Staff Report
SUBJECT:
Resolution determining the amount of property tax revenues to be exchanged between the City of
San Bernardino and the County of San Bernardino relative to the reorganization consisting of
the annexation of 6 areas of unincorporated territories generally lying north of Pacific Street, east
of Valencia Avenue, south of Piedmont Drive and west of Victoria Avenue, to be known as City
of San Bernardino Annexation No. 361.
BACKGROUND:
On January 21, 2000, Assembly Bill 1555 became effective, allowing for the annexation of
unincorporated territory of 75 acres or less, without the need to obtain property owner or
registered voter approval. Subsequently, an amendment increased the qualifying area to 150
acres.
On February 21, 2006, the Mayor and Common Council authorized the filing of an application
for annexation with the Local Agency Formation Commission (LAFCO) for the Arrowhead
Springs area. At that time, LAFCO staff indicated that a condition of approval for this
annexation would be for the City to initiate and complete annexation of portions of various
islands pursuant to Assembly Bill 1555. The provisions of AB 1555 were set to terminate on
January 1,2007. However, recent legislation extended this deadline to January I, 2014. LAFCO
staff have further indicated that the initiation, processing and completion time will be about 6
months.
On July 10, 2006 authorization to proceed was given for the proposed annexation of these 6
areas and Resolution No. 2006-247 was adopted making application to the Local Agency
Formation Commission for the reorganization consisting of the proposed annexation of the 6
areas. Exhibit I shows the 6 areas proposed for annexation.
Pursuant to Section 99 of the Revenue and Taxation Code, agencies affected by a change of
jurisdictional boundaries must negotiate the re-distribution of property taxes for property within
the affected area and respond with a resolution. This must be accomplished within 60 days of
receiving a response from the Auditor-Controller. In this case, the negotiations consist of the
implementation of a formula that was established by the County in 1983.
Attached for your consideration is a resolution determining the amount of tax transfer that is to
occur between the County and the City upon annexation of these territories. A detail of the
amount to be transferred, by tax rate area, is attached as Exhibit "A" to the resolution. The
deadline for submitting the resolution to LAFCO is October 31, 2006.
Upon annexation, the total property tax to be transferred to the City for the area to be annexed is
$81,784. This transfer amount is determined using a supplemental formula adopted by the Board
of Supervisors. Areas 4, 5 and 6 are also within designated Inland Valley Development Agency
(IVDA) redevelopment areas. The IVDA currently receives tax increment funds for these areas
and will continue to receive these funds.
FINANCIAL IMPACT:
Annual property tax revenues in the amount of $81,784 will be received after annexation.
RECOMMENDATION:

AMONG THE CITY OF SAN BERNARDINO AND THE COUNTY OF SA:"

ANNEXATION OF 6 AREAS OF UNINCORPORATED TERRITORIES GENERALLY
6 LYING NORTH OF PACIFIC STREET, EAST OF VALENCIA AVENUE, SOUTH OF
PIEDMONT DRIVE AND WEST OF VICTORIA AVENUE, TO BE KNOWN AS CITY

SECTION 1. Recitals. That the Mayor and Common Council of the City of San
Bernardino hereby find and determine that:
A. Pursuant to Section 99 of the Revenue and Taxation Code, prior to the
issuance of a certificate of filing by the Local Agency Formation Commission Executive Officer,
15 the governing bodies of all local agencies whose service area or service responsibilities will be
16 altered by a proposed jurisdictional change shall negotiate and determine by resolution the
17 amount of property tax revenues to be exchanged between and among such local agencies.

B. Except as provided in Section 99.1 of the Revenue and Taxation Code, in the
event that a jurisdictional change would affect the service area or service responsibility of one or
20
21 more special districts, the Board of Supervisors of the County of San Bernardino shall, on behalf
22 of the district or districts, negotiate any exchange of property tax revenues.

C. The Mayor and Common Council of the City of San Bernardino and the
Board of Supervisors of the County of San Bernardino have determined the amount of property .
tax revenues to be exchanged as a result of jurisdictional change described by LAFCO 3067, for
six unincorporated territories, generally located north of Pacific Street, east of Valencia Avenue,
28 south of Piedmont Drive and west of Victoria Avenue.

SECTION 2. Implementation.
A. The negotiated exchange of property tax revenues between the City of San Bernardino
and the County of San Bernardino, attached hereto as Exhibit "A" and incorporated herein by
reference, resulting from the above described jurisdictional change, is hereby approved and
accepted.
SECTION 3. The annual tax increment generated m these areas subject to the
jurisdictional change and attributable to the local agencies whose servIce area or servIce
responsibilities will be altered by the proposed jurisdictional change shall be allocated in the
future years pursuant to the provisions of Section 99 of the Revenue and Taxation Code.
SECTION 4. The City Clerk of the City of San Bernardino is hereby directed to certify
to the passage of this resolution and to cause a certified copy to be filed with the Executive
Officer of the Local Agency Formation Commission of the County of San Bernardino.
