HomeMy WebLinkAbout1986-041 ~ 1 RESOLUTION NO. 86-41 2 RESOLUTION OF THE CITY OF SAN BERNARDINO CALLING A SPECIAL MUNICIPAL ELECTION AND REQUESTING THE BOARD OF SUPERVISORS OF THE 3 COUNTY OF SAN BERNARDINO TO CONSOLIDATE THE SPECIAL MUNICIPAL ELECTION WITH THE STATEWIDE PRIMARY ELECTION TO BE HELD ON JUNE 3, 4 1986. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 6 SAN BERNARDINO AS FOLLOWS: 7 SECTION 1. Recitals. 8 A. The Mayor and Common Council desire to submit to the 9 electors at a special municipal election to be held on June 3, 10 1986, a proposed charter amendment for their approval or 11 disapproval. 12 B. June 3, 1986, is also the date of a statewide primary 13 election. 14 C. It is desirable that the special municipal election be 15 consolidated with the statewide primary election to be held on the 16 same date; that within the City of San Bernardino the precincts, 17 polling places and election officers for the two elections be the 18 same; that the Board of Supervisors of the County of San 19 Bernardino canvass the returns of the City election; and that the 20 statewide primary election and the special municipal election be 21 held in all respects as if there were only one election. 22 SECTION 2. Special Municipal Election. A special municipal 23 election is called and will be held in the City of San Bernardino 24 ~n Tuesday, June 3, 1986, for the purpose of submitting to the 25 qualified electors of the City, for their approval or disapproval, 26 a Charter amendment as proposed and submitted by the Mayor and 27 Common Council by a resolution adopted or to be adopted. 28 SECTION 3. Request for Consolidation. Pursuant to Section . 1 23302 of the Elections Code, the Mayor and Common Council of the 2 City of San Bernardino request that the Board of Supervisors of 3 the County of San Bernardino consolidate the City's special 4 municipal election with the statewide primary election to be held 5 on June 3, 1986. 6 SECTION 4. Measure. The measure to be voted on at the 7 special municipal election as it is to appear on the ballot shall 8 be as follows: 9 10 11 SPECIAL MUNICIPAL ELECTION CITY OF SAN BERNARDINO 12 MEASURE CHARTER. . AMENDS THE SAN BERNARDINO : YES 13 Shall the Charter be amended to adopt a 14 p~b~ic policy continuing the sale or g1vlng away of impounded and unclaimed 15 animals for research, testing or educational purposes to legally accredited 16 organizations. : NO : : 17 18 The measure shall be designated on the ballot by a letter 19 printed on the left margin of the square containing the 20 description of the measure as provided in the Elections Code of 21 the State of California. 22 SECTION 5. Notice of Election. Within the time prescribed 23 by the Government Code of the State of California, the proposed 24 Charter amendment shall be published once in the San Bernardino 25 Sun, a newspaper of general circulation, printed, published and 26 circulated in the City of San Bernardino. In addition, and 27 pursuant to the provisions of Government Code Section 34456, 28 copies of the proposed Charter amendment shall be printed in -2- 1 pamphlet form and mailed to each of the qualified electors of the 2 City, and notices shall be published in the San Bernardino Sun as 3 required by Government Code section 34456 to the effect that 4 additional copies of the proposed Charter amendment may be 5 obtained from the City Clerk upon request. 6 SECTION 6. Canvass of Returns by Board of Supervisors. The 7 Board of Supervisors of the County of San Bernardino is authorized 8 to canvass the returns of the special municipal election called by 9 this resolution, and to conduct the special municipal election and 10 the statewide primary election in all respects as if there were 11 only one election with only one form of ballot. 12 SECTION 7. Conduct of Election. The special municipal 13 election called by this resolution shall be held in such precincts 14 and at such polling places as shall be determined by the Registrar 15 of Voters of the County of San Bernardino. The Board of 16 supervisors of the County of San Bernardino is hereby requested to 17 issue instructions to the Registrar of Voters to take all steps 18 necessary for the holding of the consolidated election. The Mayor 19 is hereby authorized to execute a contract for the services 20 necessary for conducting the municipal election. 21 SECTION 8. Submission of Arguments and Rebuttal Arguments. 22 A. The Mayor and Common Councilor any member authorized by 23 Councilor any registered voter or bona fide association of 24 citizens entitled to vote on the proposal is invited to submit and 25 file with the City Clerk for printing and distribution in the 26 ballot pamphlet an argument for or against the measure. Such 27 argument shall not exceed three hundred words in length, shall be 28 accompanied by no more than five signatures, and shall be -3- 1 accompanied by the statement in Section 5350 of the Elections 2 Code. 3 B. The last day for submission of primary arguments for or 4 against the measure has been established as 4:30 p.m. on Tuesday, 5 March 4, 1986, in the City Clerk's Office, Second Floor, City 6 Hall, 300 North "D" Street, San Bernardino. 7 C. The last day for receipt of rebuttal arguments is 4:30 8 p.m. on Tuesday, March 11, 1986, in the City Clerk's Office at the 9 above location. 10 SECTION 9. Certification After Ratification by Voters. 11 Three copies of the complete text of the Charter amendment 12 approved by the electorate shall be certified and authenticated by 13 the Mayor and City Clerk in a document setting forth the 14 submission of the Charter to the electors of the City and its 15 ratification by them. The City Clerk shall file one copy with the 16 Recorder of the County of San Bernardino, retain one copy for the 17 City Archives, and submit the third copy to the Secretary of State 18 together with certified copies of the publication of the proposed 19 Charter amendment, the arguments for and against the Charter 20 proposal which were mailed to voters, and a certified abstract of 21 the vote at the election at which the Charter amendment was 22 approved. 23 SECTION 10. Filing of Resolution. The City Clerk of the 24 City of San Bernardino is directed to file a certified copy of 25 this resolution with the Board of Supervisors of the County of San 26 Bernardino, and a copy to the Registrar of Voters of the County of 27 San Bernardino. 28 I HEREBY CERTIFY that the foregoing resolution was duly -4- 1 adopted by the Mayor and Common Council of the City of San 2 Bernardino at a fl ~rljf"\l1rnprl rp~111.:::lr- 3 the 13th day of 4 to wit: Februarv meeting thereof, held on , 1986, by the following vote, AYES: Council Members Estrada.
