RESOLUTIONS SUPPORTING THE CONSTRUCTION BY THE STATE OF CALIFORNIA
OF A NEW JUSTICE CENTER AND COURTHOUSE FACILITY
IN THE CITY OF SAN BERNARDINO
BACKGROUND/CURRENT ISSUE:

The present Courthouse facility for the Superior Court of the County of San Bernardino, Main Branch,
is located at 351 North Arrowhead Avenue and was constructed in 1927 as an umeinforced masomy
struct~e and consists of several courtrooms in the original structure thereof (the "San Bernardino
Courthouse"). Additional courtrooms were constructed after 1927 as a then modern addition to the
San Bernardino Courthouse to better serve the public and the residents of the County of San
Bernardino and such addition has since fallen into a state of disrepair and is in dire need for seismic
retrofit and major structural upgrades for its continued use as a public facility. Consequently, in or
about 2000, a San Bernardino area committee was formed comprised of local community leaders,
business people and elected officials who desired to assure that all necessary studies were undertaken
and financing options were reviewed to determine the feasibility of constructing a new courthouse
facility in downtown San Bernardino (the "San Bernardino County Justice Center and Courthouse
Facility") as such location as determined to best serve the needs of the residents of the local
community and the State. While in the past, the State of California considered the development of a
new San Bernardino County Justice Center and Courthouse Facility a low priority, recently, the State
compared San Bernardino County's needs to other counties on a State-wide basis, and based on the
need, a new evaluation criteria and inclusion of a category for "Access to Justice", the San Bernardino
County Justice Center and Courthouse Facility ascended to the top priority group, number three (3) on
the list. The other two (2) cities are the City of Long Beach and the City of Stockton. The San
Bernardino County Justice Center and Courthouse Facility increased its ranking when the new
prioritization criteria was applied due in large part to recognizing the need for additional judges and
thus the corresponding need for additional courtrooms in San Bernardino. The State of California
must now allocate resources toward the development of the new County Justice Center and Courthouse
Facility, estimated to cost more than $252 million.
The City of San Bernardino ("City") and the Redevelopment Agency of the City of San Bernardino
("Agency") have a successful history of working in cooperation with the State of California to
maintain State offices in the downtown area of the City, such as the development of the new
"Superblock". The State has attempted to provide more cost effective services to the residents of the
State and to promote Agency economic development and redevelopment opportunities within the
downtown area of the City. The specific working relationship between the State, City and Agency are
described in further detail in the attached Resolutions.
Moreover, the Agency and the City have intended that the Former Caltrans Site, presently located at
247 East 3'd Street, owned by the Agency, located in the block immediately across the street and to the
south of the existing dated San Bernardino Courthouse, should become the site of the new San
Bernardino County Justice Center and Courthouse Facility, and the Agency, with the concurrence of

C the Mayor and Common Council, intends on transferring fee title to the Former Caltrans Site to the
State for the construction and development of such a new San Bernardino County Justice Center and
Courthouse Facility without cost to the State.
The County of San Bernardino now owns the 303 3rd Street Building (formally owned by the State of
California and then the 303 LLC) with the intent of utilizing such 303 Building for interim courtroom
facilities during the remodeling and seismic retrofit of the San Bernardino Courthouse and thereafter to
convert said 303 Building into a County of San Bernardino administrative office building.
The Mayor and Common Council and the Community Development Commission, by the adoption of
the attached Resolutions, will declare the intent to assist and support the State in the development of
the San Bernardino County Justice Center and Courthouse Facility on the Former Caltrans Site for the
benefit of the residents of the City and the taxpayers of the State. The Mayor and Common Council
and the Community Development Commission further commit to cause the Agency to transfer title to
the Former Caltrans Site, with an estimated value in excess of $5 million (said value presents a
financial contribution by the Agency on behalf of the City) to the State for the immediate construction
and development of the San Bernardino County Justice Center and Courthouse Facility. In addition,
the City and Agency are committed to provide the necessary City Staff and Agency Staff resources to
further the construction and development of the San Bernardino County Justice Center and Courthouse
Facility and to expedite the site planning process, engineering review, utility connections, including
City of San Bernardino water and sewer utilities, and all other development related issues that may
need to be addressed to cause the San Bernardino County Justice Center and Courthouse Facility to be
completed and functional in an expeditious manner.

