SUBJECT:
Public hearing - 4:00 p.m., and Resolution Ordering Work - San Bernardino International
Airport/Alliance-California area Landscape and Lighting Maintenance Assessment District AD
1022, Zones 1,2 and 3.
BACKGROUND:
On July 17, 1996, the Inland Valley Development Agency (IVDA) Board requested the City,
through the office of the Director of Public Works, to initiate proceedings for the establishment
of a Landscape Lighting Maintenance Assessment District within a major portion of the former
Norton Air Force Base property, now known as San Bernardino International Airport (SBIA) and
Alliance-California.
On April 7, 1997, authorization was given for the formation of the proposed assessment district.
Due to the dynamic changes occurring at this site over the years, no master plan had been
formed regarding the assessment district and what was to be maintained and what the district
boundaries should be until recently. The IVDA had hired an Assessment Engineering firm
(David Evans and Associates) to complete the Engineer's Report and mapping that was required
to bring this project to completion.
Currently, the IVDA, the City, and the property owners are maintaining the landscape areas. The
formation of the district will relieve the IVDA and the City of these costs and assess them to the
properties receiving the benefit. Landscaping along arterial and collector streets are deemed to
have some general benefit, which cannot be assessed to the property owners and will need to be
paid from the general fund. Additionally, as required by law, any City owned property that is
receiving benefit from the maintenance will be assessed. The total cost to the City is listed
below.
Due to the large area, the assessment district has been divided into three separate zones, and
parcels in each zone will be assessed for the benefit received by the maintenance in its respective
zone. The assessments will cover the costs of street lighting and the maintenance of landscaping
along the major streets within the airport area. Specifically, the streets are 3rd Street, Harry
Sheppard Boulevard, Rialto Avenue, Mill Street, Central Avenue, Del Rosa Avenue, Palm
Meadows Drive, Lena Road, Tippecanoe Avenue and Leland Norton Way. Additionally, the
maintenance of Timber Creek drainage channel, which is owned by the City of San Bernardino
will be included in the proposed assessment district.
The assessment for each zone will be spread across the parcels in proportion of the area (land
only) of each parcel to the total area of parcels within the zone. Some of the areas are proposed
to be maintained by the adjacent property owners and/or businesses through a Default
Assessment Agreement. Property owners will still be assessed for maintenance of the common
areas and street lighting costs. Properties qualifying for a default agreement must either be 2.5
acres or larger in size, or have a front footage of 400 feet or more. The limits were established to
assure a more uniform maintenance schedule and appearance across the smaller parcels. Table A

shows the various assessment amounts for each parcel within each zone with Default Assessment
Agreements in place. The total for each zone has been estimated to be $ 62,863.90 for Zone I,
$35,119.11 for Zone 2 and $27,959.71 for Zone 3, as shown in summary in Table A-8 of the
Engineer's Report.
Table B shows the maximum assessment amount assuming no Default Assessment Agreements
have been executed, and development in the area fully built out. The estimated costs of
maintenance for the first year under this scenario is $209,807.36 for Zone 1, $140,660.92 for
Zone 2, and $93,336.89 for Zone 3, as shown in summary in Table B-8 of the Engineer's
Report.
As required by law, the maintenance costs for areas or portions of areas determined to also have
a general benefit cannot be assessed to the district and must be funded from some other source,
such as the general fund. The Engineer's Report gives details as to the percentages and amounts
determined to be general benefit. In summary, the amounts are $9,905.60 for Zone 1; $3,786.31
for Zone 2; and $3,143.33 for Zone 3 for the proposed first year's costs. The total for all three
Zones is $16,835.24. The estimated general benefit amounts on full build-out and development
are $32,927.40 for Zone I; $16,917.47 for Zone 2; and $10,269.09 for Zone 3, a total of
$60,113.96 for all three Zones.
Proposition 218 requires that any publicly owned parcels be assessed if they receive any benefit.
The IVDA owned parcels will be assessed, as will City or other publicly owned parcels. There is
one City owned parcel that would be subject to assessment, shown as Assessment No. lion the
Diagram map. The initial assessment on this parcel will be $4,960.97.
The City's total portion of the maintenance costs, including the City owned parcel together with
the general benefit amount will be $21.796.21 for the first year and $65,074.93 for ultimate
build-out. Since the District is within the IVDA redevelopment area, they have indicated that
they would be open to discussing the assumption of all of, or a portion of, the City's costs of the
full build-out amount, sometime in the future.
On April 3, 2006, authorization to proceed was given and a resolution of intention was adopted
preliminarily approving the Engineer's Report and setting a public meeting for May 15, 2006
and a public hearing for June 5, 2006. All owners of record or as otherwise known were given
notice of the meeting and hearing by mail, along with an Assessment Ballot.
On May 15, 2006, a public meeting was held and the item continued to the public hearing on
June 5, 2006. The public hearing was continued to June 19, 2006, due to new ballots being
mailed and to allow sufficient time for property owners to respond. The new ballots were
needed because the original ballots showed incorrect amounts. At the conclusion of the public
hearing on June 19, 2006, the results of the assessment ballots will be determined. If ballots
representing more than 50% of the total assessment amount are submitted in opposition to the
assessment district, proceedings for the formation will have to be terminated. It is anticipated
property owners of the larger developments (and thus larger assessments) will elect to execute a

Default Agreement, a majority opposition to the formation of the district is not anticipated. The
Default Agreements are being submitted under as a separate item, and will need to be considered
prior to the adoption of the resolution creating the assessment district,
FINANCIAL IMPACT:
Applicant has paid the $6,000 processing fee and all subsequent work carried out in the district
will be assessed back to property owners, with the exception of $21,796.21 determined to be
general benefit and City obligation for the first year ($65,074.93 at ultimate build-out). This
amount will need to be funded from the general fund or other non-district funding source.
RECOMMENDATION:
Staff recommends that the public hearing be closed and the resolution be adopted.

