BACKGROUND
The applicant, Dan Katz, appealed a zoning verification determination that the property at
2176 N. McKinley (Exhibit 1) had lost its non-conforming status as a four-plex in the PCR,
Public Commercial Recreation land use district.
The following is a summary of the activities related to this appeal. Refer to the Planning
Commission staff report (Exhibit 2) for a complete discussion.
. March 16, 2001- Administrative Warrant (property vacated)
. March 26, 2001 - Notice of Pendency filed against property
. June 1, 2001 - Hearing Order (No. 01119) granting owners thirty days to pull
permits for rehabilitation or demolition of structure. The hearing order included
language in Section 5 regarding the loss of non-conforming status if such a
property were left vacant for 12 months or longer.
. January 7, 2002 Fairbanks Capital took possession.
. June 21, 2002 Mr. Katz contacted City Attorney's office having reviewed the
Code Enforcement file. Included in the file were copies of the three actions listed
at the top of this list.
. January 17, 2003 Mr. Katz obtained a zoning verification noting that the property
had lost its non-conforming status
. February 2003 Mr. Katz filed appeal to Planning Commission
At their meeting of April 22, 2003 the Planning Commission heard testimony regarding
the appeal and denied it based on the grounds that the property had lost its non-
conforming status because it had been vacant for over twenty-four months in total.
Section 19.62.030(2) of the Development Code states that a non-conforming use "shall lose
its legal non-conforming status, and the continued use of the property shall be required to
conform with the provisions of [the] Development Code" if a use is discontinued for
twelve months or longer.
FINANCIAL IMPACT
None; the applicant has submitted the application filing fees for this project.
RECOMMENDATION
Staff recommends that the Mayor and Common Council:
Deny the appeal and uphold the Planning Commission that the four-plex located
at 2176 N. McKinley has lost its non-conforming status, based upon the
supporting data contained in this staff report.

APPELLANT'S GROUNDS FOR APPEAL
Appeal of loss of non-conforming use status ior a four-plex located at 2176 N. McKinley Avenue
(see Attachment A).
The appellant's grounds for appeal are that the property was obtained by Fairbanks Capital
Corp (Fairbanks) during a foreclosure action with the intent of using it as a four-plex (a copy of
the applicant's application and other letters from the applicant is attached as Attachment B).
Fairbanks bought the property in January of 2002, and it had been vacated by Administrative
Warrant issued on March 16, 2001 due to lack of water service. The electrical service was shut
off later in March of 2001. The applicant claims that they were working with the Code
Compliance Department and that they simply wish to rehabilitate the existing structure as per
the Abatement Order (Order No. H/O 01119) from May of 2001 (part of Attachment C). Section
5 of Order No. 01119 clearly discusses the City regulations regarding non-conforming uses,
including a statement as to the time limitation, specific Development Code Sections regarding
non-conforming uses, and a statement that the City may deny the right to rehabilitate due to the
non-conformity of use..
BACKGROUND/ANALYSIS
General Plan Amendment No. 98-07, which was adopted by Resolution No. 1999-42 in March of
1999, changed the land use district from RMH, Residential Medium High to PCR, Public
Commercial Recreation, thus making all residential uses within the area non-conforming. The
Code Compliance department issued a Notice of Pendency for the subject property on March
26,2001, following Order No. H/O 01119. The Administrative Order was effective June 1, 2001,
requiring the property owners to obtain permits to rehabilitate or demolish the structure within
thirty (30) days from the date of the order. The owners took no action so the property should
have been scheduled for demolition sometime after July of 2001. The current owners took
possession of the property on January 7, 2002 with the Notice of Pendency filed against the
property. An interoffice memorandum from Robert Houts, Code Compliance Officer dated
February 25, 2003 (attached to this report as Attachment C) provides a full statement regarding
the activities they have undertaken with his department for the subject property, which
includes the Notice of Pendency; the Administrative Order; a copy of a letter from Mr. Katz to
Ms. Jolena Barnes Deputy City Attorney; a returned letter from; and a copy of the Grant Deed of
the property verifying the date of acquisition by Fairbanks.
Since the property was ordered to be vacated in March of 2001, then ordered to obtain permits
within thirty days of the Administrative Order, and no action was taken to rehabilitate the
property or repair the nuisances the property has been vacant for over two years. At the time
the Zoning Verification (part of Attachment B) was submitted the property had been vacant for
over twenty-two months, and by the admission of Mr. Dan Katz representing Fairbanks on the
submitted zoning verification the property had been knowingly vacant for over twelve months
deeming the property as having lost its non-conforming use by admission on a signed form.
Additionally Mr. Katz wrote a letter to Ms. Jolena Barnes of the City Attorneys office on June 21,
2002 (part of Attachment C) where he stated he had reviewed the Code Compliance file. This
file contains all of the information regarding the vacancy and the requirements for action within
twelve months of that vacancy. Thus in June of 2002 Mr. Katz knew the property had already
lost its non-conforming status.

