Authorized the Director of Finance to transfer $111,600 from Sewer Line Maintenance Fund
balance to Account No. 132-431-5505-7475 "SW-D Sewer Siphon Flushing at Various
Locations" and transfer $23,400 from Unallocated Sewer Line Maintenance Fund balance to
Account No. 132-431-5505-7567 "SW06-03 "South "E" Street Sewer Siphon Cleaning" and
adopt Resolution.
Recommended Motion:
I. Authorize the Director of Development Services to execute Contract Change Order No. One to the contract
with Downstream Services, Inc. for Cleaning Sewer Siphons at Various Locations in the City of San
Bernardino (SW-D 2005/2006), per Project Plan No. I 1 340B.

Snbject:
Authorize the Director of Development Services to execute Contract Change Order No. One to the contract with
Downstream Services, Inc. for Cleaning Sewer Siphons at Various Locations in the City of San Bernardino
(SW-D 2005/2006), per Project Plan No. 1 I 340B.
Background:
On August I, 2005, the Mayor and Common Council allocated funds, as part of the FY 2005/06 Capital
Improvement Program (CIP) for Cleaning Sewer Siphons at Various Locations in the City of San Bernardino
(SW -D), per Project Plan No. I I 340B.
On October 3, 2005, the Mayor and Common Council approved a resolution to contract Downstream Services,
Inc. for "Cleaning Sewer Siphons at Various Locations in the City of San Bernardino (SW-D 2005/2006)", per
Project Plan No. I 1340B.
Upon cleaning the sewer siphons, it was determined that specific additional tasks, as described in the attached
change order, were necessary to properly clean these siphons.
Item I-I "Increase Length at Waterman and Santa Ana River at Siphon Location No.2." The actual length was
measured at 1,065 feet. The Design Section had estimated the length from available drawings at 666 feet. The
additional 399 feet needed to be cleaned.
Item 1-2 "Increase Length at South "E" Street and Santa Ana River at Siphon Location No.6." The actual
length was measured at 840 feet. The Design Section had estimated the length from the available plans at 717
feet. The additional 123 feet needed to be cleaned.
Item 1-3 "Increase Length at South "E" Street and Santa Ana River (Lorna Linda Siphon) at Siphon Location
No.7." The actual length was measured at 840 feet. The Design Section had estimated the length from the
available plans at 717 feet. The additional 123 feet needed to be cleaned.
Financial Impact:
The total cost of Contract Change Order No. One is $22,398.39. Sufficient contingency funding for this change
order is available in the various project accounts as indicated in Attachment I.
Recommendation:
Authorize the Director of Development Services to execute Contract Change Order No. One to the contract with
Downstream Services, Inc. for Cleaning Sewer Siphons at Various Locations in the City of San Bernardino
(SW-D 2005/2006), per Project Plan No. 11340B.

JUSTIFICATION:

No. 1-1 At siphon location No.2, the actual siphon length was measured at 1,065 feet. The bid
distance was 666 feet. Therefore, an additional 399 feet of sewer main line was cleaned.

Subject Notice of Delay and Request of Change Order for Sites 02,04,06,07.
DearMr. Wolf-
Thank you for your support and the time that has been spent by you and your staffto accomplish this
difficult project to this point. We have successfully cleaned 5 sites that have been approved by you and the
Construction Inspector-Andy Navarro. We have attempted all 7 sites. Please see attached:
These sites include:

. Site 03 Perris Hill Park @ Twin Creek Channel
. Site 04 Tippecanoe Avenue @ Warm Creek Channel (24")

. Site 06 South "E" Street and Santa Ana River
. Site 07 South "E" Street and Santa Ana River (Lorna Linda) (20")
We have some concerns on this project that we feel are justified and need attention. In accordance with the
Contract, page SP-19, Section 6-1.05 EXTRA WORK AND MARKUP, Section 3.3 of the Standard
Specifications, (unknown physical conditions of an unusual nature differing materially from those
ordinarily encountered and generally recognized as inherent work of the character being performed").
Several sites have been determined to meet this condition and are listed below.
The following sites are requiring attention.

o Site 02 Waterman and Santa Ana River 8" and 12" DIP
o Bid distance is 666ft for a contract compensation rate of $23,972.40 = $35.99 ft
o Change Order Condition -Actual distance is I 065ft- difference of 399ft@ $35.99ft =

Friday January 27)
o Distance 340' both pipes, bid price is $ 23.50 per foot per pipe
o Change Order Condition - On the 14" CIP we have spent 2.5 working days attempting to
remove the foreign objects through confined space entries and using various attachments
to our hydro jetting equipment. Construction debris is a reportable item listed in spill
reports to the RQCB. This line does not convey flow, is inoperable, and outside the
intended scope of the contract. We request activating a T&M condition to complete
cleaning of this pipe

o Bid distance is 717ft for contract compensation rate of$44,904.00 ~ $20.87 per foot per
pipe (3 pipes total)
o Change Order 01 Site 07 Condition-actual distance 840' difference of 123ft @(1 pipe
approved only) 20.87fr= $2,567.01 Additional Cost 1 Pipe
Change Order 02 Site 07
On the 16" CIP and 14" CIP we have spent 1.5 working days attempting to penetrate thru
these lines through confined space entries and using various attachments to our hydro jetting
equipment. Pre-existing condition not disclosed under any document or at the pre bid or
construction meeting. Pipes appear to be 100% impacted with foreign objects and debris.
These two lines do not convey flow, are inoperable, and are outside the intended scope of the
contract.
In summary Site 02 is longer than the bid specs represent, Site 04 - Tippecanoe siphon is blocked by
unknown foreign objects and debris and is non functioning outside the scope of cleaning. Site 07 - South
"E" Street and Santa Ana River (Lorna Linda), all pipes are longer than the bid specs represent, two of the
three siphons (16" and 14") are blocked by unknown foreign objects and debris and are non ftmctioning
and outside the scope of cleaning. These events directly affect the time constraints, therefore Downstream
Services (DSI) request a change order for these sites.
This letter is Notification of Delay as required by contract requirements.
