HomeMy WebLinkAbout2006-247 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2006-247 RESOLUTION OF THE CITY OF SAN BERNARDINO MAKING APPLICATION TO THE LOCAL AGENCY FORMATION COMMISSION OF THE COUNTY OF SAN BERNARDINO FOR A REORGANIZATION CONSISTING OF ANNEXATION TO THE CITY OF SAN BERNARDINO OF 6 AREAS OF UNINCORPORATED TERRITORIES, GENERALL Y LYING NORTH OF PACIFIC STREET, EAST OF VALENCIA AVENUE, SOUTH OF PIEDMONT DRIVE AND WEST OF VICTORIA AVENUE, TO BE KNOWN AS ANNEXATION NO. 361. WHEREAS, the City of San Bernardino desires to initiate proceedings pursuant to Cortese-Knox-Hertzberg Local Government Reorganization Act of2000 (Section 56000 et. Seq. of the Government Code) for reorganization consisting of the annexation of 6 areas of unincorporated territories generally lying north of Pacific Street, east of Valencia Avenue, south of Piedmont Drive and west of Victoria Avenue, more specifically shown on the attached maps as Exhibit "A" attached hereto and made a part hereof and as described in Exhibit "B" attached hereto and made a part hereof; and WHEREAS, said reorganization is to include annexation of said areas to the City of San Bernardino and detachment from certain County of San Bernardino Service Areas; and WHEREAS, the areas proposed to be annexed are consistent with the Sphere of Influence of the City of San Bernardino; and WHEREAS, the reason for this proposed reorganization is the reduction of the areas of certain unincorporated islands, total reduction consisting of 94 acres, more or less, within the City of San Bernardino's Sphere of Influence pursuant to Section 56375.3 of the Government Code; and WHEREAS, pursuant to Government Code Section 56375.3, the proposed reorganization may be completed without a protest hearing, subject to the conditions as set forth therein; and WHEREAS, proceedings pursuant to said Government Code Section 56375.3 are subject to a completion date of January 1,2007; and 07/07/06 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION MAKING APPLICATION TO LAFCO FOR REORGANIZATION CONSISTING OF ANNEXATION TO THE CITY OF SAN BERNARDINO OF 6 AREAS OF UNINCORPORATED TERRITORIES, GENERALLY LYING NORTH OF PACIFIC STREET, EAST OF VALENCIA AVENUE, SOUTH OF PIEDMONT DRIVE AND WEST OF VICTORIA AVENUE, TO BE KNOWN AS ANNEXATION NO. 361. WHEREAS, subject to passage of Assembly Bill 2223 by the State of California, said completion day may be extended to January I, 2014. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Application is hereby made to the Local Agency Formation Commission of the County of San Bernardino to initiate proceedings for the reorganization consisting of the annexation of 6 areas of unincorporated territories generally lying north of Pacific Street, east of Valencia Avenue, south of Piedmont Drive and west of Victoria Avenue, more specifically shown and described in said Exhibit "A" and Exhibit "B", to be known as Annexation No. 361. SECTION 2. The Mayor ofthe City of San Bernardino is hereby directed and authorized to execute, on behalf of said City, the justification for proposal, a copy of which is attached hereto as Exhibit "C" and made a part hereof, and supplemental form, a copy of which is attached hereto as "Exhibit "D" and made a part hereof. SECTION 3. No special conditions shall be required or imposed on the property owners or residents of the areas proposed to be annexed under this proposal other than what is normal and customary of annexations into the City of San Bernardino, except that these areas will not be assessed the City's Utility User's Tax. SECTION 4. The City of San Bernardino will assume all revenues now collected by the County of San Bernardino pursuant to County Service Area (CSA) 38 L for paramedic services. SECTION 5. The City of San Bernardino uses the San Bernardino County Assessor's Property Tax Rolls for collections of its portion of property taxes, special taxes and assessments. 07/07/06 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION MAKING APPLICATION TO LAFCO FOR REORGANIZATION CONSISTING OF ANNEXATION TO THE CITY OF SAN BERNARDINO OF 6 AREAS OF UNINCORPORATED TERRITORIES, GENERALLY LYING NORTH OF PACIFIC STREET, EAST OF VALENCIA AVENUE, SOUTH OF PIEDMONT DRIVE AND WEST OF VICTORIA AVENUE, TO BE KNOWN AS ANNEXATION NO. 361. SECTION 6. Subject to passage of Assembly Bill 2223 by the State of California extending the completion date of proceedings under said Government Code Section 56375.3 to January I, 2014, the City of San Bernardino shall initiate proceedings for annexation of other islands of unincorporated territory within its sphere of influence, or portions thereof, and subject to conditions and qualifications as set forth therein, to be completed prior to the proposed extended completion date of January 1,2014, or as otherwise may be authorized therein. SECTION 7. The City Clerk of the City of San Bernardino is hereby authorized and directed to file, or cause to be filed, a certified copy ofthis Resolution with the Executive Officer of the Local Agency Formation Commission of the County of San Bernardino. SECTION 8. Morris, Mayor City of San Bernardino 7/10/06 2 2006-247 PLAN FOR SERVICES Reorganization of the City of San Bernardino to include the annexation of 6 unincorporated areas located within the City of San Bernardino. DESCRIPTION OF SERVICES . Fire Protection Services: All proposed Areas are currently served by the City of San Bernardino Fire Department pursuant to an agreement with the County of San Bernardino. The City will continue to provide fire services for these areas after annexation. The nearest fire stations to the proposed annexation Areas are as follows: Area I: No. 226 Area 2: No. 226 Area 3: No. 226 Area 4: No. 226 Area 5: No. 226 Area 6: No. 227 1920 Del Rosa Ave, 92404 282 W. 40lh Street, 92407 In addition to fire and paramedic services, citywide services include disaster preparedness and emergency operations. CSA 38L fees are currently collected in county pockets and will continue to be collected after