of San Bernardino's Special Municipal Election be consolidated with the June 6, 2006
Statewide General Election conducted by the County of San Bernardino.
2/21/06 Resolution #2006-63: submitting to the qualified electors of said City for their approval
a proposed charter amendment relating to the salary of council members; transmission
of the proposed charter amendment to the office of the City attorney for purposes of
preparation of an impartial analysis.

Resolutions calling for a special election and submitting to the qualified electors for their
approval three proposed Charter Amendments relating to Charter Sections 120, 121, and 122;
and other related matters.
Backl!round:
At the May 17,2004 meeting of the Mayor and Common Council, City Clerk Rachel G. Clark
submitted suggested changes to the proposed City Charter. There were three key changes
recommended at that time that were not approved by the City Council and that need to be
reconsidered by the Mayor and City Council. The recommended changes would affect City
Charter Sections 120, The Initiative; Section 121, The Referendum; and Section 122; The Recall.
In November 2004, a new City Charter was approved by the voters and it included minor
changes for Charter Sections 120, 121, and 122. Although the City Charter was recently
amended, I believe that language with regard to the three processes remains either silent,
ambiguous, or conflicts with the Municipal Code or Elections Code and therefore strongly calls
for changes that would clarify the processes.
At this time I would like to recommend that the Mayor and Council call for a special election to
be consolidated with the November 7, 2006 statewide general election and submit to our voters
for their approval charter amendments that, if approved by the voters, would adopt the provisions
of the Elections Code as they relate to Initiative, Referendum, and Recall. In each of these areas,
the proposed change would delete existing language and would be substituted with the following
language: "There is hereby reserved to the voters ofthe City the powers of the (initiative,
referendum, recall). The provisions of the Elections Code of the State of California, as it
exists or is amended, governing the (initiative, referendum, recall) shall apply so far as such
provisions ofthe Elections Code are not in conflict with this Charter."
Two years ago, my office conducted a survey of charter cities. At that time, there were 107
Charter cities and 24 ofthose Charter cities were surveyed. We found that 22 of the 24 cities
either follow the Elections Code provisions on initiative, referendum, and recall, in its entirety or
in part. The language proposed in the foregoing paragraph is exactly what other Charter cities
have approved in their City Charters and provides a clear path to follow for each of these critical
areas.
Attached is a summary that shows existing Charter language for each of the areas, the language
in the Elections Code, and comments; however, I will attempt to describe how the proposed
changes would affect each of the three areas.

1. Section 120. The Initiative.
a) Notice ofIntent to Circulate; Filing, form. Section 120 is silent on a requirement
to file a Notice of Intent, and the form for such Notice; however, Elections Code
Section 9202 provides specific instructions for these requirements.
b) Proposed Measure; title and summary. Section 120 is silent on preparation of a
proposed measure and request to have the City Attorney prepare a ballot title and
summary; however, Elections Code Section 9203 and 9205 addresses these areas.
c) Publication of Notice. Section 120 is silent; however, Elections Code Section
9205 clearly outlines requirements for publication or posting of the notice of
intention and title and summary. It also addresses related matters.
d) When petition mav be circulated. Section 120 is once again silent on when the
petition may be circulated; however, Elections Code Section 9207 provides clear
direction.
e) Filing of Petition. Section 120 is silent on when the petition shall be filed. The
Elections Code provides that the petition shall be filed within 180 days from the
date of receipt of the title and summary, or after termination of any action for a
writ of mandate, etc. The Elections Code does not allow a petition to be amended
except by order of a court.
f) Insufficient signatures. The City Charter provides ten days to amend a petition if
it has insufficient signatures, while the Elections Code states that if petitions are
not filed within the time permitted (180 days), the petitions shall be void for all
purposes. (EC 9208).
g) Verification/Examination of Petition Signatures. Section 120 provides ten days
for examination of the petition, and an additional ten days if an amended petition
is submitted. The Elections Code allows 30 days, excluding Saturdays, Sundays,
and holidays - a much more reasonable time frame within which to properly
conduct an examination of a petition.
The above areas give you an indication of the differences between key sections of
language concerning the initiative process in our City Charter and the Elections Code.
2. Section 121. The Referendum.
The new City Charter approved by the voters in November 2004 did not include any
changes to this section of the Charter; however, here are the differences that continue to
exist between Section 121 of the Charter and the Elections Code.
a) Referendum form; affidavit of circulator. Section 121 is silent on these matters;
however, Elections Code Section 9238 gives clear direction on the form and
requirement for an affidavit.
b) Petition to reconsider ordinance/number of signatures required. Section 121
requires that the petition be signed by electors equal to 30% of the entire vote cast
for all candidates for Mayor at the last City election. The Elections Code requires
that the petition be signed by 10% of the voters according to the last official
report of registration (Section 9237). If, for example, a referendum petition was
circulated at this time, it would require 4,771 signatures following the City
Charter's requirements and it would require 6,805 signatures if we followed the
Elections Code.