DETERMINING THE EXISTENCE OF LESS THAN A MAJORITY PROTEST, THAT
BALLOTS SUBMITTED IN FAVOR OF THE ASSESSMENT EXCEED THE BALLOTS
SUBMITTED IN OPPOSITION TO THE ASSESSMENT AND THAT THE PUBLIC
CONVENIENCE AND NECESSITY REQUIRE THE MAINTENANCE OF
LANDSCAPING IN SAN BERNARDINO INTERNATIONAL AIRPORT/ALLIANCE-
CALIFORNIA AREA, GENERALLY NORTH OF CENTRAL A VENUE, EAST OF LENA
ROAD AND SOUTH OF 3RD STREET, APPROVING THE FINAL ENGINEER'S
REPORT, CREATING AN ASSESSMENT DISTRICT TO COVER THE COSTS OF SAID
MAINTENANCE, KNOWN AS ASSESSMENT DISTRICT NO. 1022, ZONE 1, ZONE 2,
AND ZONE 3, ORDERING THE WORK, CONFIRMING THE 2006-2007 ASSESSMENT
ROLL, AND DETERMINING THAT THE SPECIAL ASSESSMENT INVESTIGATION,
LIMITATION AND MAJORITY PROTEST ACT OF 1931 SHALL NOT APPLY.
WHEREAS, pursuant to Chapter 12.90 of the San Bernardino Municipal Code, the Mayor
and Common Council of the City of San Bernardino have preliminarily found that the public
interest, convenience. and necessity require the maintenance of landscaping in a portion of the City,
as more fully hereinatler described. and the appurtenances and appurtenant work and incidental
costs and expenses in connection therewith, that the project is feasible, and that the lands to be
assessed will be able to carry the burden of the proposed assessments to pay the costs and expenses
thereof: and
WHEREAS; on April 3, 2006, the Mayor and Common Council of the City of San
Bernardino preliminarily approved the Engineer's Report relative to the formation of Assessment
District No. 1022. Zone 1. Zone 2, and Zone 3. which is on file in the office of the City Clerk, and

adopted Resolution No. 2006-91 entitled:

which said resolution duly and legally was published and notice given ofa Public Meeting and a
Public Hearing in the manner required by law, and pursuant to Section 4 of Article XIlID of the
California Constitution, all property owners given notice were also given an Assessment Ballot to
indicate support or opposition to the proposed assessment, and written objections and protests, if
any, to the formation of the proposed district, the work to be done or the extent of the district to be
assessed were heard and considered; and
WHEREAS, a Diagram of the Assessment District has been prepared and is on file in the
office of the City Clerk: and
WHEREAS, an Assessment Roll has been prepared totaling $62,863.90 for Zone 1,
$35,119.11 for Zone 2, and $27,959.71 for Zone 3, which sets forth the individual assessments
to be levied on each of the parcels of land within Assessment District No. 1022, Zone I, Zone 2,
and Zone 3, for the fiscal year 2006-2007, as set forth in the Engineer's Report, as revised and now
submitted, on file in the oflice of the City Clerk.
WHEREAS, the City's annual collection of said individual assessments may be reduced
by the execution and implementation of a Default Assessment Agreement between the City of San
Bernardino and property owners of certain parcels within the boundaries of the Assessment
District as set forth in said Engineer's Report, but may be collected up to the maximum amount

as set forth therein, in the absence of a Default Assessment Agreement, without further notice or
hearing.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That a Public Meeting having been held on May IS, 2006, and a Public
Hearing having been held on June S, 19, July 10 and 24, 2006. the Mayor and Common Council,
having heard and considered any and all comments received thereon and being fully advised in the
premises, hereby determine that any and all protests received represent less than a Majority Protest,
as represcnted by the assessment units assessable on the properties represented by said protests.
SECTION 2. That ballots having been received and considered, it is hereby determined
that the ballots submitted in favor of the assessment exceed the ballots submitted in opposition to
the assessment.
SECTION 3. That it is hereby determined that all properties, parcels and lots within the
boundaries of the Assessment District receive a local and direct benefit for the works of
improvement as proposed for said Assessment District, except for portions determined to be of a
general benctit as set forth in said Engineer's Report, and it is hereby further determined and
declared that all assessable costs and expenses have been apportioned and spread over the
properties within the boundaries of the Assessment District in direct proportion to the benefits
received thereby.
SECTION 4. That the public convenience and necessity require the proposed maintenance
and the Mayor and Common Council hereby order. by an affirmative vote of not less than 4/Sths

of its members voting thereon, the formation of Assessment District No. 1022, Zone I, Zone 2,
and Zone 3, along with the work and appurtenances described in said Resolution No. 2006-91 and
said Engineer's Report as herein approved and that the Special Assessment Investigation,
Limitation and Majority Protest Act of 1931 shall not apply.
SECTION 5. That the Engineer's Report relative to the formation of Assessment District
No. 1022, Zone I. Zone 2 and Zone 3, as now submitted, together with a Diagram of the
Assessment District, both on file in the office of the City Clerk, are hereby accepted and approved
and that said Engineer's Report shall stand as the Report for all future proceedings for this
Assessment District.