The San Bernardino Development Code 9 19.62.030.2 allows for continuation of non-conforming
uses as long as the use has not ceased for a period of one year or more. Since the structure
became vacant in March of 2001, and was not re-occupied or even in process of rehabilitation by
June of 2002, the property had already lost its non-conforming status when Mr. Katz wrote the
letter to Ms. Barnes. No known action was then taken until January of 2003 when Mr. Katz
obtained the zoning verification from the Planning Division public counter and was denied the
use of the property as a residential four-plex due to its having lost its non-conforming status.
Mr. Katz then proceeded to file the appeal of the Directors Determination at the end of January
2003, over one year after his clients had taken possession of the property and over six months
since he acknowledged having previously reviewed the Code Compliance file containing all of
the information regarding the loss of non-conforming use. The only permissible uses at the
subject site at this time are those allowed by the current land use district PCR, Public
Commercial Recreation.
CONCLUSION
Based on the Code Compliance actions, and the City's records staff found no facts and I or data
to support the appellant's grounds for the appeal.
RECOMMENDATION
Staff recommends that the Planning Commission close the public hearing, deny the appeal and
uphold Directors Determination that the four-plex has lost its non-conforming status, based
upon the supporting data contained in this staff report.

Specific grounds for the appeal: The property was obtained by Fairbanks in foreclosure for
the purpose of using it as a fourplex. The property is the subject of a Code
Enforcement Action. Fairbanks wishes to rehabilitate the property consistent with the
requirements of code enforcement, but must obtain approval for such use before
entering into a rehabilitation contract with the City of San Bernardino.

Dear Mr. Funk:
This office represents Fairbanks Capital Corporation, the owner of the above-referenced
property. On January 17,2003, a zoning verification was requested by me on behalf of Fairbanks
for use of the above-referenced property as a fourplex. The zoning verification was denied. A
copy is attached for your convenience. This letter shall constitute Fairbanks' appeal of the
Planning Department's decision on the zoning verification.
The above-referenced property is the subject of a pending nuisance abatement action
involving the Office of Code Enforcement. Fairbanks did not own the Property at the time the
nuisance abatement action was commenced and accordingly, had no opportunity to defend it.
Fairbanks desires to take whatever steps are necessary to rehabilitate the Property for use as a
fourplex and correct any and all defects found by the Office of Code Enforcement. However, the
Property's current condition requires that Fairbanks pursue its efforts to rehabilitate the Property
with the Planning Department.

Ben you are correct, this property has not had water and was vacated by the City of San
Bernardino under an Administrative Warrant issued March 16, 200 I, A Notice of Pendency was
filed against the property March 26, 2001 and an Administrative Order issued June 1,2001. This
order stated in part that the property owners were to obtain permits to rehabilitate or demolish the
structure within thirty days from the date of the order and that the property was not to be rented,
[eased or occupied until all repairs had been made and all violations corrected. The owners of
the property failed to make the required repairs and no permits were obtained. Therefore, the
property has not been legally rented since the abatement warrant of March 16, 200 I. The current
owners of the property, Fairbanks Capital, purchased the property January7, 2002. with the
Notice of Pendency in place. These documents are attached, along with the others listed below.
An attorney, Daniel Kats, for Fairbanks Capital contacted our office requesting a Rehabilitation
Agreement. He was instructed to obtain zoning approval prior to entering into any Agreement.
The Code Compliance Department does not have the authority to allow this structure to be
rehabilitated or used in violation of the City's General Plan. [referred him to your department in
January 2003, your records show that on or about January 17,2003, Daniel Kats filed a Zoning
Verification Review in which stated that the property has been vacant over I year. Your
department at that time determined that the property had lost its Non-confonning Status. It is my
understanding that the City is unable to enter into an agreement if the owners of the property are
unable to meet the requirements of the General Plan or a non-conforming use. The owners must
submit a plan that will convert the property to the current General Plan of Resolution #1999-07
or obtain permits to be demolished.

