STAFF REPORT
Subject:
Resolution awarding a contract to Nikola Construction Corporation for Sewer Improvements on Athol
Street from "D" Street to Arrowhead A venue (SW06-04) and Goodlett Street from Pico Street to
Herrington Avenue (SW06-08) and Street Improvements on Goodlett Street from Western Avenue to
Mt. Vernon Avenue (SW06-08), per Project Plan No. 11646 and authorization for the Director of
Finance to amend the FY 2006/07 Budget.
Background:
On August IS, 2006, the Mayor and Common Council allocated funds, as part of the FY 2006/07
Capital Improvement Program (CIP), for sewer improvements on Athol Street and sewer line
replacement (SW06-04); and Goodlett Street sewer line replacement (SW06-08).
On Athol Street, tbe existing sewer main has a reverse flow due to the high water table under the
Warm Creek Channel Bridge. The 8-inch line replacement will extend approximately 350 feet.
Maintenance of an existing sewer main in Goodlett Street has become increasingly difficult, due to its
deteriorated condition. Claims for damages due to plugging of this sewer main have increased in
recent years.
These projects consist of the following:
1. Installation of the new sewer mains.
2. Full width milling of the existing pavement on Goodlett Street from Western Avenue to Mt.
Vernon Avenue.
3. Full width asphalt pavement overlay on Goodlett Street from Western Avenue to Mt. Vernon
A venue.
The plans and specifications for this project have been completed and the project was opened to public
bidding on July 25, 2006. The project was advertised locally in the San Bernardino County Sun
Newspaper, F. W. Dodge, Construction Bid Board, High Desert Plan Room, San Diego Daily
Transcript, Sub-Hub Online Plan Room, Reed Construction Data, Bid America Online, Construction
Bid Source, Bid Ocean, the City's web site, and with the San Bernardino Area Chamber of Commerce.

STAFF REPORT - Continued
Based on review of the sealed competitive bid received, staff has determined that Nikola Construction
Corporation of Irvine, CA, the lowest bidder, has met the minimum requirements of the specifications
and bid guidelines; and, therefore, recommends that the Mayor and Common Council award the
referenced contract to Nikola Construction Corporation.
The estimated project costs are as follows:
$ 241,916.00
$ 31,796.60
$ 36,287.40
$ 310,000.00
If approved, this project is expected to begin construction in December of 2006 and be completed in
early 2007.
Financial Impact:
Funding for this project was allocated in the FY 06/07 Budget from the Sewer Construction Fund
(Fund 245), which is normally reserved for extending and enlarging sewer mains. After review of the
project, it was determined that the project is entirely maintenance and should have been funded from
the Sewer Maintenance Fund (fund 132).
Therefore, staff recommends that funding for each of these projects be transferred from unallocated
sewer maintenance funds (Fund 132) and the sewer construction moneys be transferred to the
unallocated account. Adequate funding for these projects is available from the sewer maintenance
fund (Fund 132).
Recommendation:
I. Authorize the Director of Finance to amend the FY 2006/07 budget by transferring $86,600 from
unallocated sewer maintenance funds (Fund 132) to Account No. 132-431-5505-7569 "Alhol Street
Sewer Replacement (SW06-04), and
2. Authorize the Director of Finance to amend the FY 2006/07 budget by transferring $223,400 from
unallocated sewer maintenance funds (Fund 132) to Account No. 132-431-5505-7570 "Goodlett
Street Sewer Replacement (SW06-08), and
3. Authorize the Director of Finance to amend the FY 2006/07 budget by transferring the balance of
AccoUli.t No. 245-365-5504-7569 "Athol Street Sewer Replacement (SW06-04)" and Account No.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTlO!'lI. Nikola Construction Corporation, 18012 Cowan, Suite 290, Irvine, CA
926 I 4, is the only responsible bidder for Sewer Improvements on Athol Street from "D" Street
to Arrowhead Avenue (SW06-04) and Goodlett Street from Pico Street to Herrington Avcnue
(SW06-08), and Street Improvements on Goodlett Street from Western Avenue to Mt. Vernon
Avenue (SW06-0S), per Project Plan No. 11646. A contract is awarded accordingly to said
bidder in a total amount of 5; 241,916.00. with a contingency amount of S 36,287.40, but such
contract shall be effective only upon being fully executed by both parties. All other bids,
therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute said
contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk
and incorporated herein by reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not take effect
or become operative until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it within
sixty (60) days of passage of this resolution.

Financial Impact:
Current funding for this project is from the "Sewer Line Construction Fund" and, due to the
deteriorating condition of these lines, it is requested that the $8,100 shortfall be funded under our
"Sewer Line Maintenance Fund," which will allow the "Sewer Line Construction Fund to be used on
new sewer construction.
Recommendation:
1. Authorize the Director of Finance to amend the FY 2006/07 budget by transferring $81,100 from