9 WHEREAS, the present Courthouse facility for the Superior Court of the County of San
10 Bernardino, Main Branch, is located at 351 North Arrowhead Avenue and was constructed in 1927
11 as an unreinforced masonry structure and consists of several courtrooms in the original structure
12 thereof (the "San Bernardino Courthouse"); and
WHEREAS, additional courtrooms were constructed after 1927 as a then modern addition
to the San Bernardino Courthouse to better serve the public and the residents of the County of San
Bernardino, and such addition has since fallen into a state of disrepair and is in dire need of seismic
retrofit and major structural upgrades for its continued use as a public facility; and
WHEREAS, a grant from the Federal Emergency Management Agency (in addition to other
funding sources) has been obtained by the County of San Bernardino in the amount of $5,000,000
to provide funds for the seismic retrofit to the San Bernardino Courthouse as required for a public
use facility, and the County of San Bernardino has commenced the preparation of engineering and
architectural plans and specifications in connection with such upgrade; and
WHEREAS, both the City of San Bernardino (the "City") and the Redevelopment Agency
of the City of San Bernardino (the "Agency") have a successful history of working in cooperation
with the State of California to maintain State offices in the downtown area of the City in
furtherance of the State providing more cost effective services to the residents of the State and to
26 promote economic development and redevelopment opportunities for the Agency within the

WHEREAS, commencing in 1993, the State through the Department of General Services
("DGS") and the California Department of Transportation ("Caltrans") initiated the process to
consolidate State offices from outlying locations to a single site within the area of the downtown
San Bernardino commonly referred to as the "SuperBlock" on "E" and 4th Streets, downtown San
Bernardino, for which the Agency had acquired land during a 20 year period of time and initiated
the architectural and engineering design and site planning efforts for two (2) high rise State office
buildings, and appurtenant parking structures, to encourage the consolidation of DGS State office
tenants and Caltrans offices into a single downtown San Bernardino location; and
WHEREAS, as part of the incentives offered by the Agency to the State to encourage the
development of new State office facilities in downtown San Bernardino in the "SuperBlock" and to
reuse obsolete State office facilities, the Agency agreed to (i) acquire the former Caltrans building
site located at 247 East 3'd Street with the structures demolished and the site cleared (the "Former
Caltrans Site") and (ii) assist a developer with a financial loan package to acquire and remediate
environmental issues with the former DGS State office building located at 303 East 3'd Street (the
"303 Building"), and such actions of the Agency effectively expedited several levels of real estate
transactions required to cause the "SuperBlock" development of the State to be economically viable
17 in downtown San Bernardino; and
18 WHEREAS, in or about 2000, a San Bernardino area committee was formed comprised of
19 local community leaders, business people and elected officials who desired to assure that all
20 necessary studies were undertaken and financing options were reviewed to determine the feasibility
21 of constructing a new courthouse facility in downtown San Bernardino (the "San Bernardino
22 County Justice Center and Courthouse Facility") as such location was determined to best serve the
23 needs of the residents of the local community and the State; and
24 WHEREAS, the Agency and the City have intended that the Former Caltrans Site, presently
25 owned by the Agency, which is located in the block immediately across the street and to the south
26 of the San Bernardino Courthouse, should become the site of the new San Bernardino County
C 27 Justice Center and Courthouse Facility, and the Agency, with the concurrence of the Mayor and

1 Common Council, intends on transferring fee title to the Former Caltrans Site to the State for the
2 construction and development of such new San Bernardino County Justice Center and Courthouse
3 Facility without cost to the State; and
4 WHEREAS, the County of San Bernardino has recently acquired the fee title ownership of
5 the 303 Building with the intent of utilizing a portion of such 303 Building for interim courtroom
6 facilities during the remodeling and seismic retrofit of the San Bernardino Courthouse and
7 thereafter to convert said 303 Building into a County of San Bernardino administrative office
8 building; and
WHEREAS, the San Bernardino County Justice Center and Courthouse Facility was
previously a low priority project for new courthouse construction when compared to other counties
on a State-wide basis, but as a result of the addition of other evaluation criteria and the inclusion of
a category for "Access to Justice", the San Bernardino County Justice Center and Courthouse
Facility ascended to the top priority group when new prioritization criteria was applied due in large
part to the currently recognized need for additional judges, and thus, the corresponding need for
additional courtrooms; and
WHEREAS, the Mayor and Common Council by the adoption of this Resolution do hereby
declare their intent to assist and support the State in the development of the San Bernardino County
Justice Center and Courthouse Facility on the Former Caltrans Site, currently owned by the
Agency, for the benefit of the residents of the City and the taxpayers of the State and to cause the
Agency to transfer title to the Former Caltrans Site to the State for the immediate construction and
development of the San Bernardino County Justice Center and Courthouse Facility.
NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND ORDERED BY
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, AS

