Synopsis of Previous Council Action:
On August 4, 2003, the Mayor and Common Council adopted Resolutions No. 2003-224
(General Unit), 2003-225 (Middle-Management), 2003-226 (Management-Confidential), 2003-
227 (Fire Safety), 2003-228 (Police Safety), and 2003-229 (Elected Officials), Resolutions of the
City of San Bernardino electing to cease to be subject to the Public Employees' Medical and
Hospital Care Act.

STAFF REPORT
SUBJECT
Resolution electing to discontinue CalPERS contract providing health insurance benefits for City
of San Bernardino Part-Time Elected Officials and Board Members.
BACKGROUND
The attached resolution applies to Part-Time Elected Officials and Board Members and supports
the City's recommendation to exit the CalPERS Health Insurance Benefits Program effective
111104. This action was previously approved at the August 4, 2003 Mayor and Council meeting.
The Mayor and Common Council initially adopted five resolutions, including one for full-time
elected officials and board members. Afterwards, the City was informed by CalPERS that a
resolution for part-time elected officials was inadvertently omitted. The reason for this agenda
item is to include this additional resolution being requested by CaIPERS, specifically identifying
part-time elected officials and board members.

BE SUBJECT TO THE PUBLIC EMPLOYEES' MEDICAL AND HOSPITAL CARE ACT
FOR THE CITY OF SAN BER,'\fARDINO PART-TIME ELECTED OFFICIALS AND
BOARD MEMBERS.

WHEREAS, Government Code Sectioll 22853 provides that a contracting agency whieh
6
has elected to be subject to the Public Employees' Medical and Hospital Care Act (hereinafter
7
"Act") may cease to be so subject by proper application by the contracting agency; and
8
WHEREAS, the City of San Bernardino (hereinafter "Contracting Agency) is a
9
contracting agency under the Act for participation by Part-Time Elected Officials and Board
10
Members.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:

SECTION I. That the Part-Time Elected Officials and Board Members of the

Contracting Agency elect, and the Contracting Agency does hereby elect, to cease to be subject
14
to the provisions of the Act.
15
SECTION 2. That coverage of the Act cease on December 31,2003.
16
SECTION 3. That Title 2, Section 599.515 (e), of the California Administrative Code
17
prohibits the Contracting Agency from filing with the Board of Administration of the Public
18
Employees' Retirement System a new resolution electing to be subject to the Act within two
19
years of tennination date.
