Subject:
Resolution awarding a contract to Matich Corporation for Pavement Rehabilitation at eleven locations
- 2nd Street (SS 06-07), Del Rosa Avenue (SS 06-19), "H" Street (SS 06-21), University Parkway (SS
06-32), Sierra Way (SS 06-50), "H" Street (SS 06-52), 16th Street (SS 06-53) & (SS 06-54), Mill Street
(SS 06-57), "D" Street (SS 06-70), Mt. Vernon Avenue (SS 06-77), per Project Plan No. 11735, and
authorization for the Director of Finance to amend the FY 05/06 Budget.
Background:
On August 1, 2005, the Mayor and Common Council allocated funds, as part of the FY 2005/06
Capital Improvement Program (ClP) for pavement rehabilitation at the above-mentioned eleven
locations.
This project consists of the following:
1. Milling and removing damaged asphalt concrete pavement.
2. Overlay new asphalt pavement full width.
3. Stripe new pavement.
4. Replace loop detectors at intersections.
The plans and specifications for this project are completed and the project was opened to public
bidding on May 9, 2006. The project was advertised locally in the San Bernardino County Sun
Newspaper, F. W. Dodge, Construction Bid Board, High Desert Plan Room, San Diego Daily
Transcript, Sub-Hub Online Plan Room, Reed Construction Data, Bid America Online, Construction
Bid Source, Bid Ocean, the City's web sites, and with the San Bernardino Area Chamber of
Commerce.

Based on review of the sealed competitive bids received, staff has determined that Matich Corporation
of San Bernardino, the apparent low bidder, has met the minimum requirements of the specifications
and bid guidelines; and, therefore, recommends that the Mayor and Common Council award the
referenced contract to Matich Corporation.

The estimated project costs are as follows:

If approved, this project is expected to begin construction in late July of 2006 and be completed by
October of2006.
Financial Impact:
Adequate total funding for these projects is available from the FY 2005/06 CIP from the various
accounts. Budget adjustments are needed to supplement the funding for work at two locations. The
supplemental funding will be transferred from other locations in this contract, which have surplus
funding. Therefore, there will be no net increase in total budget requirements for this contract.
Recommendation:
1. Authorize the Director of Finance to amend the FY 2005/06 Budget by transferring $39,000 from
Account No. 240-379-5504-7610 (SS06-21) "H" Street Pavement Rehabilitation" to Account No.
240-379-5504-7605 (SS06-07) "2nd Street Pavement Rehabilitation", and
2. Authorize the Director of Finance to amend the FY 2005/06 Budget by transferring $95,600 from
Account No. 240-379-5504-7614 (SS06-32) "University Parkway Pavement Rehabilitation" to

DEL ROSA AVENUE (SS 06-19), "H" STREET (SS 06-21), UNIVERSITY PARKWAY
(SS 06-32), SIERRA WAY (SS 06-50), "H" STREET (SS 06-52), 16TH STREET (SS 06-53)
& (SS 06-54), MILL STREET (SS 06-57), "D" STREET (SS 06-70), MT. VERNON
AVENUE (SS 06-77), PER PROJECT PLAN NO. 11735, AND AUTHORIZATION FOR
THE DIRECTOR OF FINANCE TO AMEND THE FY 05/06 BUDGET.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Matich Corporation, 1596 Harry Sheppard Boulevard, San Bernardino,
CA 92408, is the lowest responsible bidder for Pavement Rehabilitation at Eleven Locations, 2"d
Street (SS 06-07), Del Rosa Avenue (SS 06-19), "H" Street (SS 06-21), University Parkway (SS 06-32),
Sierra Way (SS 06-50), "H" Street (SS 06-52), 16th Street (SS 06-53) & (SS 06-54), Mill Street (SS 06-
57), "0" Street (SS 06-70), Mt. V emon Avenue (SS 06-77), per Project Plan No. 11735. A contract is
awarded accordingly to said bidder in a total amount of $1,259,952.00, with a contingency
amount of $189,000.00, but such award shall be effective only upon being fully executed by
both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby authorized
and directed to execute said contract on behalf of the City; a copy of the contract is on file in
the office of the City Clerk and incorporated herein by reference as fully as though set forth at
length.
SECTION 2. This contract and any amendment or modifications thereto shall not take effect
or become operative until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or
course of conduct of any party.

At the Mayor and Common Council meeting of July 10, 2006, the City of San Bernardino
adopted Resolution No. 2006-248 - Resolution awarding a contract to Matich Corporation for
pavement rehabilitation at eleven locations, 2nd Street (SS 06-07), Del Rosa Avenue (SS 06-19),
"H" Street (SS 06-21), University Parkway (SS 06-32), Sierra Way (SS 06-50), "H" Street (SS-
52), 16th Street (SS 06-53) & (SS 06-54), Mill Street (SS 06-57), "D" Street (SS 06-70), Mt.
Vernon Avenue (SS 06-77), per Project Plan No. 11735, and authorization for the Director of
Finance to amend the FY 05/06 Budget.
Attached is one (I) certified copy of the resolution, one (1) original bound contract, and three (3)
duplicate original bound contracts. The contracts have been executed by the Mayor, City
Attorney, and City Clerk. Please obtain signatures where indicated and return one fully executed
original bound contract to the City Clerk's office as soon as possible to the attention of Dodie
Otterbein, Records Management Coordinator. Please distribute the remaining bound contracts
accordingly.
Please be advised that the contract will be null and void if not executed within sixty (60)
days, or by Friday, September 8, 2006.

adopted Resolution No. 2006-239 - Resolution adopting the Ca/trans Race-neutral
Disadvantaged Business Enterprise (DBE) Program, effective May 1, 2006, and the City of San
Bernardino annual anticipated DBE Participation Level (AADPL) submittal for Federal
Financial Assistance Projects, effective for Federal Fiscal Year 2006/2007, and authorizing the
City Engineer to execute the Disadvantaged Business Enterprise Race-neutral Implementation
Agreement.
I am providing you with one certified copy of Resolution 2006-239, one (1) original agreement
and two (2) duplicate originals. Please obtain signatures where indicated and return one fully
executed original agreement to Dodie Otterbein in City Clerk's office as soon as possible. Please
retain a duplicate executed agreement for your records and forward the other duplicate
