Staff Report
Subiect:
Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the
Director of the Parks, Recreation and Community Services Department to execute Amendment
No.4 to the Agreement for Consultant Services for the CAPS Program between the City and the
San Bernardino Unified School District.
Back2round:
The Children's After-School Program for Success (CAPS) is a grant funded program
administered by the San Bernardino City Unified School District to provide before & after-
school programs at school sites. The city has been a sub-contractor to the school district in this
program since 1999. The schools provide teachers and aides to instruct educational and tutorial
programs. The Parks, Recreation and Community Services Department (PRCSD) provides
various recreational activities to the youth in the program. The agreement covered the term July
1,2005 through June 30, 2006 in the amount of $401,109.
Over the course of this agreement the School District requested several changes to the agreement
to increase staff at some CAPS sites and add staff to additional CAPS sites. These additional
staff and programs were added by PRCSD with the understanding that the district would draft
agreement amendments to reflect these new costs. The amendments highlight each specific
program expansion that occurred throughout the agreement term. Amendment No.1 increased
the funding by $42,700 to a total of $443,809. Amendment No.2, a companion item on this City
Council docket, increases the agreement amount by $2,500 to $446,309. Amendment No. 4
includes $11,500. The new total is $457,809. All of these amendments reflect the agreement's
original term of July 1, 2005 through June 30, 2006.
Amendment No. 3 was approved by previous City Council action to extend the term of the
original agreement to September 30, 2006 in the amount of$IIO,494.
Financial Impact:
The total of $457,809 will cover all staff costs for the period July I, 2005 - June 30; 2006.
Recommendation:

SECTION 1. The Director of the Parks, Recreation and Community Services
9 Department of the City of San Bernardino is hereby authorized and directed to execute

Amendment No.4 to the agreement for consultant services for the CAPS Program with the San
Bernardino City Unified School District. A copy of said agreement is hereby attached hereto,
marked Exhibit "A", and incorporated herein by reference as fully as though set forth at length.

SECTION 2. The authorization granted hereunder shall expire and be void and of no
further effect if the agreement is not executed by both parties and returned to the Office of the

16 City Clerk within 120 days following effective date of the Resolution.

AGREEMENT FOR CONSULTANT SERVICES IN
COLLABORATION WITH DISTRICT FOR
THE CREATIVE BEFORE AND AFTER SCHOOL PROGRAM FOR SUCCESS (CAPS)
THE AGREEMENT made and entered into the 18th day of July, 2005, by and between the SAN
BERNARDINO CITY UNIFIED SCHOOL DISTRICT, hereinafter referred to as the
"DISTRICT", and CITY OF SAN BERNARDINO PARKS, RECREATION AND
COMMUNITY SERVICES DEPARTMENT, hereinafter referred to as the
"CONSULTANT" is hereby amended this 19th day of July, 2006, hereinafter Amendment No.
4.
RECITALS
WHEREAS, the DISTRICT is authorized by Section 53060 of the California Government Code
to contract with and employ any persons for the furnishing of special services and advice in
financial, economic, accounting, engineering, legal, or administrative matters, if such persons are
specially trained and experienced and competent to perform the special services required; and,
WHEREAS, the CONSULTANT itself is, or those hired by the CONSULTANT are, specially
trained, experienced and competent to render the special services required by the DISTRICT,
and such services are needed on a limited basis; and,
NOW, THEREFORE, in consideration of the covenants and conditions hereinafter set forth, the
DISTRICT and the CONSULTANT mutually agree to amend this agreement as follows:
L CHANGES TO THE AGREEMENT:
Pa2e 3. Article IV. Consultant's Fee and Payment Thereof, Paragraph A is amended as
follows:
The amount payable to the CONSULTANT for the period July I, 2005 - June 30, 2006,
shall be increased by an amount not to exceed Eleven Thousand Five Hundred Dollars
($11,500.00) for a new aggregate total for this period of not-to-exceed Four Hundred
Fifty-Seven Thousand Eight Hundred Nine Dollars ($457,809.00).

Any prior Amendment to this Agreement is hereby revoked to the extent it is inconsistent
with this Amendment. All other terms and conditions will remain in full force and effect.