WHEREAS, pursuant to the San Bernardino Municipal Code, Title 15, Chapter
15.24/28, the Supervising Building Official has posted a building(s) located at 2176 N.

8 McKinley Street, San Bernardino, California, with a "Notice to Abate Nuisance" and has
9 notified the person(s) having an interest in said property that the said building(s) or
10 premises constitute a public nuisance;

WHEREAS, the Supervising Building Official ordered abatement of said property
12
to protect the health and safety of the community;

WHEREAS, pursuant to San Bernardino Municipal Code, the Supervising
15
Building Official has served a "Notice of Hearing Before the Hearing Officer of the City
16 of San Bernardino", relating to abatement of said nuisance, to all person(s) having an
17 interest in the above property, and has prepared a declaration of mailing of the notice, a
18 copy of which is on file in these proceedings; and;

WHEREAS, a hearing was held to receive and consider all relevant evidence,
20
objections or protests on Mav 10, 2001, and;

NOW THEREFORE, IT IS ORDERED BY THE HEARING OFFICER OF THE CITY OF
SAN BERNARDINO AS FOllOWS:

SECTION 1. Based upon the evidence submitted and upon the failure of any
6
party to appear to contest the matter, it was found and determined that the building(s)
7
and or premises located at 2176 N McKinley Street, San Bernardino, California
8
-
constituted a public nuisance and that the action to abate the nuisance was appropriate.
9
SECTION 2. The Hearing Officer accepted staff's recommendations. The
10
11
property owner(s) are hereby directed to comply with the following requirements. To
12
prevent unauthorized entry, the owner(s) of record shall continuously maintain all
13
structures to FHA board up standards. That within ten (10) days from the date of this
14
order, if plans are required to correct any violations as stated in the Notice of Hearing,
15 the owner(s) shall submit plans for the necessary repairs or rehabilitation to
16
Development Services, for violations to include, but not limited to: 1) Hazardous
17
18
electrical; 2) unsafe walking surface; 3) hazardous plumbing; 4) hazardous mechanical
19
equipment; 5) inadequate sanitation, lack of heat and lighting/ventilation, and 6) faulty
20 weather protection. In the alternative, if only permits are required for repairs as stated in
21
the Notice of Hearing, if needed for violations to include but not limited to: 1) hazardous
22
electrical; 2) unsafe walking surface; 3) hazardous plumbing; 4) hazardous mechanical
23
equipment; 5) inadequate sanitation, lack of heat and lighting/ventilation, and 6) faulty
24
weather protection, the owner(s) shall obtain the necessary permits for rehabilitation or
25
26
demolition within thirty (30) days from the date of this order. The property shall not be
27
rented, leased or occupied until all violations are corrected and inspected by
Development Services Department. All work to correct the violations noted in the Notice

of Hearing must be completed, all required permits finalized and approved by the
4
Development Services Department and Code Compliance Division within sixty (60)
5
days from the date of this order Within ten (10) days from the date of this order, the
6
owner(s) of record shall install landscaping where required and shall continue to
7
maintain the existing landscaping to include regular irrigation, pruning and cutting of
8
9
lawn; remove and continue to maintain the property free of weeds, dry brush, overgrow
vegetation, trash, debris and any items causing an unsightly appearance or improperly
10
11
stored items. The property shall meet all applicable codes adopted by the City of San
12
Bernardino.

SECTION 3. That upon the failure of the owner(s) of record to comply with the
order of the Hearing Officer, the Code Compliance Division shall obtain an
Inspection/Abatement warrant to abate violations noted in the Notice of Hearing. If the
owner fails to comply with the order of the Hearing Officer, within the time specified, the
City may initiate action including demolition, removal of any unauthorized construction,
and any other actions necessary to abate the nuisance.
SECTION 4. It was determined that the City was required to initiate abatement
proceedings and incurred costs in the amount of $2,57369. Due to the failure of the
owner(s) of record to respond or comply within the time frame stated on the previous
notice of violation issued, the owner(s) shall incur these direct costs and any additional
abatement costs as a lien upon record If not paid within thirty (30) days, the Code
Compliance Division is hereby authorized to collect unpaid amounts owed by entering a
lien with the Auditor of the County of San Bernardino, State of California. The sum is to
be entered as lien charges against said property as it appears on the current

