Synopsis of Previous Council Action:
On 7/5/05, the Mayor and Common Council adopted Resolution No. 2005-230, Resolution of the
City of San Bernardino approving a side letter to Resolution No. 2001-94, establishing a
compensation and benefits plan for the Management, Confidential & Unclassified employees,
amending Section 2 (1) -PERS, and adding a new section to Section 2 (X) - Holidays, for Police
Safety Management Employees.

Staff Report
Resolution of the City of San Bernardino approving a Side Letter to Resolution No. 2005-242, establishing a
compensation and benefits plan for the Management, Confidential and Unclassified Employees, amending and
adding benefits for the Police Safety Management Employees.
BACKGROUND
There are currently sixteen (16) Police Safety Management employees which include the Chief of Police,
Assistant Chief, three (3) Captains and eleven (11) Lieutenants. Police Safety Management benefits are
provided through the Management, Confidential and Unclassified Employees Compensation and Benefits Plan.
Because of the unique nature of police work, Police Safety Management employees have at times received
additional benefits in order to ensure parity with members of the Police Safety Employees Unit, whom they
supervise. This side letter will provide the Police Safety Management employees benefits that are in line with
those recently received by members of the Police Safety Employees Unit.
On October 2, 2006, the Mayor and Common Council, in closed session, approved the economic benefits
package described below.
Retirement Plan - Effective 12/31108 the City will amend the current PERS contract to include the 3% @ 50
formula. .
_ealthlLife Insurance - Effective 7/1107, employees who retire with 20+ years of service as a City of San
Bernardino sworn Police Officer will be eligible to receive retiree health benefit contributions in the amount of:
20 Years of Service upon retirement
25 Years of Service upon retirement
30 Years of Service upon retirement
$200 per month
$350 per month
$450 per month
Uniform Allowance: The annual uniform allowance will be increased as follows:
Effective 3/15/06 $800*
Effective 3/15/07 $875
Effective 3/15/08 $950
*Employees who already received the $600 uniform allowance on March 15,2006, will receive the additional
balance of $200 to be paid on or before November 30, 2006.
These additional benefits will encourage qualified candidates to promote into Management positions and help
retain quality employees in the Management ranks.
FINANCIAL IMPACT
Fiscal year 2006-07 will provide for the continuation of PARS (supplemental retirement plan currently
Audgeted in FY 06/07), an increase in medical retiree employer contributions, and an increase in uniform
Wllowance. .
The cost of enhanced benefits provided in FY 2006-07 is $42,500. Currently the Police Department has
numerous vacancies and is actively recruiting to fill those vacancies. Due to multiple vacancy savings and the
81ticipated date to fill vacancies, the PD will be able to absorb $42,500 in their FY 2006-07 budget without
~mpromlsmg programs.
It is estimated that the recurring cost beginning FY 08/09 for these additional benefits, assuming each employee
qualifies or utilizes the benefit, is $122,600.

SIDE LETTER TO RESOLUTION NO. 2005-242
FOR POLICE SAFETY MANAGEMENT EMPLOYEES
The following sets forth a Side Letter to Resolution No. 2005-242, for full-time, regular active
Police Safety Management Employees to amend the language in: Section 2 (D) Retired
Employees Medical Insurance, Section 2 (H) Uniform Allowance, Police and Section 2 (I)
PERS, Safety Employees.
Section 2 (0) Retired Employees Medical Insurance:

The City shall contribute a monthly maximum of forty-eight dollars and forty cents ($48.40) per
retired employee to be applied towards the monthly medical insurance premium.
(Add)
I. Regular, full-time Management, Confidential and Unclassified employees who are enrolled
as a subscriber in a City of San Bernardino sponsored health plan at the time of retirement
from City of San Bernardino service, shall be eligible to participate in any City of San
Bernardino sponsored qualified health plan as a retiree providing he/she maintains
continuous membership in good standing. Qualifying retirees will receive a monthly City
contribution equal to the current PERS adopted schedule amount per retired employee to be
used exclusively for the purchase of medical insurance in any City of San Bernardino
sponsored plan.
2. Any Police Safety Management employee who retires on or after July I, 2007 from the City
of San Bernardino and who meets the requirements set forth in Section 2 (D) (I) for
participation in a City of San Bernardino sponsored qualified health plan as a retiree, shall
receive from the City of San Bernardino certain employer contributions to such qualified
health plan as set forth in Section 2 (D) (I) if, upon retirement, the employee meets all the
following conditions:
a. The employee must have completed at least twenty (20) years of full-time service as a
City of San Bernardino sworn Police Officer on the date of retirement, and
b. The employee must have been awarded a retirement from the Public Employees'
Retirement System (PERS) as the reason for separation from City of San Bernardino
service, and
c. PERS retirement benefits must commence no later than the first day of the month
following the date of separation from City of San Bernardino service.
If all conditions set forth in Section 2 (D) (2) above are met by the retiring Police Safety
Management employee, such employee shall receive employer contributions to a City of San
Bernardino sponsored qualified health plan based upon hislher years of service with the City
of San Bernardino as follows:

The above-referenced contribution amounts shall be paid directly to a City of San Bernardino
sponsored qualified health plan for the benefit of the Police Safety Management retired
employee, with any and all amounts not utilized for the purchase of such health plan reverting
back to the City of San Bernardino.
Section 2 (H) Uniform Allowance. Police:

I.
Once each fiscal year, each Police Safety Management member shall receive an annual
uniform allowance of six hundred dollars ($600) to be paid in a lump sum amount during
the first pay period of March.
Effective March 15,2006, each Police Safety Management member shall receive an
annual uniform allowance of$800 to be paid in a lump sum. Safety Management
members who alrel\dy received the $600 uniform allowance on March 15,2006, will
receive the additional balance of $200 to be paid on or before November 30, 2006.
Effective March 15, 2007, each Police Safety Management member shall receive an
annual uniform allowance of$875 to be paid in a lump sum.
Effective March 15, 2008, each Police Safety Management member shall receive an
annual uniform allowance of$950 to be paid in a lump sum.