c) Petition filing and examination of signatures. The Charter provides ten days to
examine the petition and an additional ten days to examine an amended petition, if
one is filed and the Elections Code allows for 30 days and it does not allow a
petition to be amended if it does not have sufficient signatures.
3. Section 122. The Recall.
When the new Charter was approved in 2004, Section 122, concerning Recall, included
numerous changes. In some instances, the language is similar to that in the Elections
Code; however, there are still areas in the Charter that should be changed. Here are the
key differences.
a) Limitations of Recall. The City Charter provides that recall of an elected officer
may not be commenced unless:
o The officer has held office for at least 90 days
o No recall petition has been filed within the preceding six months
The Elections Code provides the same provisions; however, it has one other
provision that is not included in the City Charter: His or her term of office ends
within six months or less.
b) Form of recall petition. The City Charter is silent on the form of the recall
petition; however, Elections Code Sections 11041, 11042, and 11043 provide
clear direction on the form of the petition and related matters concerning filing of
the proposed petition.
c) Number of qualified signatures required. The City Charter requires 15% of
registered voters for the recall of a City officer elected at large and 25% of
registered voters in a ward for the recall of a Council Member. These provisions
are actually the same in the Elections Code.
d) Filing and examination of petition. The City Charter requires that a recall petition
be filed within 90 days of the filing of the Notice ofIntention, while the Elections
Code provides for 160 days if there are 50,000 registered voters or more
(citywide). In the case of recalling a Council Member, the City Charter again
provides 90 days, while the Election Code bases the days on the number of voters
in the jurisdiction, i.e., 90 days if less than 10,000 but at least 5,000 voters, and
120 days ifless than 50,000, but at least 10,000 voters.
e) Random sampling technique. The Charter is silent in this area; however, the
Elections Code (11225) provides for the use of a random sampling technique for
verification of signatures.
f) Insufficient petition. The Charter allows the proponent 30 additional days to
obtain additional signatures if the petition is shown to be insufficient. On the
other hand, the Election Code provides that no action shall be taken if a petition is
insufficient.
g) When election shall be held The City Charter provides for a recall election to be
held not less than 50 days nor more than 70 days from the date of the Clerk's
Certificate. Following recent meetings with the Registrar of Voters, this time
frame simply would not permit a recall election to be conducted given the time
required for preparation of ballots, printing, mailing to overseas voters, etc. The
Elections Code provides a window of 88 to 125 days to call an election after the
issuance of the order.

The attached summary shows more clearly exactly what the differences are in the
area of recall.
Our Charter begs for clearer and more straightforward language in the three areas ofInitiative,
Referendum, and Recall and based on my experience as City Clerk for the past 16 years, I
believe that adopting the provisions of the Elections Code would remove the ambiguity and
archaic language that is contained in Sections 120, 121, and 122 of our City Charter.
Financial Imuaet:
The estimated cost is $50,000. A budget amendment will be brought back for approval if these
measures are placed on the ballot for November 7, 2006.

SECTION 1. Recitals.
A. In accordance with the Constitution of the State of California, the City of San
Bernardino, a municipal corporation, has adopted a Charter.
B.
The Mayor and Common Council of the City of San Bernardino desire to submit
to the qualified electors of the City of San Bernardino for their consideration a Charter
Amendment concerning Section 120, The Initiative.
SECTION 2. Special Municipal Election Called. A special municipal election is
hereby called and will be held in the City of San Bernardino on Tuesday, November 7, 2006,
for the purpose of submitting to the qualified electors of the City, for their approval or
disapproval, the proposed Charter Amendment as set forth in Exhibit "A" attached hereto.
SECTION 3. Request for Consolidation of Elections. Pursuant to Section 10400 of
the California Elections Code. the Mayor and Common Council of the City of San Bernardino
request that the Board of Supervisors of the County of San Bernardino consolidate the City's
special municipal election with the statewide general election to be held on Tuesday, November
7,2006.
The polls for said election shall be open at 7:00 a.m. on the day of said election and
shall remain open continuously from said time until 8:00 p.m. of the same day when said polls
shall be closed, except as provided in Section 14401 ofthe California Elections Code.

far as such provisions of the Elections Code are not in conflict
with the City Charter, except that the number of signatures
required for a qualified initiative petition submitted to the elections Against the Amendment
official shall be signed by electors equal in number to thirty
percent (30%) of the entire vote cast for all candidates for Mayor
at the last preceding City election at which a Mayor was elected.
The measure shall be designated on the ballot by a letter printed on the left margin of
the square containing the description of the measure as provided in the California Elections
Code.
SECTION 5. Canvass of Returns. The Registrar of Voters of the County of San
Bernardino is hereby authorized to canvass the returns of the special municipal election so
called which shall contain the following:
A. The time of the election;
B.
The hours the polls will be open;
C.
That the last day for receipt of primary arguments for or against the measure has
been established as 5:00 p.m. on August 21, 2006 in the City Clerk's Office, Second Floor,
City Hall, 300 North "D" Street, San Bernardino, California;

That the last day for receipt of rebuttal arguments is 5:00 p.m. on August 31,

held in such precincts and at such polling places as shall be determined by the Registrar of
Voters of the County of San Bernardino. The Board of Supervisors of the County of San

necessary for the holding of the consolidated election. The Mayor is hereby authorized to
execute a contract for the services necessary for conducting the special municipal election. The
City of San Bernardino recognizes that additional costs will be incurred by the County by
reasons of this consolidation and agrees to reimburse the County for any such costs.

required for a qualified initiative petition submitted to the elections Against the Amendment

percent (30%) of the entire vote cast for all candidates for Mayor

SECTION 5. Canvass of Returns. The Registrar of Voters of the County of San
Bernardino is hereby authorized to canvass the returns of the special municipal election so
