selectively excavated at the off-site borrow source(s), moisture conditioned as
necessary, and placed as compacted fill to form the monolithic final cover.
The following summarizes GLA's scope of work for CQA services:
1. Periodic visits and inspections of the borrow excavation to visually observe soils
exposed in the excavation and to obtain soil samples for laboratory testing.
2. Laboratory testing of borrow soils to assure their suitability for the cover repair
project.
3. Monitoring and compaction testing of the reprocessed and recompacted upper
6 inches of the existing foundation layer material.

During the construction period, GLA's field technician will regularly visit the landfill
and borrow excavation(s) to visually observe the work, perform field testing, and to
obtain samples for laboratory analyses. While the contractor's excavation and fill
placement rates will govern the time required of the field technician, for proposal
purposes, GLA anticipates that the technician may be required for 5 or 6 hours each
working day.
During construction, GLA will submit to the City a summary of field and laboratory
test results approximately every other week. Approximately one month after the
completion of construction, GLA will submit a Draft Report of CQA Services for City
review. This report will summarize construction activities and laboratory and field test
results, and provide certification by a State of California Certified Engineering
Geologist that construction was performed in accordance with the minimum
requirements of the Project Specifications. A final report of CQA Services will be
submitted approximately one week after receipt of City comments to the Draft report.
FEE ESTIMATE FOR TASK 1
The anticipated fee estimate to complete Task 1 is provided in Attachment 1. The totals
listed in Attachment 1 for geotechnical laboratory testing are consistent with the testing
frequency identified in the CQA Plan and listed above. The fee estimate provided is for

SECTION 2 - SERVICES RELATED TO THE LFG SYSTEM
TASK 2.1
ENGINEERING SUPPORT SERVICES
Task 2.1.1
LfG System Construction DrawinRs
In this task, BAS will develop construction drawings (the level of details is intended for a
design/build type of project) for the LFG system including the following:
. Title sheet
. LFG system site plan
. Piping alignments and piping rletails
. Condensate sump details
. LFG treatment system site plan
. LFG treatment system electrical plans
. LFG treatment system process piping diagram
As part of the design process, BAS will perform the calculations necessary to estimate LFG
flow rates and extraction system pipe sizes. BAS will provide the City with a preliminary
set of drawings for comment, and include City comments on the final. wet stamped set.
Deliverable: One set of preliminary LFG system drawings on bond, and one set of final
LFG system drawings on Mylar.
Task 2.1.2
SCAQMD Permit Aoolication
In this task, BAS will prepare applications for South Coast Air Quality Management District
(SCAQMD) Permits to Construct/Permits to Operate. Up to three (3) separate permits
may be required; LFG extraction system, treatment facility, and condensate management
system. Each permit will include a cover letter; the appropriate SCAQMD standard forms,
calculations, preliminary drawings, and a check for the application fee (the costs
associated with any permit fees are not included in our cost estimate, and it is our

assumption that these fees will be provided by the City). The treatment facility permit
application package will include all necessary health risk calculations for the chronic and
acute assessment, as well as the "one in a million calculation." BAS will submit the
application to SCAQMD on behalf of the City. Processing of the permit application by
SCAQMD can take several months, but if necessary, the City can expedite the process by
paying additional overtime fees to SCAQMD.
Deliverable: One copy of each permit application.
Task 2.1.3
LFG Quality and Quantity Testim~
Following completion of the LFG extraction system, and after allowing the system to
stabilize, BAS will test the quality and quantity of the LFG for the purpose of selecting the
appropriate treatment technology. Potential treatment technologies include enclosed
ground flare, thermal oxidizer, and activ~ted carbon. The selected technology will be
dependent on methane content and f1owrate.
This test will involve extracting LFG for a period of four weeks using a rented trailer-
. mounted thermal oxidizer. BAS will monitor LFG f1owrates, methane content, and
condensate levels in the sumps and the City will pump and disposed of condensate during
the test if necessary.
Deliverable: One copy of LFG quality test report.
Task 2.1.4
LFG Treatment System Equipment Procurement Specifications
Based on the results of the LFG quality and quantity test, BAS will prepare technical
specifications to be used by the City to procure a LFG treatment facility. The
specifications will include requirements for equipment performance, warranty, startup,
testing, and operating manual. The City will attach this specification with City
procurement documents and send to bidders.
Deliverable: One copy of specifications.
Task 2.1.5
Source Test LFG Treatment System
In this task, BAS will procure the services of a source testing firm and air lab, coordinate
with SCAQMD, supervise and oversee the source test, and submit the report to
SCAQMD.