SECTION 6. That the Mayor and Common Council do hereby find and determine that the

proportionate costs to be levied against the parcels of land within Assessment District No. 1022,
Zone I, Zone 2 and Zone 3, are correctly set forth on Assessment Roll No. 1022, Zone I, Zone
2 and Zone 3 for the fiscal year 2006-2007, as set forth in said Engineer's Report, as now approved,
and on file in the oflice of the City Clerk of the City of San Bernardino, and do hereby confirm said
assessments.
SECTION 7. The City Clerk is hereby directed and authorized to publish a Notice Inviting
Bids for performing the work ordered, in the San Bernardino County Sun, a newspaper published
and circulated in said City. according to the specifications prepared or as will be prepared by the
City Engineer and on file or to be filed in the office of the City Engineer, at such time when the
installation of the landscaping and appurtenances has been accepted by the City. The contract will

be awarded pursuant to standards used by the City in the award of Public Works contracts.
SECTION 8. It is hereby determined that the formation of the assessment district is
categorically exempt from the requirements of the California Environmental Quality Act (CEQA),
pursuant to Class 1, Section 15301(c).
SECTION 9. Reference hereby is made to said Resolution No. 2006-91 and said
Engineer's Report for a description of the work, the extent of the assessment district, the financing
alternatives and for further particulars.
SECTION 10. That the City Clerk is directed to cause a copy of this Resolution to be
transmitted to the office of the Auditor-Controller for the County of San Bernardino with the
request that the individual asscssments as shown on Assessment Roll No, 1022, Zone I, Zone 2
and Zone 3, be placed on the subject 2006-2007 property tax bills for collection together with all
other property taxes.

BACKGROUND:
On July 17,1996, the Inland Valley Development Agency (IVDA) Board requested the City,
through the office of the Director of Public Works, to initiate proceedings for the establishment
of a Landscape Lighting Maintenance Assessment District within a major portion of the former
Norton Air Force Base property, now known as San Bernardino International Airport (SBIA) and
Alliance-California.
On April 7,1997, authorization was given for the formation of the proposed assessment district.
Due to the dynamic changes occurring at this site over the years, no master plan had been
formed regarding the assessment district and what was to be maintained and what the district
boundaries should be until recently. The IVDA had hired an Assessment Engineering firm
(David Evans and Associates) to complete the Engineer's Report and mapping that was required
to bring this project to completion.
Currently, the IVDA, the City, and the property owners are maintaining the landscape areas. The
formation of the district will relieve the IVDA and the City of these costs and assess them to the
properties receiving the benefit. Landscaping along arterial and collector streets are deemed to
have some general benefit, which cannot be assessed to the property owners and will need to be
paid from the general fund. Additionally, as required by law, any City owned property that is
receiving benefit frorn the maintenance will be assessed. The total cost to the City is listed
below.
Due to the large area, the assessment district has been divided into three separate zones, and
parcels in each zone will be assessed for the benefit received by the maintenance in its respective
zone. The assessrnents will cover the costs of street lighting and the maintenance of landscaping
along the major streets within the airport area. Specifically, the streets are 3'd Street, Harry
Sheppard Boulevard, Rialto A venue, Mill Street, Central A venue, Del Rosa A venue, Palm
Meadows Drive, Lena Road, Tippecanoe Avenue and Leland Norton Way. Additionally, the
maintenance of Timber Creek drainage channel, which is owned by the City of San Bernardino
will be included in the proposed assessment district.
The assessment for each zone will be spread across the parcels in proportion of the area (land
only) of each parcel to the total area of parcels within the zone, Some of the areas are proposed
to be maintained by the adjacent property owners and/or businesses through a Default
Assessment Agreement. Property owners will still be assessed for maintenance of the common
areas and street lighting costs. Properties qualifying for a default agreement must either be 2.5

acres or larger in size, or have a front footage of 400 feet or more. The limits were established to
assure a more uniform maintenance schedule and appearance across the smaller parcels. Table A
shows the various assessment amounts for each parcel within each zone with Default Assessment
Agreements in place. The total for each zone has been estimated to be $ 62,863.90 for Zone 1,
$35,119.11 for Zone 2 and $27,959,71 for Zone 3, as shown in sWllmary in Table A-8 of the
Engineer's Report.
Table B shows the maximWll assessment amount assuming no Default Assessrnent Agreernents
have been executed, and development in the area fully built out. The estimated costs of
maintenance for the first year under this scenario is $209,807.36 for Zone 1, $140,660,92 for
Zone 2, and $93,336.89 for Zone 3, as shown in sWllmary in Table B-8 of the Engineer's
Report.
As required by law, the maintenance costs for areas or portions of areas determined to also have
a general benefit cannot be assessed to the district and must be funded from some other source,
such as the general fund. The Engineer's Report gives details as to the percentages and amounts
determined to be general benefit. In summary, the amounts are $9,905.60 for Zone 1; $3,786.31
for Zone 2; and $3,143.33 for Zone 3 for the proposed first year's costs. The total for all three
Zones is $16,835.24. The estimated general benefit amounts on full build-out and development
are $32,927.40 for Zone I; $16,917.47 for Zone 2; and $10,269,09 for Zone 3, a total of
$60,113.96 for all three Zones.
Proposition 218 requires that any publicly owned parcels be assessed if they receive any benefit.
The IVDA owned parcels will be assessed, as will City or other publicly owned parcels. There is
one City owned parcel that would be subject to assessment, shown as Assessment No. lion the
Diagram rnap. The initial assessment on this parcel will be $4,960,97.
The City's total portion of the maintenance costs, including the City owned parcel together with
the general benefit amount will be $21,796.21 for the first year and $65,074.93 for ultimate
build-out. Since the District is within the IVDA redevelopment area, they have indicated that
they would be open to discussing the assumption of all of, or a portion of, the City's costs of the
full build-out amount, sometime in the future.
On April 3, 2006, authorization to proceed was given and a resolution of intention was adopted
preliminarily approving the Engineer's Report and setting a public meeting for May 15,2006
and a public hearing for June 5, 2006. All owners of record or as otherwise known were given
notice of the meeting and hearing by mail, along with an Assessment Ballot,
On May 15,2006, a public meeting was held and the item continued to the public hearing, The
assessment amounts showed on the ballots previously mailed were based on the assWllption that
all of the property owners who qualify for a Default Agreement, would execute an agreement
and thus have their assessment lowered. Since not all of property owners may elect to execute an
agreement, and to allow for a higher future assessment in the event of a default under the
agreement, the ballots should have indicated the maximWll assessment without regards to an

