Home My WebLink About2006-175 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2006-175 RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING AMENDMENT NO.2 TO THE FIVE-YEAR CAPITAL IMPROVEMENT PROGRAMS FOR FY's 2002-2007 & 2003-2008 AND AMENDMENT NO.1 TO THE FIVE-YEAR CAPITAL IMPROVEMENT PROGRAM FOR FY 2005-2010 FOR MEASURE "I" LOCAL EXPENDITURES. WHEREAS, San Bernardino County voters approved passage of Measure "]" in November, ]989, authorizing San Bernardino Associated Governments, acting as the San Bernardino County Transportation Authority, to impose a one-half of one percent retail transactions and use tax applicable in the incorporated and unincorporated territory of the County of San Bernardino; and, WHEREAS, San Bernardino County voters approved an extension of Measure '']'' in November, 2004, extending Measure "I" for an additional 30 years beyond the previous expiration in 2010; and, WHEREAS, revenue from the tax can only be used for transportation improvements and traffic management programs authorized in the Expenditure Plans set forth in Ordinance No, 89- I of the Authority; and, WHEREAS, Expenditure Plans of the ordinance require each local jurisdiction receiving revenue from the tax to expend those funds pursuant to a Five-year Capital Improvement Program and a Twenty- Year Transportation Plan adopted by resolution of the local jurisdiction; and, WHEREAS, Expenditure Plans of the ordinance also require that each local jurisdiction annually adopt and update the Five-Year Expenditure Plan, and WHEREAS, the Five-Year Capital Improvement Program for FY's 2002-2007 for Measure "]" Local Expenditures was approved by Resolution No. 2002-289 on 09/23/02, and, WHEREAS, the Five-Year Capital Improvement Program for FY's 2003-2008 for Measure "]" Local Expenditures was approved by Resolution No. 2003-263 on 09/15/03, and, WHEREAS, Amendment No. I to the Five-Year Capital Improvement Programs for FY's 2002-2007 and 2003-2008 for Measure "]" Local Expenditures was approved by Resolution No. 2004-142 on 06/07/04, an WHEREAS, the Five-Year Capital Improvement Program for FY's 2005-2010 for Measure "]" Local Expenditures was approved by Resolution No. 2005-288 on 08/15/05, and, WHEREAS, Amendment NO.2 to the Five-Year Capital Improvement Program (2002- 2007) for Measure "]" Local Expenditures is necessary due to changes detailed in Attachment "'A", and, WHEREAS, Amendment No.2 to the Five-Year Capital Improvement Program (2003- 2008) for Measure "]" Local Expenditures is necessary due to changes detailed in Attachment "B", and, 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION ...... APPROVING AMENDMENT NO.2 TO THE FIVE-YEAR CAPITAL IMPROVEMENT PROGRAMS FOR FY's 2002-2007 & 2003-2008 AND AMENDMENT NO.1 TO THE FIVE-YEAR CAPITAL IMPROVEMENT PROGRAM FOR FY 2005-2010 FOR MEASURE "I" LOCAL EXPENDITURES WHEREAS, Amendment No. I to the Five-Year Capital Improvement Program (2005- 20 I 0) for Measure "I" Local Expenditures is necessary due to changes detailed in Attachment "'C", and, NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Amendment No.2 to the Five-Year Capital Improvement Programs (CIP), for Measure "I" Program of Local Expenditures, for FY 2002 through 2007 and FY 2003-2008, copies of which is attached hereto, marked Attachment "A" and Attachment "B" and incorporated herein as fully as though set forth at length, are hereby adopted. SECTION 2. Amendment No. I to the Five- Year Capital Improvement Programs (CIP), for Measure "I" Program of Local Expenditures, for FY 2005 through 20 I 0, a copy of which is attached hereto. marked Attachment "C" and incorporated herein as fully as though set forth at length, are hereby adopted. SECTION 3. Except as noted in Attachment "A", Attachment "B" and Attachment "C", all other local expenditures of Measure I funds for FY 2002 though 2007, FY 2003 through 2008, and FY 2005 through 20 I 0 remain unchanged. SECTION 4. The "twenty-year transportation plan," for Measure ''!'' Program of Local Expenditures, adopted by Resolution No. 92-277, on July 20, 1992, is still in effect.