assessment rolls, to be collected as the same and in the same manner, subject to the
same penalties and interest upon delinquencies, that the general taxes for the City of
San Bernardino are collected. The Code Compliance Division shall present for
recording an appropriate notice of the imposition of the lien with the County Recorder.
These costs and any future additional abatements shall be the personal

obligation of the owner and if unpaid shall be recorded as a special assessment on the
9
property.

SECTION 5. If a legal nonconforming structure or a legal nonconforming use is
11
discontinued for a period of 12 or more consecutive calendar months, the structure or
12
13
use shall lose its legal nonconforming status, and shall be removed or altered to
14
conform to the provisions of the City's General Plan and Development Code pursuant to
15
Sections 19.62.020 and 19.62.030. The City may deny building permits to repair or
16
rehabilitate this structure if the structure and/or use are nonconforming to the City's
17
current General Plan and Development Code.

SECTION 6. Upon receipt of an application from the person required to conform
19
to the order and by agreement of such person to comply with the order if allowed
20
21
additional time, the Supervising Building Official may grant an extension of time, not to
22
exceed an additional 120 days, within which to complete said repair, rehabilitation or
23
demolition, if the Supervising Building Official determines that such an extension of time
24
will not create or perpetuate a situation imminently dangerous to life or property. The

Supervising Building Official's authority to extend time is limited to the physical repair,
26
rehabilitation or demolition of the premises and will not in any way affect or extend the
27
time to appeal the notice and order.

SECTION 7. Any person aggrieved by this order may appeal to the Board of

Dear Members of the City of San Bernardino Planning Commission:
This office represents Fairbanks Capital Corporation ("'Fairbanks"), the owner of the
above-referenced property (hereinafter, the "Subject Property"). Thank you for giving me the
opportunity to address you regarding the Subject Property.
As you are aware the area where the Subject Property is located was downzoned in 1999
from Residential High Medium, which permitted use of the Subject Property as a residential
fourplex, to Public Commercial Recreational, which does not permit this use. Owners of
fourplexes in the area affected by the downzoning were granted a nonconfornling use status. The
City imposed a condition that the properties in question not go unoccupied for more than a
continuous calendar year or else they would lose their nonconforming use status.
As you are further aware, the Subject Property has been and is the subject of a nuisance
abatement proceeding that commenced in March, 2001 against the owner of record at that time
and resulted in a nuisance abatement order, dated May 10, 200 I.

During the time period relevant to the 1999 downzoning and the nuisance abatement
proceedings, Fairbanks was neither the O\\Iler of the Subject Property nor was it in possession of
the Subject Property. Fairbanks acquired title to the Subject Property by way of a foreclosure
sale, after entry of the nuisance abatement order. (See Trustee's Deed Upon Sale, dated January
10,2002, attached hereto as Exhibit "A" for your convenience). At the time Fairbanks acquired
title to the Subject Property in January, 2002, it was unoccupied as a result of the nuisance
abatement order.
After acquiring title to the Subject Property at the foreclosure sale, Fairbanks undertook
to use the Subject Property for its historical and intended use as a residential fourplex. In this
regard, upon discovering the pendency of the nuisance abatement proceedings, Fairbanks
undertook to take the necessary steps to rehabilitate the Subject Property.
In or about May, 2002, Fairbanks engaged legal counsel to review the Code Compliance
file for the Subject Property and to undertake whatever steps necessary to effectuate the
necessary rehabilitation work. Immediately thereafter, on or about May 22, 2002, Fairbanks'
legal counsel obtained and reviewed a copy of the Code Compliance file for the Subject Property.
Thereafter, in or about June, 2002, Fairbanks, through its real estate agent, engaged Top
Line Construction to inspect the Subject Property and prepare a bid for rehabilitation work
necessary to bring the Subject Property in compliance with all relevant City building ordinances
and the aforementioned nuisance abatement order. In or about the end of June, 2002, a Top Line
representative, Sandra J. Bretto, personally inspected the Subject Property and submitted a bid
for the necessary rehabilitation work contemplated by the nuisance abatement order. (Top Line's
July 2, 2002 bid is attached hereto as Exhibit "B" for your convenience.)
Thereafter, Fairbanks, through its legal counsel, entered into discussions with various
City of San Bernardino Code Compliance officers in order to obtain approval and direction with
regard to rehabilitating the Subject Property in conjunction with the nuisance abatement order.
Most of the contact with Code Compliance in this regard was with Doug Leeper.
On or about September 30, 2002, Ms. Bretto personally met with Mr. Leeper to formally
discuss the steps Fairbanks needed to take in order to a obtain rehabilitation order and proceed
with the work. The requirements imposed by Code Compliance, as they were communicated to
Ms. Bretto, are outlined in a letter dated October 2,2002 to Fairbanks' legal counsel. (Ms.
Bretto's October 2, 2002 letter is attached hereto as Exhibit "C" for your convenience).