to an agreement. New ballots have been prepared and mailed with the corrected amounts. In
order to allow sufficient time for property owners to respond to the new ballots, the hearing will
need to be continued to June 19,2006, and the time allowed to return the ballots extended to that
date. At the conclusion of the public hearing on June 19, 2006, the results of the assessment
ballots will be determined. If ballots representing more than 50% of the total assessment amount
are subrnitted in opposition to the assessment district, proceedings for the formation will have to
be terminated. It is anticipated property owners of the larger developments (and thus larger
assessments) will elect to execute a Default Agreement, a majority opposition to the formation of
the district is not anticipated.
The Engineer's Report has been revised to reflect these changes and a revised Report is attached
and also on file in the office of the City Clerk. The deadline for submitting an executed Default
Agreement is July 31, 2006, in order to allow adjustments to be made in the assessrnent roll,
prior to transmitting to the County Assessor/Tax Collector's deadline of August 10, 2006.
A list of those property owners that have submitted an agreement or proposed to submit an
agreement by the July 31, 2006 deadline will be submitted, along with the form of the
agreement, at the June 19, 2006 Council meeting for your consideration,
FINANCIAL IMP ACT:
Applicant has paid the $6,000 processing fee and all subsequent work carried out in the district
will be assessed back to property owners, with the exception of $21,796.21 determined to be
general benefit and City obligation for the first year ($65,074,93 at ultimate build-out), This
amount will need to be funded from the general fund or other non-district funding source.

PETITION - On July 17, 1996, a petition was received from the Inland Valley Development Agency
("IVDA") regarding the property located within the vicinity of the San Bernardino International Airport area on the
former Norton Air Force Base, including adjacent properties, for the establishment of an assessment district for the
maintenance of landscaping and street lighting along portions of Lena Road, Mill Street, Tippecanoe Avenue, Harry
Sheppard Boulevard, Central Avenue, Del Rosa Drive, Third Street, Rialto Avenue, Palm Meadows Drive and
Leland Norton Way within the City of San Bernardino. Hillwood/San Bernardino, ("Master Developer") has
entered into a Master Disposition and Development Agreement with the IVDA pursuant to which the Master
Developer has committed to cause those properties to be acquired from the IVDA to be included within an
assessment district as intended to be formed as Assessment District No. 1022. Said commitment is applicable for
those properties to be acquired by the Master Developer from the 1VDA in addition to other properties owned by
third parties deemed desirable to be included within Assessment District No.1 022.
AUTHORIZATION - On April 7,1997, by action of the Mayor and Common Council of the City of San
Bernardino, the City Engineer and City Clerk were authorized to initiate proceedings for the formation of
Assessment District No. 1022 (San Bernardino International Airport/Alliance-California Landscape and Lighting
Maintenance Assessment District) pursuant to the provisions of San Bernardino City Municipal Code Chapter
12,90, This Report has been prepared and is hereby submitted pursuant to said provisions and in accordance with
Resolution of Intention No. adopted by the Mayor and Common Council of the City of San
Bernardino on the _ day of , 2006.
ADVANCE OF ESTIMATED COSTS OF PROCEEDINGS- On July 17, 1996, pursuant to Section
12.94.030 of the Municipal Code, the IVDA deposited $6,000,00 with the City to cover the estimated cost of the
proceedings for the formation of the Assessment District. At the conclusion of the proceedings and after
confirmation of all costs, any amounts remaining will be returned to the 1VDA. If the actual costs are more than the
deposit, then the remainder can either be paid in a lump sum by the IVDA or assessed against the properties
involved.
DESCRIPTION OF IMPROVEMENTS - The improvements to be maintained include landscaping, street
lighting, and all appurtenances along portions of Lena Road, Mill Street, Tippecanoe Avenue, Harry Sheppard
Boulevard, Central Avenue, Del Rosa Drive, Third Street, Rialto Avenue, Palm Meadows Drive, and Leland
Norton Way, within the City of San Bernardino. Street lighting shall also include traffic signals and all
appurtenances thereto.
PLANS AND SPECIFICATIONS - Plans and Specifications for the landscaping either have been prepared
or will be prepared at tile time of development by the Master Developer or any other third party property owner
according to the standards of the City and shall be subject to final approval by the City prior to the installation of
any landscaping.

