Recommended Motion: 1. Adopt resolution. 2. Authorize the Director of Finance to amend the FY 2003-04 Adopted Budget and transfer $54,944 from the General Government budget (001-092-5011) to the Police Department budget (various personnel line items). CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report Subiect: Resolution of the City of San Bernardino approving a side letter amending Resolution No. 2001- 94, implementing the compensation and benefits plan between the City of San Bernardino and the San Bernardino Confidential/Management and Unclassified Employees for Police Management. Back!!round: Per Resolution No. 2002-104, approved by the Mayor and Common Council adopting a side letter to Resolution No. 2001-94, for Police Safety Management employees, amending Section I, PERS, adding language which states: "If the City enters into nel!otiations with the POA pertaininl! to the 3% @ 50 PERS retirement benefit. or anv other PERS retirement issues. the Citv al!rees to discuss similar issues with the Police Safety Maoal!ement members." On September 2, 2003, the Mayor and Common Council approved a new Memorandum of Understanding between the City of San Bernardino and employees in the Police Safety Employees' bargaining unit represented by the San Bernardino Police Officers' Association (SBPOA), which provided for the establishment of a tax-qualified defined benefit plan to provide supplemental retirement benefits based on the difference between CalPERS' 3% @ 55 Plan and 3% @ 50 Plan. In accordance with the side letter, the City entered into discussions with the Police Safety Management representatives and subsequently reached agreement to provide them the same supplemental retirement benefit. This is a "me, too" benefit. Financial Impact: PARS has estimated the cost for the benefit at this time is $549,442. This figure is based on costing this supplemental retirement benefit for three (3) Police management employees who will be eligible to retire in the next three years. The City will be required to make five annual contribution payments to fund the benefit, which is estimated to be $109,888 for five years. Only one-half of the annual payment ($54,944) will be payable in FY 2003/2004. As additional employees retire, the City's costs for this plan will increase. Recommendation: 1. Adopt resolution. 2. Authorize the Director of Finance to amend the FY 2003-04 Adopted Budget and transfer $54,944 from the General Government budget (001-092-5011) to the Police Department budget (various personnel line items). SIDE LEITER TO RESOLUTION NO. 2001-94 FOR POLICE SAFETY MANAGEMENT EMPLOYEES The following sets forth the side letter to Resolution No. 2001-94, for full-time, regular active Management and Confidential and Unclassified Employees. This side letter amends language to Section I, PERS, Safety Employees, Subsection 5, of the Management and Confidential Employee Compensation and Benefits Plan. I. PERS Safetv Emplovees: (Amend) 5. Effective as soon as possible following adoption of this side letter, the City will establish a tax-qualified defined benefit plan to provide supplemental retirement benefits based on the difference between CaIPERS' 3% @ 55 Plan and 3% @ 50 Plan for Police Safety Management employees with 20 or more years of service effective January I, 2004. This side letter shall be in effect until December 31, 2005. Until that time, the costs associated with this plan will be paid by the City. Police Safety Management employees' share of ongoing costs after December 31, 2005, will be subject to future discussions.