The terms communicated to Ms. Brello by Mr. Leeper were and still are acceptable to
Fairbanks The process entailed, among others. the entry into a strictly enforced rehabilitation
contract with the City. However, shortly after Ms. Brello's meeting with Mr. Leeper, Ms. Brello
was contacted by Code Compliance and informed that the rehabilitation process that was
communicated to her by Mr. Leeper would not be made available for the Subject Property
without prior approval from the City of San Bernardino Planning Department. It was specifically
communicated to Ms. Bretto that the City would not enter into a rehabilitation contract with
Fairbanks, until the Planning Department approved of Fairbanks' use of the Subject Property as a
residential fourplex, due to the fact that it did not retain its nonconforming use due to
unoccupancy.
Thereafter, Fairbanks, through its legal counsel and Ms. Brello, had several conversations
with various members of Code Compliance (Mr. Leeper) and staff members of the City Planning
Department in order to determine the appropriate course of action to effectuate an approved
rehabilitation of the Subject Property. It was eventually determined that Fairbanks would have to
submit a Zoning Verification Review to the Planning Department for use of the Subject Property
as a fourplex. On January 17,2003, Fairbanks submitted a Zoning Verification Review to the
City Planning Department for use of the Subject Property as a residential fourplex. The Zoning
Verification Review for use of the Subject Property as a residential fourplex was denied and this
appeal ensued.
Currently, Fairbanks has a pending contract to sell the Subject Property to a buyer who
also intents to use the Subject Property as a residential fourplex. The contract for sale is
contingent on the rehabilitation of the Subject Property and the permitted use of it as a fourplex.
In conclusion, Fairbanks stands to lose the entirety of its investment in the Subject
Property. Fairbanks was not the owner of record during the nuisance abatement proceedings and
was not on the service list for any of the proceedings that led to the May 10, 200 I nuisance
abatement order. Upon acquiring title to the Subject Property in January, 2002. Fairbanks
undertook to discover and effectuate the steps necessary to rehabilitate the Subject Property, as
set forth above herein. Fairbanks remains ready willing and able to effectuate all repair work on
the Subject Property imposed by Code Compliance by way of the nuisance abatement order.