DESCRIPTION OF BOUNDARIES - The boundaries of the proposed district are shown on the
Assessment Diagram of Assessment District No.1 022.
VICINITY MAP - A vicinity map showing the general location of the proposed Assessment District is
attached as Exhibit" I",
DISTRICT BOUNDARY MAP - A proposed District Boundary Map has been approved and is on file in
the office of the City Clerk. A reduced copy of the District Boundary Map is attached as Exhibit "2" and includes an
area of approximately 515 acres located both on the former Norton Air Force Base and in the vicinity thereof.
DISTRICT DIAGRAM - A proposed Diagram of the Assessment District has been prepared and will be
filed with the City Clerk after preliminary approval of this Report and will be filed with the County Recorder and
recorded in the office of the City Engineer after final approval of this Report, confirmation of the Assessment Roll
and adoption of the Resolution Ordering Work. A reduced copy of the Assessment District Diagram is attached as
Exhibit "3".
NOTICE OF EXEMPTION - A "Notice of Exemption" declaring a Statutory Exemption pursuant to the
California Environmental Quality Act of 1970, as amended, was prepared and will be filed with the Clerk of the
Board of Supervisors of San Bernardino County upon formation of the Assessment District. No further
environmental proceedings will be necessary in connection with the formation or the undertaking of activities of the
Assessment District. A copy of the Notice of Exemption is attached as Exhibit "4".
PARTIAL EXEMPTION FROM ASSESSMENT - Any property owner may petition the City of San
Bernardino at any time for a partial exemption of a property from Assessment District No. 1022 provided that such
property owner commits to maintain adjacent landscaping in accordance with applicable City standards and pay the
other annual costs associated with the Assessment District No. 1022 in accordance with the Method of Assessment
and executes a Default Assessment Agreement. Each Default Assessment Agreement shall be effective from and
after the next succeeding fiscal year for which the City of San Bernardino is then able to implement the provisions
of such Default Assessment Agreement and to modify the assessment amount that would be payable annually
thereafter with respect to such property; however, for the first year, the Agreements may be submitted to and
accepted by the City, up to the date of July 31,2006 to be effective for the first year's assessments, Said exemption
will be at the sole discretion of the City of San Bernardino and will be evidenced by a Default Assessment
Agreement with property owners setting forth duties and obligations of said property owners to maintain certain
landscape areas. Said property owners will remain obligated to pay annual assessments with respect to street
lighting and electricity costs and certain common area landscape maintenance.
METHOD OF ASSESSMENT AND DETERMINATION OF BENEFIT - Landscaping and street
lighting and its proper maintenance enhances the aesthetics of any given area, The benefit received by the owners
of properties in the area varies depending upon which zone the property is located. The Assessment District is
divided into three zones. The location and boundaries of the three zones are shown on the Assessment Boundary
map of Assessment District No, 1022. The San Bernardino International Airport provides a special benefit to all
three zones. Thus all three zones shall share a portion of the maintenance cost for improvements located on such
Airport properties. Timber Creek provides a special benefit to Zone 1 and Zone 2 but provides no benefit to Zone 3.
The maintenance cost for Timber Creek shall be shared proportionally by area between Zone 1 and Zone 2 whereas
Zone 3 shall not participate in any of the maintenance costs for Timber Creek.
The benefit received by the parcels within the boundaries of the Assessment District is determined to be of
more than ordinary public benefit, thus each parcel within the Assessment District being assessed receives a special
benefit from the improvements. If property not within the boundaries of an assessment district also receives some

benefit from the improvements, consideration must then be given to a general benefit conferred by the
improvements, which may not be assessed to the parcels within the Assessment District. The installation and
maintenance of the landscaping and lighting and establishment of an assessment district for the maintenance of the
landscaping and lighting is specific and incidental to the redevelopment of the former Norton Air Force Base and
the adjacent properties in proximity thereto wherein the majority of the landscape improvements are intended to be
located. It is further determined that the landscape improvements to be maintained by the Assessment District are
of special benefit to the Assessment District only and are thus 100% assessable to the parcels within the boundaries
of the Assessment District, except as follows:
1. Areas of maintenance that front on maior arterial streets, as determined by the Circulation Plan of the
City's General Plan, are determined to be 15% general benefit and the proportional costs thereof are
not assessable to the Assessment District.
2. Areas of maintenance that front on secondary arterial streets, as determined by the Circulation Plan of
the City's General Plan, are determined to be 10% general benefit and the proportional costs thereof
are not assessable to the Assessment District.
3. Areas of maintenance that front on collector streets, as determined by the Circulation Plan of the City's
General Plan, are determined to be 5% general benefit and the proportional costs thereof are not
assessable to the Assessment District.
4, Areas that front on local streets are determined to be 100% special benefit (i.e., 0% general benefit)
and are 100% assessable to the Assessment District.
These percentages are based on the traffic circulation for the various street classifications contained within the
boundaries of the Assessment District.
Tippecanoe A venue, Third Street, and Del Rosa Drive between Harry Sheppard Boulevard and Third Street
are classified as major arterial streets. Lena Road, Mill Street, and Harry Sheppard Boulevard between Tippecanoe
Avenue and Del Rosa Drive are classified as secondary arterial streets, Ria1to Avenue, Mountain View. Avenue,
Leland Norton Way, Harry Sheppard Boulevard between Del Rosa Drive and Leland Norton Way are classified as
collector streets.
Within Zone 1 the major arterial streets comprise 75.6%, the secondary arterial streets comprise 19.7%, and the
collector streets comprise 4.7% of the total areas of maintenance. Pursuant to the above determination of benefit,
15% of 75.6% plus 10% of 19,7% plus 5% of 4.7% of the total cost of maintenance will not be assessed to the
District.
Within Zone 2 the major arterial streets comprise 21.3%, the secondary arterial streets comprise 78.7%, and the
collector streets comprise 0.0% of the total areas of maintenance, Pursuant to the above determination of benefit,
15% of21.3% plus 10% of78.7% of the total cost of maintenance will not be assessed to the District.
Within Zone 3 the major arterial streets comprise 35.9%, the secondary arterial streets comprise 30.8%, and the
collector streets comprise 33.3% of the total areas of maintenance. Pursuant to the above determination of benefit,
15% of 35.9% plus 10% of30.8% plus 5% of33.3% of the total cost of maintenance will not be assessed to the
District.

