Staff Report
Subiect:
Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the
Director of the Parks, Recreation and Community Services Department (PRCSD) to execute
Amendment No.2 to the Agreement for Consultant Services for the CAPS Program between the
City and the San Bernardino Unified School District.
Backluound:
The Children's After-School Program for Success (CAPS) is a grant funded program
administered by the San Bernardino City Unified School District to provide before & after-
school programs at school sites. The CAPS Program is offered at seventeen elementary schools.
The city has been a sub-contractor to the school district in this program since 1999. The schools
provide teachers and aides to teach educational and tutorial programs. The Parks, Recreation and
Community Services Department (PRCSD) provides arts and crafts and other recreational
activities to the youth. The agreement covered the term July 1, 2005 through June 30, 2006 in the
amount of $401,109.
Over the course of this agreement the School District requested several changes to the agreement
to increase staff at some CAPS sites and add staff to additional CAPS sites. These additional
staff and programs were added by PRCSD with the understanding that the district would draft
agreement amendments to reflect these new costs. The amendments highlight each specific
program expansion that occurred throughout the agreement term. Amendment No.1 increased
the funding by $42,700 to a total of $443,809. Amendment No.2 increases the agreement
amount by $2,500 to $446,309. Therefore, the department is requesting execution of
Amendment No.2.
Financial Imoact:
This amendment will cover staffing costs incurred during the contract period July 1, 2005
through June 30, 2006. The grant award will be increased $2500 from $443,809 to $446,309.
Recommendation:

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
6 OF SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. The Director of the Parks, Recreation and Community Services

Department of the Cit)' of San Bernardino is hereby authorized and directed to execute
9
Amendment No. 2 to the agreement for consultant services for the CAPS Program with the San
10
Bernardino City Unified School District. A copy of said agreement is hereby attached hereto,
11
12 marked Exhibit "A", and incorporated herein by reference as fully as though set forth at length.
13 SECTION 2. The authorization granted hereunder shall expire and be void and of no
14 further effect if the agreement is not executed by both parties and returned to the Office of the

City Clerk within 120 days following effective date of the Resolution.

THIS AMENDMENT is made and entered into this 21" day of June, 2006, by and
between the BAR BERIIARDIKO CITY UNIFIED SCHOOL DISTRICT, hereinafter
referred to as the "DISTRICT", with its principal place of business at 777 N. oF" Street,
San Bernardino, California 92410, and, CITY OF BAR BBRIIARDIKO, PARKS,
RBCRBATlOK AKD COIOlUJlII I SERVICES, hereinafter referred to as the "CITY"
having a principal place of business at 547 N. Sierra Way, San Bernardino, California
92410.
RECIT ALS:
WHEREAS, the CITY is authorized under the terms and conditions of the original
Agreement entered into on the 18th day of July, 2005, to provide a variety of learning
experiences in the area of art, fitness and sports skills, and values through the
provisions of Recreational Aides at each school participating in the CAPS Program;
and,
WHEREAS, any increase or revision in the Agreement is accomplished by means of an
amendment;
NOW, THEREFORE, the DISTRIcr and the CITY mutually agree to amend the existing
Agreement as follows:
1. The amount payable to the CITY as specified in Section N (A) City'. Fee _d
PaymeDt Thereof, of the original Agreement shall be increased by an amount
not to exceed Two Thousand Five Hundred Dollars ($2,500.00) for a new
aggregate total of not-to-exceed Four Hundred Forty Six Thousand Three
Hundred Nine Dollars ($446,309.00).
2. This Amendment is effective upon execution. In the event of any conflict or
inconsistency between the provisions of this Amendment and . the original
Agreement, the provisions of this Amendment shall control. All other terms and
conditions of the original Agreement shall remain the same.