Subject Meetings with City of San Bernardino Building & Safely and Code Compliance Division
Per your authorize of September 30, 2002, I met with the City of San Bernardino Officials Tuesday
October1, 2002, as the first step toward obtaining building permits for the above referenced property and
to clarify the status of the City's demolition permit. Information herein is mostly from:
Doug Leeper, Field Operation Manager, Code Compliance Division (909) 364-5205.
The bottom line is that the City does not have a Demolition Permit Code Compliance has a demolition
HOLD on the property. Because of the Demolition Hold the city will not issue any permits until Code
Compliance has a written Rehabilitation Contract with the owners of the property. Code Compliance will
only enter into this agreement only wtth the property owner or his legal representative,
A brief description of current conditions and steps Fairbanks and/or their Lawyer need to take:
1) The Demolttlon Hold Is a result of the property owner's failure to respond to the city's Notice of
Hearing last year. The property has been in default since July 2001,
2) Before the Ctty will enler Into negotiations to release the default and perma rehabilitation, the
owner of the property must submit a CASH (cash or cashiers check) deposit In an amount equal
to the estimated cost of demolishing the building. In the case of this building tt would be between
$12,000.00 and $15,000.00. This deposa Is non refundable except for the completion of the
rehabllttation. If the property owner and the Ctty can not come to an agreement regarding the
rehabilitation plan, the money will not be refunded. If the rehabilitation plan is not completed in the
time frame agreed to by the ctty and the property owner, the deposit will not be refunded. If the
property is not rehabilitated wtthin the require time frame the deposit will be used to demolish the
building.
3) After the deposit is made the Property Owner or his Legal Representative must met with Code
Compliance and negotiate a plan for the Rehab of the building. The plan will consist of each
elements to be repaired, the start date and completion date for each element This plan w~1
become the legal contract and no dates within the contract will be extended for any reason.
Whereas detailed descriptions of the repairs will be required, it is unlikely building plans will need to
be drawn up unless there is structural damage to the building.
4) After the contract is completed it will be sent, by Code Compliance, to the Hearing Officers listed
on the original Notice of Hearing which was Wendy Riner (909) 384-5945. The Hearing OffICer can
approve or reject the plan. If the plan Is rejected, the deposit will not be refunded. According
to Doug Leeper 80+ percent of the plans are approved.
5) The agreed to contractual dates will be fIXed and will not be extended for any reason. If for
example (elCllmple given by Doug Leeper), vandals break Into the property just before final
inspection is due and as a result the building can not pass inspection -- the deadline for completion
will not be extended,

the rate of $75.00 an hour. The rate for Administrallve personnel to comply the data needed and to attend
meetings will be $45.00 an hour including traveltime.

Dear Members of the City of San Bernardino City Counsel:
This office represents Fairbanks Capital Corporation ("Fairbanks"), the owner of the
above-referenced property (hereinafter, the "Subject Property"). Thank you for giving me the
opportunity to address you regarding the Subject Property.
By this letter, Fairbank hereby appeals the decision of the City of San Bernardino
Planning Commission to deny of the appeal of the Zoning Verification Review to use the Subject
Property as a residential four-plex. The Planning Commission's decision to deny the appeal was
rendered on April 22, 2003 (Appeal No. 03-03).
As you are aware, the area where the Subject Property is located was downzoned in 1999
from Residential High Medium, which permitted use of the Subject Property as a residential
four-plex, to Public Commercial Recreational, which does not permit this use. The uses
permitted under the Public Commercial Recreational zoning ordinance (sports field, restaurant,
golf course, etc.) are wholly inconsistent with Fairbanks' intended use of the Subject Property
and are likewise inconsistent with the surrounding area. The Public Commercial Recreational
zoning ordinance was in furtherance ofthe City's calculated effort to remove residential four-
plexes from the surrounding area (commonly referred to as "Arden/Gutherie"). Owners offour-
plexes in the area affected by the downzoning were granted nonconforming use status. With
regard to the nonconforming use, the City imposed a condition that the properties in question not
go unoccupied for more than a continuous calendar year.

The Subject Property has been and is the subject of a nuisance abatement proceeding that
commenced in March, 200 I against the owner of record at that time and resulted in a nuisance
abatement order, dated May 10,2001. The nuisance abatement order mandated that the Subject
Property remain vacant until it was rehabilitated in a matter so as to cure the defects found by
Code Enforcement. Moreover, the nuisance abatement proceeding resulted in the utilities to the
Subject Property being shut-off.
During the time period relevant to the 1999 downzoning and the nuisance abatement
proceedings, Fairbanks was neither the owner of the Subject Property nor in possession of it.
Fairbanks acquired title to the Subject Property by way of a foreclosure sale, after entry of the
nuisance abatement order. (See Trustee's Deed Upon Sale, dated January 10,2002, attached
hereto as Exhibit "A" for your convenience). Fairbanks' decision to acquire title to the Subject
Property was based upon the value that it would have as a residential four-plex.
At the time Fairbanks acquired title to the Subject Property in January, 2002, it was
unoccupied as a result of the nuisance abatement order
After acquiring title to the Subject Property at the foreclosure sale, Fairbanks undertook
to use the Subject Property for its historical and intended use as a residential four-plex, as
contemplated by Fairbanks when it acquired title to it. In this regard, upon discovering the
pendency of the nuisance abatement proceedings, Fairbanks undertook to take the necessary steps
to rehabilitate the Subject Property.
In or about May, 2002, Fairbanks engaged legal counsel to review the Code Compliance
file for the Subject Property and to undertake whatever steps necessary to effectuate the
necessary rehabilitation work. Immediately thereafter, on or about May 22, 2002, Fairbanks'
legal counsel obtained and reviewed a copy of the Code Compliance file for the Subject Property.
Thereafter, in or about June, 2002, Fairbanks, through its real estate agent, engaged Top
Line Construction to inspect the Subject Property and prepare a bid for rehabilitation work
necessary to bring the Subject Property in compliance with all relevant City building ordinances
and the aforementioned nuisance abatement order. In or about the end of June, 2002, a Top Line
representative, Sandra J. Bretto, personally inspected the Subject Property and submitted a bid
for the necessary rehabilitation work contemplated by the nuisance abatement order. (Top Line's
July 2, 2002 bid is attached hereto as Exhibit "B" for your convenience.)
Thereafter, Fairbanks, through its legal counsel, entered into discussions with various
City of San Bernardino Code Compliance officers in order to obtain approval and direction with
regard to rehabilitating the Subject Property in conjunction with the nuisance abatement order.
Most of the contact with Code Compliance in this regard was with Doug Leeper.

