SUBJECT
Authorization to Execute Subpoena for Production of Telephone Records Relative to a Police
Internal Affairs Investigation.
BACKGROUND
The Police Department's Internal Affairs Unit is conducting an internal investigation into
allegations of potential misconduct against certain Police Department employees. In order for
the Internal Affairs Investigators to effectively conduct a complete and thorough investigation, it
is necessary to review Verizon California, Inc.'s records for certain Police Department
telephones. Since Verizon California, Inc. will not release such records without a subpoena, an
administrative subpoena is being requested to obtain the information necessary to complete the
aforesaid Internal Affairs investigation.
FINANCIAL IMP ACT
None.
RECOMMENDATION
Therefore, it is requested that pursuant to San Bernardino City Charter Section 34, California
Government Code Section 37104 et seq. and 18 V.S.C. Section 2703(c)(l)(C), the Common
Council adopt the floor motion authorizing the Mayor to execute, and the City Clerk to attest, the
attached subpoena for certain Police Department telephone records maintained by Verizon
California, Inc.
