ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE
NO. 763 ENTITLED IN PART "AN ORDINANCE PROVIDING FOR THE LICENSING
3 OF BUSINESSES . . . "1 LIMITING A TRANSIENT MERCHANT LICENSE TO 90
DAYS AND REQUIRING 30 DAYS TO ELAPSE BEFORE ISSUANCE OF A NEW
4 LICENSE AT THE SAME LOCATION; REPEALING SECTION SEVEN RELATING
TO PROCURING OF A "LICENSE HOLDER"l AND REPEALING SECTION FORTY-
ONE SUBSECTION (h) RELATING TO LIVE ENTERTAINMENT PE~1ITS.
I THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION 1. Ordinance No. 763 Section Ninety-Seven is
amended to read as follows:
"SECTION NINETY-SEVEN: For any person, firm or corporation
engaging in the business of "transient merchant" in the City of
San Bernardino, $5.00 per day.
The words "transient merchant" as used ,in this ,ordinance
shall be deemed to mean and include any person or persons, either
as principal or agent, employer or employee, who engages in the
temporary business of selling or offering for sale, goods, wares,
merchandise or things or articles of value, for a period of not
more than ninety (90) days, and who, for the purpose of carrying
on such business, hires, leases or occupies any room or building
(or a structure or stand immediately accessory or incidental to a
I retail store operation) on any real property, or on or adjoining
any street or public place in the City of San Bernardino. The
person, firm or corporation so engaged shall not be relieved
from the provisions of this ordinance by reason of associating
temporarily with any local dealer, trader, merchant or auctioneer,
or by reason of conducting such temporary business in connection
with, or as a part of, the business of any local dealer, trader,
merchant or auctioneer.

1 For the purposes of this section the phrase "ninety (90)
2 days" shall be defined to mean a period of ninety (90) continuous
3 calendar days at the same location. At least thirty (30) days
4 shall elapse before a new transient license may be issued to any
5 person, firm, or corporation at the same location where a previous
6 transient license had been issued.
7 The provisions of this section shall not apply to
8 Commercial Travelers or Selling Agents selling their goods to
9 dealers for the purpose of resale, whether selling for present or I
10 future deliveries by sample or otherwise, nor to persons selling
11 fresh fruit, vegetables, butter, eggs, or other farm or ranch
12 products raised or produced by themselves."

SECTION 2. Ordinance No. 763 Section Seven and Section
14 Forty-One Subsection (h) are hereby repealed.