On or about September 30, 2002, Ms. Bretto personally met with Mr. Leeper to formally
discuss the steps Fairbanks needed to take in order to a obtain rehabilitation order and proceed
with the work. The requirements imposed by Code Compliance, as they were communicated to
Ms. Bretto, are outlined in a letter dated October 2,2002 to Fairbanks' legal counsel. (Ms.
Bretto's October 2,2002 letter is attached hereto as Exhibit "C" for your convenience).
The terms communicated to Ms. Bretto by Mr. Leeper were and still are acceptable to
Fairbanks. The process entailed, among others, the entry into a strictly enforced rehabilitation
contract with the City. However, shortly after Ms. Bretto's meeting with Mr. Leeper, Ms. Bretto
was contacted by Code Compliance and informed that the rehabilitation process that was
communicated to her by Mr. Leeper would not be made available for the Subject Property
without prior approval from the City of San Bernardino Planning Department. It was specifically
communicated to Ms. Bretto that the City would not enter into a rehabilitation contract with
Fairbanks, until the Planning Department approved of Fairbanks' use of the Subject Property as a
residential four-plex. It was explained to Ms. Bretto that this was necessary due to the fact that
the Subject Property did not retain its nonconforming use because it had been vacant for more
than a year.
Thereafter, Fairbanks, through its legal counsel and Ms. Bretto, had several conversations
with various members of Code Compliance (Mr. Leeper) and staff members of the City Planning
Department in order to determine the appropriate course of action to effectuate an approved
rehabilitation of the Subject Property. It was eventually determined that Fairbanks would have to
submit a Zoning Verification Review to the Planning Department for use of the Subject Property
as a four-plex. On January 17,2003, Fairbanks submitted a Zoning Verification Review to the
City Planning Department for use of the Subject Property as a residential four-plex. The Zoning
Verification Review for use of the Subject Property as a residential four-plex was denied and an
appeal was made to the City of San Bernardino Planning Commission (Appeal No. 03-03).
The hearing before the Planning Commission occurred on April 22, 2003. I appeared at
the April 22, 2003 on behalf of Fairbanks and stated Fairbanks' position that the Public
Commercial Recreational zoning ordinance and the restrictive uses permitted thereunder, along
with the denial by the Planning Department of Fairbanks' requested use of the Subject Property
as a four-plex, would result in a complete loss of Fairbanks' investment in the Subject Property.
Currently, Fairbanks has a pending contract to sell the Subject Property to a buyer who
also intents to use the Subject Property as a residential four-plex. The contract for sale is
contingent on the rehabilitation of the Subject Property and the permitted use of it as a four-plex.

California law provides that a regulation (such as the Public Commercial Recreational
Zoning ordinance at issue herein) may constitute a taking if it goes too far. A regulation in this
regard can be a proper exercise of police power and still be considered a taking when it deprives
the owner of its economically viable use of the property. The regulation may also result in a
taking when it constitutes a substantial interference with the ability of a property owner to make
economically viable use of, derive income from, or satisfy reasonable investment-backed profit
expectations with respect to the property. (Miller & Starr, California Real Estate (3d ed. 2001)
Inverse Condemnation: "What Constitutes a Taking," 930:25, pp. 132-144.) If Fairbanks is
denied its requested use of the Subject Property as a residential four-plex, the City's down
zoning combined with its refusal to allow for rehabilitation of this property will completely
destroy the value of this property. Fairbanks would thus be left with no option other than to
pursue its appropriate legal remedy for the loss of that value.
My client, however, does not want to take this course of action, which is why it is now
before this Council. As noted above, Fairbanks remains committed to rehabilitating the Subject
Property consistent with the terms and conditions that were originally imposed by Code
Enforcement.

