HomeMy WebLinkAbout2006-147 1 RESOLUTION NO. 2006-147 2 3 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AMENDING THE CITY'S MASTER FEE SCHEDULE, RESOLUTION NUMBER 2005-147 TO REFLECT THE NEW EMERGENCY MEDICAL SERVICES (EMS) USER FEES; AND AUTHORIZING EXECUTION OF A FIRST AMENDMENT TO THE BILLING SERVICE AGREEMENT BETWEEN THE CITY OF SAN BERNARDINO AND ADVANCED DATA PROCESSING INC. 4 5 6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 7 SECTION 1. Resolution No. 2005-147, adopted by the Mayor and Common Council on June 8 6, 2005 establishing a new master fee schedule for city-wide user fees is hereby amended to revise 9 Part IX: Fire Department, SECTION 7. No other fees established in the previous master fee 10 resolution, Resolution No. 2005-147, are being modified by this resolution. 11 SECTION 2. Part IX: Fire Department, SECTION 7 is hereby rescinded and replaced with 12 the following new SECTION 7: 13 "SECTION 7. The following fees and charges shall be collected by the Fire Department for 14 15 emergency medical services: 16 A. User fees: 17 1. Emergencies requiring Basic Life Support services by paramedics and Emergency Medical 18 Technicians: $200.00/call 19 2. Emergencies requiring Advanced Life Support services by paramedics: $200.00/call 20 B. Exemptions to user fees: The following persons are not subject to the above user fees: 21 1. Residents 65 or older years of age 22 2. Residents who qualify for the low-income utility tax exemption pursuant to Section 23 3.44.144 of the Municipal Code 24 C. Voluntary membership fees: $24.00 per year per household, due on June 1 of each year 25 covers all permanent residents of a household. 26 D. Delinquency Fees: Delinquent accounts for user fees shall be charged an additional 15% 27 28 delinquency fee on the balance due." 1 2006-147 1 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION NUMBER 2005-147 TO REFLECT THE NEW EMERGENCY MEDICAL SERVICES (EMS) USER FEES; AND ADOPTING AMENDMENT NUMBER ONE TO THE BILLING SERVICE AGREEMENT BETWEEN THE CITY OF SAN BERNARDINO AND ADVANCED DATA PROCESSING INC. 3 4 5 SECTION 3. The Mayor or his designee is hereby authorized and directed to execute the 6 First Amendment to the Services Agreement Between the City of San Bernardino and 7 Advanced Data Processing, Inc. for billing services to be effective as of May 15, 2006, a copy 8 of which is attached as Attachment A; 9 10 SECTION 4. The authorization to execute the above referenced First Amendment is 11 rescinded ifit is not issued within sixty (60) days of the passage of this resolution. 12 SECTION 5. MORRI, yor San Bernardino 24 25 Approved as to Form: 26 3 27 28 FIRST AMENDMENT TO SERVICES AGREEMENT BETWEEN CITY OF SAN BERNARDINO AND ADPI WEST, INC. FOR FIRST RESPONDER, PARAMEDIC MEMBERSHIP PROGRAM AND RELATED PROFESSIONAL SERVICES This First Amendment to Services Agreement ("Amendment") is made as of the 15th day of May, 2007 by and between The City of San Bernardino, a Municipal Corporation of the State of California, ("CITY"), and ADPI West, Inc. ("CONTRACTOR"), a Delaware corporation with offices located a 7750 Pardee Lane, Oakland, California 94621, with reference to the following facts: A. City and ADPI entered into an Agreement dated October 4, 2004 (the "Agreement") wherein ADPI agreed to perform certain billing services for first responder and paramedic fees. B. City and ADPI have agreed to modify the terms ofthe Agreement as more particularly set forth herein. NOW, THEREFORE, for good and valuable consideration, the parties hereto agree as follows: 1. Section 4.03 of the Agreement is hereby amended in part to read as follows: "The CONTRACTOR shall be paid by the CITY a monthly amount representing fees for the services provided as follows: $17.00 flat fet< for each account forwarded by CITY to CONTRACTOR." The remainder of Section 4.03 shall remain in full force and effect. 2. A new section 4.08 shall be added to the Agreement to read as follows: "4.08. Determination of qualification for the low income exemption pursuant to the CITY's Master Fee Schedule will be handled and approved by the CITY." 3. Section 21 of said Agreement is hereby deleted and is no longer in force or effect. 4. Page 2 of 5 of Exhibit B to the Agreement under "Specific Scope Compliance", no. 6, "Self Pay Cycle" shall be amended as follows: "Refer to City Policy 180 days shall be replaced with: "Return to City for Collection 180 days" 5. No Amendments. Except as otherwise set forth herein to the contrary, all terms and provisions of the Sublease shall remain unamended and in full force and effect. I 6. Defined Terms. Except as otherwise set forth herein, all defined terms used herein shaH bear the same meaning as set forth in the Sublease.