The net first vear's cost assessable to the Assessment District, assuming all qualifying property owners have
executed a Default Assessment Agreement which has been accepted by the City, is shown in Table "A" with
respect to each parcel of property as listed by Zone within the Assessment District.
The net maximum cost assessable to the Assessment District, assuming no Default Assessment Agreements have
been executed, and assuming full development of the District, is shown in Table "B" with respect to each parcel of
property as listed by Zone within the Assessment District.
METHOD OF FINANCING - The estimated cost of the first year's maintenance shall be assessed against
the properties involved within the current fiscal year or the fiscal year following the establishment of the
Assessment District. Depending upon when the costs are assessed and when the actual maintenance is assumed by
the City, this assessed amount can be used as a source of pre-funding the first year's maintenance contract and
incidental costs. After the date that the City has assumed the responsibility for the maintenance, the properties may
be assessed in advance each year thereafter to establish a source of pre-funding each year's costs, or may be
assessed for the actual contract and incidental costs plus interest. Interest will be included in the assessment costs
for any amounts or portions not pre-funded through previous assessments, and any such surplus shall be applied as a
credit to the following year's assessment or placed in a reserve fund to cover future increases or maintenance until
such reserves are depleted. The assessment, whether pre-funded or not, shall be levied, collected and enforced in
the same manner, at the same time, and with the same penalties and interest as in the case of taxes levied for
property taxes. Tables I through 4, inclusive, as attached to Table "A" set forth the estimated costs of the first
years' maintenance by Zone in addition to the costs of maintenance of Timber Creek for the first year. No Bonds
will be sold relative to this Assessment District to finance any costs related to the construction or installation
of improvements.
ASSESSMENT SPREAD - The amount of each Assessment Unit is determined by the following formulas
as set forth below. The following formulas are applicable to the costs of Timber Creek, electricity costs for street
lighting and common area landscape maintenance; a separate formula is set forth in Part II which shall be applied
for all properties within each Zone for which there is not then in effect a Default Assessment Agreement for the
payment and undertaking by the applicable property owner of the adjacent landscaping maintenance costs. The
City shall also add the annual administrative costs actually incurred for any third party consultants and other costs
incurred by the City in the Administration of the Assessment District as set forth in Part III below which
administrative costs shall be spread equally among all proprieties within the District on an acreage basis in addition
to the dollar figures derived from the formulas set forth in Part I and Part II for Timber Creek, electricity and
landscape maintenance costs.
Part 1- Applicable to All Properties within the Assessment District:

total area within each respective zone or combination of zones as follows:

Area 1 is the summation of the areas of the participating parcels within Zone 1

Part 11- Applicable to Properties withont a Default Assessment Agreement:
Within each Zone of the Assessment District the City shall undertake a separate accounting and calculation
to be maintained as to those properties which then have a Default Assessment Agreement in effect. On a Zone by
Zone basis within the Assessment District, the dollar amount of the City incurred costs for the maintenance of
adjacent landscaping, exclusive of common area landscaping at intersections and median strips and other monument
sign areas, shall be calculated and spread on an acreage basis against all properties within each Zone that do not
then have a Default Assessment Agreement in effect. Such amount as calculated pursuant to this Part II shall then
be added to the amount calculated for all properties pursuant to Part 1 above but placed on the tax bill only for those
properties that do not have a Default Assessment Agreement then in effect. Only properties having either a
minimum street frontage of 400 feet or a minimum area of 2,25 acres are eligible to petition the City for a Default
Assessment Agreement. The Part II formula is set forth below:
Zone 1. Zone 2 and Zone 3 Owners:

Part III - City Administrative Costs Applicable to all Zones:
The City shall include with the amount to be assessed each year against all properties within the
Assessment District the actual third party consultant costs required for the annual administration of the Assessment
District. Such costs shall relate to the calculations of the annual assessment, determinations of the costs of the
maintenance activities to be undertaken, addressing and resolving any issues as to the interpretation or the effect of
the Assessment District upon any property, and any costs incurred for the annual report to be submitted to the
Mayor and Common Council for approval and transmittal to the County of San Bernardino.
ASSESSMENT ROLL - Currently, there are 11 parcels comprising approximately 515 acres within the
boundaries of Assessment Boundary Map of Assessment District No, 1022, The amount assessed is determined as
described under Method of Assessment, and assessments are spread accordingly. Further subdivision of the parcels
is anticipated. Future parcels will be added to the assessment roll and will be subject to all conditions and
obligations of Assessment District No, 1022. As stated above, the net first vear's cost assessable to the Assessment
District, assuming ail qualifying property owners have executed a Default Assessment Agreement which has been
accepted by the City, is shown in Table "A" with respect to each parcel of property as listed by Zone within the
Assessment District. As also stated above, the net maximum cost assessable to the Assessment District, assuming