Subject: Meetings with City of San Bernardino Building & Safety and Code Compliance Division
Per your authorize of September 30, 2002, I met with the City of San Bernardino OffICials Tuesday
Octoberl, 2002, as the first step toward obtaining bulldin9 permits for the above referenced property and
to clarify the status of the City's demolftion permft. Information herein Is mostly from:
Doug Leeper, Field Operation Manager, Code Compliance Division (909) 384-5205.
The bottom line Is that the City does not have a Demolition Permit Code Compliance has a demolition
HOLD on the property. Because of the Demolition Hold the city will not issue any permits untll Code
Compliance has a written Rehabilitation Contract with the owners of the property. Code Compliance will
only enter into this agreement only wtth the property owner or his legal representative.
A brief description of current conditions and steps Fairbanks and/or their Lawyer need to take:
1) The Demolttion Hold Is a result of the property owner's failure to respond to the city's Notice of
Hearing last year. The property has been in default since July 2001.
2) Before the City will enter into negotiations to release the default and permit rehabilitation, the
owner of the property must submit a CASH (cash or cashiers check) deposit In an amount equal
to the estimated cost of demolishing the building. In the case of this building it would be between
$12,000.00 and $15,000.00. This deposit Is non refundable elCCept for the completion of the
rehabilitation. If the property owner and the City can not come to an agreement regarding the
rehabilitation plan, the money will not be refunded. If the rehabilitation plan Is not completed in the
time frame agreed to by the city and the property owner, the deposit will not be refunded. If the
property is not rehabilitated within the require time frame the deposit will be used to demolish the
bu i1ding.
3) After the deposit is made the Property Owner or his Legal Representative must met with Code
Compliance and negotiate a plan for the Rehab of the building. The plan will consist of each
elements to be repaired, the start date and completion date for each element This plan will
become the legal contract and no dates within the contract will be extended for any reason.
Whereas detailed descriptions of the repairs will be required, it Is unlikely building plans will need to
be drawn up unless there Is structural damage to the building.
4) After the contract Is completed it will be sent, by Code Compliance, to the Hearing Officers listed
on the original Notice of Hearing which was Wendy Riner (909) 384-5945. The Hearing OffICer can
approve or reject the plan. It the plan Is rejected, the deposit will not be refunded. According
to Doug Leeper 80+ percent of the plans are approved.
5) The agreed to contractual dates will be fIXed and will not be extended for any reason. If for
example (example given by Doug leeper), vandals break into the property just before final
inspection is due and as a result the bUilding can not pass inspection -_ the deadline for completion
will not be extended.

meetings will be $45.00 an hour Including traveltime.

Proposed Findings In Support of Denial of the Appeal:
Based upon the documentary evidence and testimony presented to the Mayor and Common Council,
the Council hereby adopts the following Findings:
I. The four-plex at 2176 N. McKinley ("Subject Property") in San Bernardino became vacant
on or about March 16, 200 I.
2. The Subject Property remained vacant for 12 or more consecutive calendar months after
March 16,2001.
3. Fairbanks Capital Corp. made no attempt to rehabilitate the Subject Property within 12
months after March 16, 200 I.
4. The only issue that the Council is deciding in this appeal is whether the legal non-conforming
status ofthe Subject Property expired. The Council is not deciding the Constitutional issues
because this is the wrong forum to present them. Fairbanks Capital Corp. is free to apply for
a zone change through a General Plan amendment or an ordinance change through a
Development Code amendment.
Motion:
That the hearing be closed; and that the Mayor and Council deny the appeal and uphold the
Planning Commission's determination that the four-plex located at 2176 N. Mckinley Avenue in the
PCR, Public Commercial Recreation, land use district has lost its legal non-conforming status, based
upon the supporting data contained in the staff report to the Council dated May 27,2003, and based
on the aforementioned Findings.