Task 2.1.6
Construction Mana~ement and Start-Up of LFG System
In this task, a BAS construction manager will be onsite full-time during construction in
order to supervise and oversee work conducted by City staff. BAS will photo log

construction activities, log wells, and document man.hours, equipment hours, and daily
work in place and work in progress. BAS will redline construction drawings, and produce
as.builts for the project. The budget for this task is based on 65 working days construction
duration. BAS will also document the end of construction byway of a construction
certification report.
Following construction of the LFG System, BAS will perform startup activities. Startup
activities include shakedown, troubleshooting, and performance testing of the treatment
facility, monitoring the boundary probes, and balancing the wellfield. These activities
typically require approximately 1 month at which time th'e system should be stable and
the probes should be in compliance.
Deliverable: Construction Certification Report, Photo Log.

Task 2.1.7
lFG System Routine Operation and Maintenance
Following startup, BAS will perform routine Operation and Maintenance (O&M) activities
on the System for a period of one year, beginning after startup activities are complete.
Routine O&M includes the following activities:
. Prepare a site specific ope'ration and maintenance manual for operation of the
wellfield and treatment facility.
. Monitor wells every two weeks, and adjust as necessary.
. Monitor condensate holding tank and call for pump-out as necessary, City will pump
and dispose of condensate. (City should investigate connection to sewer system).
. Monitor, adjust and maintain the treatment facility weekly.
. Perform SCAQMD 1150.1 compliance monitoring:
1. Boundary probe sampling and analysis (monthly)
2. Integrated surface sampling (monthly)
3. Instantaneous surface monitoring (quarterly)
4. LFG sampling and analyses at treatment system (monthly)
5. Ambient air sampling (monthly)
6. Submit 1150.1 reports to SCAQMD (quarterly)
BAS can, as an optional task, prepare an application toSCAQMD for an Alternative
Monitoring Plan (AMP) which, if approved by SCAQMD, would result in less stringent
1150.1 monitoring requirements for the site.
Non.routine activities, and emergency O&M are also available on a time and expense
basis at the request of the City.

TASK 2.2
CONSTRUGION SERVICES
BAS construction forces will work with City construction forces to construct the LFG
System. BAS estimates that the LFG collection system will consist of thirty (30) twenty five
foot dpep wells installed approximately 50-feet inside from the edge of the waste
perimeter, a 6" LFG header buried around the outside perimeter of the waste, 12
pneumatic condensate sumps, and all associated piping. The LFG treatment system will
be either J flare, thermal oxidizer, or activated carbon system, and will include a
compressed air system. The estimated construction duration is 65 days. If the
construction period were to exceed the 65 days estimate, services will be rendered on
time and expp.nse basis in accordance with the BAS standard rates schedule. A brief
description of proposed work is as follows:
. BAS will install LFG wells complete with wellheads and wellhead boxes, ready for
connection to well laterals using hose clamps. The City will supply dumpster and
dispose of well cuttings.
. BAS will supply and weld (using butt.fusion welding) the LFG header pipes, lateral
pipes, air pipes and condensate pipes in sections with flanged end connections (air
and condensate piping is supplied in rolls). The City will dig the pipe trenches, install
the piping in the trenches, and backfill/compact the trenches.
. BAS will supply condensate sumps. The City will dig the sump holes and place the
sumps in the holes. BAS will connect the s.umps to the header, air, and condensate
piping. The City will backfill and compact the sumps.
. The City will construct the treatment system site, including concrete, electrical, fencing,
etc., and supply and install the treatment system under the direction of BAS. BAS will
connect the LFG header to the treatment system, and start-up the system.

BAS shall maintain insurance policies meeting the minimum requirements set forth herein.
All insurance maintained by BAS shall be provided by insurers satisfactory to the City.
Certificates evidencing all insurance coverage required herein shall be delivered to the
City prior to BAS performing any of the services under this Agreement. All insurance
certificates required herein shall name the City as an additional insured and provide for
thirty-(30) days written notice from the insurer to the City prior to cancellation of any
insurance policy of BAS.
Comprehensive General Liability and Automobile Insurance
BAS shaH maint.:!in comprehensive general liability and automobile liability
insurance with.a combined single limit of not less than One Million Dollars
($1,000,000.00) per occurrence.
Worker's Compensation Insurance
BAS shall maintain worker's compensation insurance in accordance with the laws
of the State of California for all workers employed by the Vendor.
LIMITATIONS
The work proposed herein will be performed in accordance with sound engineering and
construction practices. However, implementation of the proposed services does not
guarantee regulatory compliance of the site. As with any mitigation plan, environmental
monitoring may indicate the need for additional measures in the future.
BAS will not be responsible for air emissions from the site, subsurface LFG migration from
the site, groundwater contamination from the site, or any other environmental
consequences resulting from the construction and/or operation and maintenance of the
mitigation measures described in this proposal.

systems, and in landfill closure engineering and construction. The City's approach to the
Waterman Landfill project, with its use of both consultant and City forces during the .
construction phase, differs significantly from the standard ~'design/build" approach. While
BAS supports the City in its non.traditional approach, we respectfully request that our
liability be limited to only those activities conducted by BAS and its subcontractors, It Is
also important to note that construction cannot take place until a permit to construct is
issued from SCAQMD.