The Mayor and Common Council of the City of San Bernardino do hereby

RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION
OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENT TO
TRANSFER CERTAIN LAND OWNED BY THE REDEVELOPMENT
AGENCY OF THE CITY OF SAN BERNARDINO LOCATED AT 247 EAST
3RD STREET, DOWNTOWN SAN BERNARDINO, WITHIN THE CENTRAL
CITY EAST REDEVELOPMENT PROJECT AREA, TO THE STATE OF
CALIFORNIA TO FACILITATE THE DEVELOPMENT AND
CONSTRUCTION BY THE STATE OF CALIFORNIA OF A NEW JUSTICE
CENTER AND COURTHOUSE FACILITY
8 WHEREAS, the Redevelopment Agency of the City of San Bernardino (the "Agency")
9 acquired the approximately 7.12 acres site located at 247 East 3rd Street (the "Property"), in
10 Downtown San Bernardino and within the Central City East Redevelopment Project Area of the
11 Agency; and
12 WHEREAS, the Agency acquired the Property in a series of transactions by and among the
13 California Department of Transportation ("Caltrans") and the State of California, Department of
14 General Services ("DGS"), in support of the development of the new Caltrans high-rise office
15 building and parking structure located at 4th and "E" Streets in the area commonly referred to as the
16 "SuperBlock"; and
17 WHEREAS, the Agency acquired title to the Property from Caltrans through a Directors
18 Deed in 2003, with the intent that the Property would be offered to the State of California at no cost
19 at a later date for the purpose of constructing a new courthouse facility thereon (the "San Bernardino
20 County Justice Center and Courthouse Facility"); and
21 WHEREAS, the Agency through the official actions of the Community Development
22 Commission of the City of San Bernardino (the "Commission") intends to transfer the fee title to the
23 Property to the State of California for purposes of constructing the San Bernardino County Justice
24 Center and Courthouse Facility by the State of California, and the Commission on behalf of the
25 Agency will be required at a later date to comply with the provisions of the Community
26 Redevelopment Law (the "CRL") found as Health & Safety Code Section 30000, et seq., for the

1 WHEREAS, the Agency, through the official actions of the Commission by the adoption of
2 this Resolution, concurs and supports the Resolution as adopted by the Mayor and Common Council
3 of the City of San Bernardino as of this date in furtherance of the construction and development by
4 the State of California of the San Bernardino County Justice Center and Courthouse Facility on the
5 Property.
6 NOW, THEREFORE, THE COMMUNITY DEVELPOMENT COMMISSION OF THE
7 CITY OF SAN BERNARDINO, DOES HEREBY RESOLVE, DETERMINE AND ORDER, AS
8 FOLLOWS:
Section 1.
The Community Development Commission of the City of San Bernardino
does hereby confirm and ratify their intent to support the approval by the Mayor and Common
Council of the City of San Bernardino (the "Council") pursuant to a duly adopted Resolution of the
Council for the transfer of the Property, for the reasons set forth in the Recitals hereto, to the State
of California for the construction and development of the San Bernardino County Justice Center and
Courthouse Facility on the Property. Subject to compliance with the applicable provisions of the
CRL for the approval and transfer of real property, the Commission declares its present intent to
transfer the Property to the State of California for the construction and development of the San
Bernardino County Justice Center and Courthouse Facility. The Commission hereby finds and
determines that the value of such transfer to the State of California for the construction and
development of the San Bernardino County Justice Center and Courthouse Facility thereon has a
current market value of approximately $5,000,000, which dollar amount shall represent a financial
contribution by the Agency on behalf of the City for the purposes of the construction and
development of the San Bernardino County Justice Center and Courthouse Facility.
Section 2.
The Commission further commits Agency Staff resources to further the
construction and development of the San Bernardino County Justice Center and Courthouse Facility
and to expedite the site planning process and all other development related issues that may need to
be addressed to cause the San Bernardino County Justice Center and Courthouse Facility to be
completed and to become functional in an expeditious manner.
Section 3.
This Resolution shall take effect upon its adoption by the Commission.
