HomeMy WebLinkAbout1986-049 RESOLUTION NO. 86-49 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO ORDER THE VACATION OF A PORTION OF HOSPITALITY LANE, WEST OF CARNEGIE DRIVE, AND RESERVING PUBLIC UTILITY EASEMENTS THEREON. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council of the City of San Bernardino hereby declares its intention to order the vacation of a portion of Hospitality Lane, West of Carnegie Drive, in said City, which said portion is more particularly described as follows: Those portions of Hospi tal i ty Lane as shown on Tract No. 12034 per map recorded in Book 168 of Maps, pages 75-87 inclusive, Records of the County Recorder of San Bernardino County, State of California, more particularly described as follows: PARCEL A COMMENCING at a point on the centerline of Hospi ta 1 i ty Lane that is North 720 19' 16" East 248.08 feet from the Northeasterly ri ght- of-way of the San Timoteo Creek as shown on said Tract No. 12034. Said point is also the beginning of a 1200 foot radius curve concave Southerly with a central angle of 030 17' 20". A radial line at said point bears North 170 40' 44" West. THENCE Northerly along said radial line a distance of 45.00 feet to a point on the Northerly right-of-way of said Hospitality Lane, said point being the beginning of a tangent curve concave Southerly having a radius of 1245.00 feet; THENCE Easterly along said tangent curve to the right, radial to the last described course, through a central angle of 010 20' 00", for an arc distance of 28.97 feet, to a point on a non-tangent curve concave Southerly, having a radius of 60.00 feet, through which a radial 1 ine bears North 590 27' 57" West, said point also being the TRUE POINT OF BEGINNING; 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 /1// 28 THENCE Easterly along said curve to the right, through a central angle of 730 18' 35", for an arc di stance of 76.77 feet, to a point of reverse curve, concave Northerly, having a radius of 100.00 feet; THENCE Easterly along said curve to the left, through a central angle of 250 00' 28", for an arc distance of 43.65 feet, to a point of cusp with a curve, concave Southerly, having a radius of 1245.00 feet; THENCE Westerly along said curve to through a central angle of 050 10' an arc di stance of 112.59 feet to POINT OF BEGINNING. PARCEL B the left, 54", for the TRUE COMMENCING at a point on the centerline of Hospi ta 1 i ty Lane that is North 720 19' 16" East 248.08 feet from the Northeasterly right- of-way of the San Timoteo Creek as shown on said Parcel Map 8493. Said point is also the beginning of a 1200 foot radius curve concave Southerly wi th a central angle of 030 17' 20". A radial line at said point bea~,North 170 40' 44" West. THENCE Southerly along said radial line a distance of 45.00 feet to a point on the Southerly right-of-way of said Hospitality Lane, said point being the beginning of a tangent curve concave Southerly having a radius of 1155.00 feet; THENCE Easterly along said tangent curve to the right, radial to the last described course, through a central angle of 010 28' 09", for an arc distance of 29.62 feet to the TRUE POINT OF BEGINNING; THENCE continuing along said curve to the right, through a central angle of 050 02' 44", for an arc distance of 101.71 feet to a point of cusp with a curve, concave Southerly, having a radius of 100.00 feet; THENCE along said curve to the left, through a central angle of 250 00' 28", for an arc di stance of 43.65 feet, to a poi nt of reverse curve, concave Northerly, having a radius of 60.00 feet; 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 THENCE along said curve to the right, through a central angle of 590 27' 37", for an arc distance of 62.27 feet, to the TRUE POINT OF BEGINNING. SECTION 2. That the Mayor and Common Council of the Ci ty of San Bernardino, in vacating the above described portion of said street, elects to proceed under and in accordance with the provisions of the "Public Streets, Highways and Services Vacation Law", being Division 9, Part 3, of the Streets and Highways Code of the State of California. SECT ION 3. Tha t the hour of 9 :00 A.M. on the 17th day of Mar c h, 1986, i nth e Co u n c il C ham be r 0 f the City Hall, San Bernardino, California, be, and the same hereby is fixed as the time and place when and where all persons interested in or objecting to the proposed vacation may appear before the said Mayor and Common Council and offer evidence in relation thereto. For further particulars as to the proposed vacation of the hereinbefore described portion of said street, reference is made to that certain map marked "Plan No. 6879" approved February 17, 1986, on file in the office of the City Clerk of said City. SECTION 4. Nothing in this Resolution shall in any way affect or disturb any existing easements for sanitary sewer and appurtenant facilities and for public utility purposes belonging either to the City of San Bernardino or to any public utility, and there is hereby reserved for future general public utility purposes and for this City an easement reasonably necessary to locate such sanitary sewer and public utility facilities over, in, under or across the real property here- 3 ~ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 inabove described and to use, maintain, repair, replace or renew such fad 1 i ties. SECTION 5. That the City Engineer of the City of San Bernardino hereby is directed to cause Notices of Street Vacation to be posted as required by the Public Streets, Highways and Services Vacation Law. SECTION 6. That the City Clerk shall certify to the adoption of this Resolution of Intention and shall cause the same to be published once a week for two successive weeks in The Sun, a newspaper publ i shed and circulated in the Ci ty of San Bernardino, prior to the date of the above public hearing. I HEREBY CERTIFY that the foregoing resolution was duly adopted by the Mayor and Common Council of the City of San Bernardino at a meeting thereof held on the reqular 17th day of 1986, by the following vote, February , to-wi t: AYES: Council Members Estrada, Reilly, Hernandez, Marks.
