Synopsis of Previous Council Action:

Mayor and Council adopted Resolution No. 82-99 that amended the Conflict of
Interest Code to incorporate the Fair Political Practices Commission's Standard
Model Conflict of Interest Code for the City of San Bernardino.
The resolution has subsequently been amended by Resolution Nos. 82-402, 83-
462,84-17,84-428,85-97,86-105,88-420,89-16, 91-12, 92-466, 94-31, 94-
362,96-381,97-23,98-333,2000-355,2001-345,2002-328, and 2004-338 to
add or delete positions required to file, or to change filing requirements and/or
position titles of the various positions and/or committees contained in the code.
Recommended Motion:

Request for Council Action - Meeting of November 6, 2006 - Resolution
of the City of San Bernardino amending Resolution No. 2004-338
entitled in part, "Resolution... amending Conflict of Interest Code...,"
by amending Appendix A to add, delete, and change the titles of various
positions within departments of the City which must file Conflict of
Interest Statements.
BACKGROUND INFORMATION:
The Political Reform Act requires every local government agency to review its Conflict
of Interest Code biennially to determine if it is accurate and up-to-date; or alternatively,
whether the Code must be amended.

Therefore, the City Clerk's Office notified the Economic Development Agency and
City departments of the need to review and amend their lists of designated positions, as
necessary. Department heads submitted their proposed changes, which included
position title changes and/or the deletion or addition of positions within their respective
departments required to file a Statement of Economic Interests.
My staff and I have reviewed the proposed changes and have worked with Senior
Assistant City Attorney Doug Calkins to prepare the necessary amendments as reflected
in Appendix A of the attached resolution. New titles and/or added positions are shown
in bold. Old titles and/or deleted positions are designated by a strike-through.
Also, when the 2005/2006 Form 700 was distributed by the Fair Political Practices
Commission (FPPC), they had combined two related reporting categories into one
category, resulting in six categories instead of seven. Since the City's reporting
categories have always paralleled the categories in the Form 700, we have deleted filing
category seven from the new code.
You will also note that on page 9, Designated Boards/Committees/Commissions, we
are deleting three Financing Authorities, due to the fact that the members are comprised
only of current Council members, who are already required to file Statements of
Economic Interests per Government Code Section 87200. The FPPC has informed this
office that these duplicate filings are unnecessary.

SECTION 1. Resolution No. 2004-338, Appendix A, is amended as set forth in
Appendix A attached hereto and incorporated herein as though set forth in full.

Consultant
Consultants shall be included in the list of designated employees and shall
disclose pursuant to the broadest disclosure category in the code subject to the
following limitation:
The Mayor may determine in writing that a particular consultant,
although a "designated position," is hired to perform a range of duties that is
limited in scope and thus is not required to fully comply with the disclosure
requirements described in this section. Such written determination shall include
a description of the consultant's duties and, based upon that description, a
statement of the extent of disclosure requirements. The Mayor's determination is
a public record and shall be retained for public inspection in the same manner
and location as this conflict of interest code.
