Subject:
Resolution adopting the Four-Year Capital Improvement Program (2006-20010) for Measure "I"
Local Expenditures.
Background:
In November 1989, voters approved Measure I authorizing San Bernardino Associated
Governments (SANBAG), acting as the Transportation Authority, to impose a one-half of one-
percent retail transaction and use-tax applicable throughout the county for a period of 20 years
beginning April, 1990 and extending to March 31, 2010. This tax has become cornmonly
known as the Y2-cent sales tax. In November of 2004, voters overwhelmingly approved an
extension of the Y2-cent sales tax for an additional 30 years from April 1, 2010, extending it to
March 31, 2040.
This Y2 cent sales tax can only be used for transportation improvements and traffic management
programs authorized in the expenditure plans set forth in Ordinance No. 89-1 of the
Transportation Authority.
The referenced ordinance requires each local agency to expend funds based on a 5-year Capital
Improvement Program and 20-year Transportation Plan adopted by resolution. The Expenditure
Plan only relates to these funds and their expenditure; it is mandatory that each agency update
the plan and program each year.
Since the current plan expires in year 2010, SANBAG is requiring a 4-year Measure I Capital
Improvement Program covering FY 2006 through FY 2010.
The proposed 4- Y ear Program for Measure I Local Funds (Attachment A) is based upon the first
four years ofthe City's 5-Year Capital Improvement Program (CIP).
Changes to the program during the year are permitted subject to approval of Amendments to the
plan year by action of the Mayor and Common Council.
This year, SANBAG is again requiring cities to provide an "Expenditure Strategy" statement.
Attached is a copy of the proposed statement (see Attachment "B") for this year.
At the September 5, 2006 Council meeting this item was continued to the meeting on September
18, 2006. The Resolution has been revised, and Attachment "D" has been added to the
Resolution to address additional potential conflicts of interest for various Council Members.
There were no changes to Attachments "A" through "C".

Financial Impact:
The financial impact related to the adoption of the Expenditure Plan is reflected in the attached
4-year Capital Improvement Plan (CIP) for the City.

2. (Script prior to voting) Due to potential conflicts of interest which require the specified
Councilmembers to recuse themselves from voting on Measure I Capital Improvement
Projects (CIPs) located within 500 feet of real property which they own or have an interest,
we will have three (3) separate actions on this item.
On the first action, the full Council will vote on all Measure I CIP's, except those which pose
a potential conflict of interest to Councilmembers Baxter, Johnson and McCammack. Do
I have a motion to adopt the Resolution with Attachments "A" & "B" which include all
Measure I CIP's except those which pose a potential conflict for Councilmembers Baxter,
Johnson, and McCammack.
(Motion is made and seconded. Question is called and all
Councilmembers vote on Attachments "A" and "B".)
3. The next vote will be on Measure I CIP's that pose potential conflicts of interest to
Councilmembers Baxter and McCammack as identified in Attachment "c" to the Resolution.

Baxter: "Because I own or have an interest in real property
within 500 ft. of CIP Code # SS04-116, I shall abstain on this
motion. "
McCammack: "Because I own or have an interest in real
property within 500 ft. of CIP Code # SS07-25, I shall abstain on
this motion."
Baxter and McCammack leave the Council Chambers.

Attachment "C".)
4. At this point, Councilmembers Baxter and McCammack will now return to the meeting to
vote on Attachment "0".

2 RESOLUTION OF THE CITY OF SAN BERNARDINO ADOPTING THE FIVE-
YEAR CAPITAL IMPROVEMENT PROGRAM (2006-2010) FOR MEASURE "I" LOCAL
3 EXPENDITURES.
4 WHEREAS, San Bernardino County voters approved passage of Measure "I" in November,
5 1989, effective 1990 through 2010, authorizing San Bernardino Associated Governments, acting as
6 the San Bernardino County Transportation Authority, to impose a one-half of one percent retail
7 transactions and use tax applicable in the incorporated and unincorporated territory of the County
8 of San Bernardino; and,
WHEREAS, revenue from the tax can only be used for transportation improvements and
traffic management programs authorized in the Expenditure Plans set forth in Ordinance No. 89-1
of the Authority; and,
WHEREAS, Expenditure Plans of the ordinance require each local jurisdiction receiving
revenue from the tax to expend those funds pursuant to a Five-year Capital Improvement Program
and a Twenty- Year Transportation Plan adopted by resolution of the local jurisdiction; and,
WHEREAS, Expenditure Plans of the ordinance also require that each local jurisdiction
annually adopt and update the Five-Year Expenditure Plan.
NOW THEREFORE, BE IT RESOLVED that the Measure "I" Five-Year Capital
Improvement Program and Twenty-Year Transportation Plan (2006-2010) attached hereto marked
Attachment "A" and incorporated herein by reference as though fully set forth, and the expenditure
strategy identified as Attachment "B" to this Resolution is adopted, except for Streets/Street Lighting
CIP code numbers SS 04-116 and SS07-25, which shall be voted upon by separate motion to become
part of this Resolution as Attachment "C" and such vote on Attachment "C" shall include the
Authorization for the Expenditure Strategy as identified as Attachment "B" to this Resolution.

MEASURE I FOUR-YEAR CAPITAL IMPROVEMENT PLAN
EXPENDITURE STRATEGY
2006/2007
The City of San Bernardino will continue to place emphasis on both the regional
and sub-regional arterial roadway system during the remaining four years of the
current Measure I program. At least fifty percent of our Measure I funds
allocation will be earmarked for specific capital projects that are geared towards
improving traffic flow and motorist convenience. Failing pavement surfaces will
be rehabilitated and traffic striping modified as needed to accommodate increased
traffic demand; and intersection capacity will be improved with new and modified
traffic signals.
In addition to the above capital projects program, San Bernardino will continue to
allocate up to fifty percent of our annual Measure I funds towards public works
maintenance activities. Maintenance work will continue to include the city I S traffic
signal systems, sidewalk and curb repair, and pavement repair and overlay on the
local street system.
