STAFF REPORT
Subject:
Resolution awarding a contract to R. 1. Noble Company for Pavement Rehabilitation on 5th Street from
Waterman Avenue to Tippecanoe Avenue (SS06-38) and Waterman Avenue from 5th Street to 9th
Street (SS04-145), per Project Plan No. 11726.
Background:
On August 15, 2005, the Mayor and Common Council allocated funds, as part of the FY 2005/06
Capital Improvement Program (CIP) for pavement rehabilitation at the above-mentioned locations.
The City of San Bernardino entered into an Agreement in March, 2006 with the County of San
Bernardino for the 5th Street Project. Per the Agreement, the City's share i5 32% and the County's
share is 68% of the construction cost. Upon completion of this project, the City will invoice the
County for their share of the project, Also, as part of the Agreement the County will pay for both
constructing and administering of that project. .
This project consists of the following:

Milling and removing damaged asphalt concrete pavement.
Overlay new asphalt pavement full width.
Stripe new pavement.
Replace loop detectors at intersections.
The plans and specifications for this project have been completed and the project was opened to public
bidding on May 30, 2006. The project was advertised locally in the San Bernardino County Sun.
Newspaper, F. W. Dodge, Construction Bid Board, High Desert Plan Room, San Diego Daily
Transcript, Sub-Hub Online Plan Room, Reed Construction Data, Bid America Online, Construction
Bid Source, Bid Ocean, the City's web site, and with the San Bernardino Area Chamber of Commerce.

Based on review of the sealed competitive bids received, staff has determined that R. J. Noble
Company., of Orange, CA., the apparent low bidder, has met the minimum requirements of the
specificati()ns and bid guidelines; and, therefore, recommends that the Mayor and Common Council
award the referenced contract to R. J. Noble Company.
The estimated project costs are as follows:

If approved, this project is expected to begin construction in August of 2006 and be completed by
November of2006.
Financial Impact:
Adequate total funding for these projects is available from the FY 2006/07 CIP from the two accounts

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AWARDING A CONTR<\CT TO R. J. NOBLE COMPANY FOR
PAVEMENT REHABILITATION ON 5TH STREET FROM WATERMAN AVENUE
TO TIPPECANOE AVENUE (SS06-38) AND WATERMAN AVENUE FROM 5TH
STREET TO 9TH S:rREET (SS04-145), PER PROJECT PLAN NO. 11726.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. R. J. Noble Company, 15505 E. Lincoln Avenue, Orange, CA 92865, is
the lowest responsible bidder for Pavement Rehabilitation on 5th Street from Watennan Avenue
to Tippecanoe Avenue (SS06-38) and Waterman Avenue from 5th Street to 9th Street (S804-
145), per Project Plan No.1 I 726. A contract is awarded accordingly to said bidder in a total
amount of $ 626,988.95, with a contingency amount of $ 94,048.34, but such contract shall be
effective only upon being fully executed by both parties. All other bids, therefore, are hereby
rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of the
City; a copy of th~ contract is on file in the office of the City Clerk and incorporated herein by
reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not take effect
or become operative until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it within
sixty (60) days of passage of this resolution.
