BETWEEN THE AGENCY AND SAN BERNARDINO HISTORICAL
AND PIONEER SOCIETY - 792 NORTH "D" STREET

BACKGROUND:
On January 9, 2006, the Community Development Commission ("Commission") approved a
Rehabilitation Grant Agreement between the Redevelopment Agency of the City of San Bernardino
("Agency") and the San Bernardino Historical and Pioneer Society ("Grantee") in the amount of $50,000
to complete much needed repairs to the Society's 114 year old Queen Ann Style Heritage House Museum,
Library and Meeting Hall. The wooden shingle roof is in a bad state of repair and leaks, especially in the
Library building where a lot of valuable and historically significant San Bernardino artifacts are in danger
of becoming damaged. The wooden shingle roof is also a significant fire hazard and needs to be replaced
with a fire retardant composite shingle. The paint on both structures is also peeling very badly and the
buildings will begin to suffer wood rot if they are not repainted in the very near future.
Museum officials informed Agency Staff prior to the January 9, 2006, approval that preliminary quotes
they had obtained indicated that the scope of work would be in the range of $25,000 ($14,000 to replace
the shingle and $11,000 to repaint the building). Without further in-depth knowledge, but aware that the
source of funds (Community Reinvestment Funds) would render the project subject to prevailing wage, so
escalating the cost of the project, Staff sought authorization from the Redevelopment Committee and the
Commission for a Rehabilitation Grant in the amount of $50,000.
CURRENT ISSUE:
Once Staff initiated expert evaluation of the building, it became apparent that the situation was far worse
than originally anticipated. When a sample of the old wooden shingles was removed, it was discovered
that there is no solid roof sheathing. The wooden shingles are attached to space sheathing which will
necessitate a new solid roof being installed to comply with Building Codes before the new composition
shingles can be attached.
A lead based paint analysis was performed and it was discovered that while the Library building is free of
lead (built in 1978), the house itself had been repainted at that time over the original lead based paint.
This necessitates the entire house being prepared (all loose and peeling paint scraped) and a lead
encapsulant applied to the entire structure under lead mitigation conditions before the house can be
repainted.
Museum staff have worked diligently to obtain private donations to help off set some of the costs such as
the receipts of Dunn and Edwards donation of the paint and GAF donation of the roof composition
shingle material. However, even with these private donations, because of the tremendous amount of
additional labor at prevailing wage, the cost of the project has risen to $125,500. This could not have
been anticipated before expert evaluation was obtained by Staff.

Not only is rehabilitation of this beautiful old house a vital link to preserving the history of our
community for generations to come, it is also regarded as an integral part of the Agency's efforts to
revitalize the Central City North Redevelopment Project Area. Members of the Grantee donate their time
to preserve this facility and its artifacts, and make it available to the public and schools. They have
worked diligently to obtain donations from the private sector to assist with this project but simply do not
have the means to carry out the project.
ENVIRONMENTAL IMPACT:
Categorically exempt under California Environmental Quality Act (CEQA) Section 15301.
FISCAL IMPACT:
$75,500 from Community Reinvestment Funds.
RECOMMENDATION:
That the Community Development Commission adopt the attached Resolution.

WHEREAS, the Community Development Commission of the City of San Bernardino

(the "Commission") is the governing board of the Redevelopment Agency of the City of San
11
Bernardino (the "Agency"); and
WHEREAS, the subject property is located at 792 North "D" Street, San Bernardino,

California, within the Central City North Redevelopment Project Area (the "Property"); and
WHEREAS, on January 9,2006, the Commission adopted Resolution No. CDC/2006-1

approving a Rehabilitation Grant Agreement (the "Grant Agreement") by the Agency to the
San Bernardino Historical and Pioneer Society (the "Grantee") in the amount of $50,000 in

order to perform much needed repairs to the building and library; and

WHEREAS, on January 9, 2006, the Grant Agreement between the Agency and the
19
Grantee was executed by the Interim Executive Director of the Agency; 'and
20
WHEREAS, subsequent detailed evaluation of the buildings have revealed that the true
21
cost ofthe rehabilitation is in the amount of$125,500; and
22
WHEREAS, it is appropriate for the Commission to approve Amendment No. I to the
23
Grant Agreement between the Agency and the Grantee (the "Amendment").

NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION OF THE
CITY OF SAN BERNARDINO DOES HEREBY RESOLVE, DETERMINE AND ORDER, AS
FOLLOWS:

Section 1.
The Commission hereby approves the attached Amendment No. 1 in the
form presented at the meeting at which this Resolution is adopted. The Executive Director of the

AMENDMENT NO.1
TO THE 2006 REHABILITATION GRANT AGREEMENT
(San Bernardino Historical and Pioneer Society)
THIS 2006 AMENDMENT NO. I TO THE JANUARY 9, 2006 REHABILITATION
GRANT AGREEMENT (this "Amendment") is dated as of August 7. 2006. by and between the
San Bernardino Historical and Pioneer Society, a California non-profit corporation (the
"Grantee") and the Redevelopment Agency of the City of San Bernardino, a public body,
corporate and politic (the "Agency") and is entered into in light of the facts set forth in the
following Recital paragraphs:
- RECITALS -
A. The Grantee and the Agency have previously entered into an agreement entitled
"The Rehabilitation Grant Agreement", dated January 9, 2006 (the "Agreement").
B. As ofthe effective date of this Amendment, the Grantee has, in collaboration with
Agency Staff, undertaken an in-depth evaluation of the actual condition of the historical Heritage
House and the Heritage House Library ("Buildings") and have discovered unforeseen
circumstances that must be mitigated, and the parties have ascertained that the actual costs of the
necessary repairs to the Buildings are $125,500 and not $50,000 as originally estimated from the
preliminary evaluation.
C. The Grantee and the Agency believe it is appropriate to consider and approve this
Amendment in order that the Grantee may complete the improvements ("Project"), as this term is
defined in the Agreement, by replacing the roof on both of the Buildings with a new fire
retardant roof, remove all lead from the exterior of the Buildings and paint all exterior walls and
surfaces to prevent further damage to the Buildings and in order to protect the historical
collections contained within the Buildings.
NOW, THEREFORE, THE GRANTEE AND THE AGENCY DOES HEREBY AGREE
AS FOLLOWS:
Section 1.
The Grantee and the Agency hereby acknowledge and agree as follows:
(i) notwithstanding any term of the Agreement to the contrary, Section 2 (a) Agency
Grant; Consideration for Grant, of the Agreement shall be amended to include the
language "not to exceed a maximum of $125,500 from the Agency" which shall
replace the language "not to exceed a maximum of $50,000" from the Agency.
(ii) any further reference to $50,000 in the entire Agreement shall be replaced with
$125,500.

Section 2. Concurrently, with the consideration and approval by the Agency of this
Amendment to the Agreement, the Grantee and Agency Staff have prepared the following
revised Line Item Budget for the Project, which replaces and eliminates Exhibit "A" of the
Agreement.
Scope of Work
Remove and dispose of existing roofing to the house
and carriage house, replace fire retardant shingle to
code; scrape, prepare and mitigate lead based paint
conditions to the historical house; scrape and prepare
carriage house; repaint both structures in three color
combinations; payments for hazard and construction
insurance premiums, etc.
Amount
$125,500.00
Section 3. Except as modified or amended by this Amendment, all of the provisions
of the Agreement shall remain in full force and effect following the Effective Date of this
Amendment.

Redevelopment Agency of the City of San Bernardino executed this Amendment as of the dates