no Default Assessment Agreements have been executed, and assuming full development of the District, is shown in
Table "B" with respect to each parcel of property as listed by Zone within the Assessment District and represents
the 2006/2006 Assessment Roll. The actual assessments levied and collected on each individual parcel may be
reduced if the property owner has submitted an executed Default Assessment Agreement, and if said Agreement has
been accepted by the City of San Bernardino as set forth herein,
COLLECTION OF DELINQUENT ASSESSMENTS - In the event any property owner within the
Assessment District should fail to pay any property tax bill of the County of San Bernardino which includes a
payment to the Assessment District, the City shall be entitled to seek judicial relief through a foreclosure proceeding
filed with the Superior Court for the payment of such delinquent assessment plus penalties and interest. All
assessment payments that are not made on or before the applicable payment date as required by either the City of
San Bernardino or the County of San Bernardino, shall bear penalties and interest at the maximum rate allowed
under California law until paid in full. The property that is then delinquent in payment of any assessment payments
with respect to the Assessment District shall additionally be assessed and shall be required to pay all costs incurred
by the City, including legal, City staff, City Attorney and other consultant costs, in determining the amount of the
delinquency and in all collection and enforcement efforts.
FUTURE APPORTIONMENTS - In the event that the assessment units, as determined under Method of
Assessment, change for any parcel or parcels during the term of the existence of the Assessment District, the
assessment amount for that parcel or parcels will change accordingly. Any increases based solely on change in
parcel size, land use or density, which would result in an increase of assessment units, will not be subject to a public
hearing provided that the formula for determining the assessments as described is applied. Pursuant to Chapter
12.90 of the San Bernardino Municipal Code, and provided further that such reapportionments do not require the
recording of an amended Diagram Map.
FUTURE INCREASES - Due to the nature of landscape and lighting maintenance, it is anticipated that
there will be future increases in assessments as contract services, labor, water and energy costs are all subject to
future increases. Annual increases may be implemented without further notice or public hearing by a percentage
equal to the increase in the Consumer Price Index (CP1) for all Urban Consumers in the Los Angeles-Orange
County-Inland Empire area, published by the United States Department of Labor, Bureau of Labor Statistics over
the previous year, or 5% whichever is less. The CP1 is typically used for assessment maintenance districts. The
rate varies from year to year, but in no event will an increase, if needed, exceed 5% without a majority approval of
the property owners within the Assessment District. The maximum assessments allowed as set forth in Table "B"
may also be increased by the CPJ or 5% as set forth herein.
FUTURE IMPROVEMENTS - It is anticipated that the area within Assessment District No. 1022 will
undergo substantial landscape improvements and construction and installation of additional landscape
improvements and street lighting, including but not limited to, right-of-way landscaping, monument areas and
future medians. The District Diagram designates the ultimate build-out of these landscape improvements as
"AREAS OF MAINTENANCE - COMMON AREA". It is also anticipated that some of the existing roadways will
be upgraded with either additional landscaped areas or upgrades to existing right-of-way landscaping. When new
public streets are constructed or existing streets are upgraded, said improvements will also include either additional
streetlights or upgrading of the existing streetlights. The maintenance costs of all such future improvements will be
automatically included in the Assessment Roll as of the time as they are incurred. These costs are excluded from the
5% maximum increase limit as described under Future Increases.

DETERMINING THE EXISTENCE OF LESS THAN A MAJORITY PROTEST, THAT
BALLOTS SUBMITTED IN FAVOR OF THE ASSESSMENT EXCEED THE BALLOTS
SUBMITTED IN OPPOSITION TO THE ASSESSMENT AND THAT THE PUBLIC
CONVENIENCE AND NECESSITY REQUIRE THE MAINTENANCE OF
LANDSCAPING IN SAN BERNARDINO INTERNATIONAL AIRPORT/ALLIANCE-
CALIFORNIA AREA, GENERALLY NORTH OF CENTRAL AVENUE, EAST OF LENA
ROAD AND SOUTH OF 3RD STREET, APPROVING THE FINAL ENGINEER'S
REPORT, CREATING AN ASSESSMENT DISTRICT TO COVER THE COSTS OF SAID
MAINTENANCE, KNOWN AS ASSESSMENT DISTRICT NO. 1022, ZONE 1, ZONE 2,
AND ZONE 3, ORDERING THE WORK, CONFIRMING THE 2006-2007 ASSESSMENT
ROLL, AND DETERMINING THAT THE SPECIAL ASSESSMENT INVESTIGATION,
LIMITATION AND MAJORITY PROTEST ACT OF 1931 SHALL NOT APPLY.
WHEREAS, pursuant to Chapter 12.90 of the San Bernardino Municipal Code, the Mayor
and Common Council of the City of San Bernardino have preliminarily found that the public
interest, convenience, and necessity require the maintenance of landscaping in a portion of the City,
as rnore fully hereinafter described, and the appurtenances and appurtenant work and incidental
costs and expenses in connection therewith, that the project is feasible, and that the lands to be
assessed will be able to carry the burden of the proposed assessments to pay the costs and expenses
thereo f; and
WHEREAS, on April 3, 2006, the Mayor and Cornmon Council of the City of San
Bernardino preliminarily approved the Engineer's Report relative to the formation of Assessrnent
District No. 1022, Zone 1, Zone 2, and Zone 3, which is on file in the office of the City Clerk, and
adopted Resolution No. 2006-91 entitled:

APPROVING THE ENGINEER'S REPORT AND GIVING NOTICE OF A PUBLIC
MEETING AND PUBLIC HEARING."
which said resolution duly and legally was published and notice given of a Public Meeting and a
Public Hearing in the manner required by law, and pursuant to Section 4 of Article xmD of the
California Constitution, all property owners given notice were also given an Assessment Ballot to
indicate support or opposition to the proposed assessment, and written objections and protests, if
any, to the formation of the proposed district, the work to be done or the extent of the district to be
assessed were heard and considered; and
WHEREAS, a Diagrarn of the Assessment District has been prepared and is on file in the
office of the City Clerk; and
WHEREAS, an Assessment Roll has been prepared totaling $209,807.36 for Zone 1,
$105,942.55 for Zone 2, and $93.336.89 for Zone 3. which sets forth the individual assessments
to be levied on each of the parcels of land within Assessment District NO.1 022, Zone 1, Zone 2,
and Zone 3, for the fiscal year 2006-2007, as set forth in the Engineer's Report, as revised and now
submitted, on file in the office of the City Clerk.
WHEREAS, said individual assessments may be reduced by the execution and
implementation of a Default Assessment Agreement between the City of San Bernardino and
property owners of certain parcels within the boundaries of the Assessment District as set forth in
said Engineer's Report, but may be imposed up to the maximum amount as set forth therein, in

the absence of a Default Assessment Agreement, without further notice or hearing.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That a Public Meeting having been held on May 15, 2006, and a Public
Hearing having been held on June 5, 2006, and continued to June 19,2006, the Mayor and
Common Council, having heard and considered any and all cornments received thereon and being
fully advised in the premises, hereby determine that any and all protests received represent less than
a Majority Protest, as represented by the assessment units assessable on the properties represented
by said protests.
SECTION 2. That ballots having been received and considered, it is hereby determined
that the ballots submitted in favor of the assessment exceed the ballots submitted in opposition to
the assessment.
SECTION 3. That it is hereby determined that all properties, parcels and lots within the
boundaries of the Assessment District receive a local and direct benefit for the works of
improvement as proposed for said Assessment District, except for portions determined to be of a
general benefit as set forth in said Engineer's Report, and it is hereby further determined and
declared that all assessable costs and expenses have been apportioned and spread over the
properties within the boundaries of the Assessment District in direct proportion to the benefits
received thereby.
SECTION 4. That the public convenience and necessity require the proposed maintenance
and the Mayor and Common Council hereby order, by an affirmative vote of not less than 4/5ths

of its members voting thereon, the formation of Assessment District No. 1022, Zone 1, Zone 2,
and Zone 3, along with the work and appurtenances described in said Resolution No. 2006-91 and
said Engineer's Report as herein approved and that the Special Assessment Investigation,
Limitation and Majority Protest Act of 1931 shalt not apply.
SECTION 5. That the Engineer's Report relative to the formation of Assessment District
No. 1022, Zone I, Zone 2 and Zone 3, as now submitted, together with a Diagram of the
Assessment District, both on file in the office of the City Clerk, are hereby accepted and approved
and that said Engineer's Report shalt stand as the Report for alt future proceedings for this
Assessment District.
SECTION 6. That the Mayor and Common Council do hereby find and determine that the
proportionate costs to be levied against the parcels of land within Assessment District No. 1022,
Zone 1, Zone 2 and Zone 3, are correctly set forth on Assessment Roll No. 1022, Zone 1, Zone
2 and Zone 3 for the fiscal year 2006-2007, as set forth in said Engineer's Report, as now approved,
and on file in the office of the City Clerk of the City of San Bernardino, and do hereby confirm said
assessments.
SECTION 7. That the individual assessment amounts as set forth in said Engineer's
Report, and as confirmed herein, may be reduced by the City Engineer, upon the execution and
acceptance of a Default Assessment Agreement as set forth herein and as set forth in said
Engineer's Report, by the amount set forth in said Engineer's Report as the maintenance costs for
the adj acent area defined in said Engineer's Report.

SECTION 7. The City Clerk is hereby directed and authorized to publish a Notice Inviting
Bids for performing the work ordered, in the San Bernardino County Sun, a newspaper published
and circulated in said City, according to the specifications prepared or as wilt be prepared by the
City Engineer and on file or to be filed in the office of the City Engineer, at such time when the
instaltation of the landscaping and appurtenances has been accepted by the City. The contract wilt
be awarded pursuant to standards used by the City in the award of Public Works contracts.
SECTION 8. It is hereby determined that the formation of the assessment district is
categoricalty exempt from the requirements ofthe California Environmental Quality Act (CEQA),
pursuant to Class I, Section 15301(c).
SECTION 9. Reference hereby is made to said Resolution No. 2006-91 and said
Engineer's Report for a description of the work, the extent of the assessment district, the financing
alternatives and for further particulars.
SECTION 10. That the City Clerk is directed to cause a copy of this Resolution to be
transmitted to the office of the Auditor-Controlter for the County of San Bernardino with the
request that the individual assessments as shown on the 2006/2007 Assessment Rolt No. 1022,
Zone I, Zone 2 and Zone 3, or as may be adjusted as set forth herein, be placed on the subject
2006-2007 property tax bilts for coltection together with alt other property taxes.