annexation. All estimates for services are based on 2000 census data. Multi-family complexes of four units or more located within the City are charged a mandatory fee for fire prevention inspections. Inspection rates vary by the size of the complex. There are no multi-family complexes that meet the criteria within the six proposed annexation areas. . Police Protection Services: The Areas are presently served by the San Bernardino County Sheriff. After annexation, the City of San Bernardino Police Department will provide police services. The Department currently has approximately 312 sworn officers. This includes 206 patrol/traffic officers, 46 detectives, 44 sergeants, 11 lieutenants, 3 captains, I Assistant Chief and I Chief. The department will also offer a "Crime Free"(Rental Housing) and all other crime prevention services to all proposed annexation areas. No additional fees are charged for routine services. Based on data analysis, the San Bernardino Police Department will absorb any additional costs of services for the proposed areas, no additional officers are needed at this time. All estimates for services are based on 2000 census data. . Water & Sewer Services: Areas 1-6 are currently receiving water delivery and sewage disposal from the East Valley Water District, which will continue after annexation. . Public Services/Refuse: Pursuant to City of San Bernardino policy, residents of a newly annexed areas may continue to use their current refuse provider for a period of up to five years after the date of annexation, or may have refuse services provided by the City anytime before that period. The current single family residential rate is $19.86 per month for once a week pick- up and includes the provision of three containers (normal, recycle-able and green waste). Commercial rates vary depending on the type and frequency of pick up. Additional services, such as old appliance pick-up or special pick up for large and hard to handle items are available for an additional fee. The City also has a comprehensive recycling program including the collection of used oil and tires. . PI/blic Services/Streets: The street division provides monthly street sweeping, street/sidewalk repair and street tree trimming. No additional fees are charged for these services. After completing the windshield survey of potential annexation areas it is believed the following costs will be incurred by the City: I. Additional 172,480 square feet of right-of-way to be sprayed for weeds- $12,000 2. Sign upgrades to City standards- $1,200 3. Many of the street name and stop signs that are now controlled by the county will need to be replaced to bring them up to City standard - $1,600 4. Edison maintains the streetlights in county controlled areas, and they all appear to be within the City street lighting policy. If additional lighting is needed Edison will install with little or no cost to the City. The City will assume the maintenance costs for these lights after annexation and upon a completion of an agreement with County. Those costs are unknown at this time. ' Total Cost - $14,800 It is expected that these services will be funded through anticipated revenue. Any difference will be offset by the general fund. . Develovme/lt Services: The Development Services Department provides planning, building and engineering services related to land development, including new development and additions. The permit fees vary, depending on the type of development. The Public Works Division of the Development Services department also provides services such as street rehabilitation and storm drain installation and repair. These types of projects are normally part of the City's five year Capital Improvement Program and funding is normally provided by either the general fund or various transportation funds such as gas tax funds. No additional fees are charged for these services. . Code Comvlia/lce/E/lforceme/lt: Currently the City of San Bernardino has a staff of 32 personnel that administer code compliance services. These services include housing improvement, neighborhood revitalization and weed abatement. Abatement costs are normally billed or assessed to the owners of property on which abatement activity occurs. The recent Del Rosa annexation did not include an increase in code enforcement officers. The City is proposing that two (2) new officers be added to cover the newly annexed areas. The cost for two officers including uniforms, radios and office equipment is approximately S 115,000 for the first year and S II 0,00 each additional year after. 2 2006-247 A portion of these costs will come from anticipated revenues from this annexation, with the remainder to be paid from the general fund. . Allimal COlltrol: The City of San Bernardino will provide Animal control services. No additional fees will be charged for these services. Any animal currently licensed by the County of San Bernardino will be honored until the license expiration, at that time all animals must be licensed with the City. Additional services, such as spay/neutering, adoption and vaccination, are available on an individual basis for an additional fee. EFFECTIVE DATE OF SERVICES . All City services will be available to property owners and/or residences on the effective date of annexation. IMPOSITION OF INFRASTRUCTURE IMPROVEMENTS or OTHER CONDITIONS . The area is primarily developed; therefore, no immediate need for infrastructure improvements have been noted. Streets within the islands will be included in the city-wide pavement management programs. IMPROVEMENT ZONES/DISTRICTS; ASSESSMENT DISTRICTS . Districts: None of the 6 Areas are in Redevelopment Districts, Assessment Districts or Community Facility Districts. . IVDA: Areas 4,5,6 are located within Inland Valley Development Agency boundaries. ESTIMATED REVENUE FROM ANNEXATION AREAS* . The City of San Bernardino currently collects a 7.93 percent Utility Users Tax. This fee will Ilot be assessed to the 6 Areas, unless otherwise approved by voters within the Areas. .
