Synopsis of Previous Council Action:
On August 21, 2006, Mayor and Common Council approved Resolution No. 2006-291,
Implementing Memorandum of Understanding Between the City of San Bernardino and
Employees in the Police Safety Employees' Bargaining Unit Represented by San Bernardino
Police Officers' Association(SBPOA)

SUBJECT
Adopt Resolution approving a Side Letter to Resolution No. 2006-291, amendment to Article VI, Section 5, of
the Memorandum of Understanding between the City of San Bernardino and employees in the Police Safety
Employees' Bargaining Unit represented by the San Bernardino Police Officers' Association (SBPOA).
BACKGROUND
The SBPOA has requested a reopener to the 2006-09 Memorandum of Understanding to revise language to
Article VI, Working Conditions, Section 5, Reemployment. New language allows a former employee who
reapplies within 90 calendar days and is rehired within one year to have his/her seniority restored,minus the
actual time not employed by the City. The proposed language that will replace the current language is as
follows:
"Current and new employees who have terminated City employment and who subsequently reapply within 90
days and are rehired within one year to the same classification shall receive restoration of seniority except for
the duration of the absence.
The restored seniority of any current employee shall be effective upon the adoption of this language and such
seniority status shall only be used for applicable purposes occurring on or after the date of such adoption."
The SBPOA has agreed to this language.
FINANCIAL IMPACT
No cost to general fund.

6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
7 SAN BERNARDINO AS FOLLOWS:
8 SECTION 1. The Mayor and Director of Human Resources are hereby authorized and
9 directed to execute on behalf of said City a Side Letter to Resolution No. 2006-291, amending
10 Article VI, Working Conditions, Section 5, Reemployment, a copy of which amendments are
11 attached hereto and incorporated herein marked Exhibit A.

SIDE LETTER TO RESOLUTION NO. 2006-291
FOR POLICE SAFETY EMPLOYEES
The following sets forth the Side Letter to Resolution No. 2006-291, for full-time regular active
Police Safety Employees. This Side Letter replaces current language in Article VI—Working
Conditions, Section 5 —Reemployment, of the Police Safety Employees' Memorandum of
Understanding.
Article VI, Working Conditions— Section 5, Reemployment
Current language:
An employee who has terminated City employment and who is subsequently rehired in the same
classification in a regular position within a 90-day period may receive restoration of salary step.
Seniority shall begin anew as of the rehire date. All other authorized benefits shall accrue as of
the date of rehire.
New language:
Current and new employees who have terminated City employment and who subsequently
reapply within 90 days and are rehired within one year to the same classification shall receive
restoration of seniority except for the duration of the absence.
The restored seniority of any current employee shall be effective upon the adoption of this
language and such seniority status shall only be used for applicable purposes occurring on or
after the date of such adoption.
