and Associates for installation of landfill gas monitoring probes at the former Waterman
Landfill.
Background:
The City of San Bernardino operated a municipal solid waste landfill between 1950 and
1960 on 19 acres of leased private property along the south bank of the Santa Ana
River, east of Waterman Avenue. Landfill operations ceased in 1961.
Under State regulations contained in both the Public Resources Code (PRC) and in
sections of Title 27 of the California Code of Regulations, the Owner and Operator of a
landfill is required to implement a monitoring plan for methane gas that is generated
from landfills as a result of anaerobic decomposition of the disposed wastes. By
regulatory definition (PRC Section 40123), the owner is defined to mean "the person
who holds title to the property used as a disposal site after January 1, 1977." PRC
Section 40160 defines an Operator to mean "the person to whom the approval to
operate a disposal site, transfer or processing station, or collection system is granted."
Currently Rancon Realty Trust is defined as the Owner, while the City of San
Bernardino is defined as the Operator.
Rancon Realty Trust and the City of San Bernardino have a concurrent responsibility to
perform the monitoring programs. In November 2002, both parties were placed on
notice by the County of San Bernardino Department of Environmental Health
Department, acting as the State's Local Enforcement Agency (LEA) that the current gas
monitoring program was not in compliance with State Regulations and that immediate
corrective action was required.
On January 27,2003, the City in cooperation with Rancon submitted a proposed gas
monitoring plan to the LEA. This plan is designed to bring the landfill into compliance
with the gas monitoring requirements. The City issued Purchase Order 996700 on
February 6, 2003 in the amount of $24,767 to Bryan A. Stirratt and Associates (BAS) for
preliminary engineering design of a landfill gas monitoring program. BAS previously
performed various engineering studies on the Waterman Landfill and is most familiar
with the technical background relating to the landfill in order to quickly respond to the
LEA's concerns. The proposal that was submitted by BAS included a task to install the
gas monitoring probes, but since it'was not possible to quantify the total number of
probes that would be required by the LEA, this option was not separately priced in the
original proposal price, (see Attachment 1).
In late March, the LEA approved the proposed landfill gas boundary probe design and
the location for the installation of fifteen (15) probes around the perimeter of the landfill.
Based on the final design and location requirements, BAS submitted the attached
proposal on May 9, 2003 for the physical installation of the probes. Once the probes
have been installed according to the May 9, 2003 proposal, BAS will provide training to
City staff in order to be able to sample and record landfill gas quantities on an
appropriate frequency as directed by the LEA, (see Attachment 2). In addition, BAS will
conduct a landfill surface sampling and will prepare a final report. The City may
consider retaining BAS to prepare all required reports to the LEA and other regulatory
agencies, based on the gas sampling performed by the City.
Upon completion of this project, the City will be in compliance with the landfill gas
monitoring requirements. However, based on the results of the monitoring program,
additional actions may be mandated relating to the management of the landfill gas by
the LEA. These actions could include the installation of a landfill gas collection system
designed to remove excessive gas from the landfill. This work is separate and
additional to the work proposed to be performed on the Cover Repairs for the landfill as
required by the Santa Ana Regional Water Quality Control Board.
Staff is therefore requesting that Purchase Order 996700 be increased from $24,767 by
an additional $41,400 for a total not-to-exceed amount of $66,167 to include the cost of
the installation of the Landfill Gas Boundary Probes at the Waterman Landfill. Copies of
the two proposals are included for review.
Financial Impact:
Funds for this project were not included in the FY02-03 Refuse Budget since this was
not a planned program and is in response to regulatory compliance. Based on the
FY02-03 Midyear Report, the Refuse Fund is anticipating an unallocated fund balance
of $720,000 as of June 30, 2003. Staff is therefore requesting that funds in the amount
of $41 ,400 be transferred from the Refuse Unallocated Fund Balance to 527-415-5502
Professional Services in order to fund this amount.
Recommendation:

WHEREAS, the City of San Bernardino operated a municipal solid waste landfill

ceased in 1961.
WHEREAS, The California Code of Regulations requires a monitoring plan for
methane gas that is generated from landfills as a result of decomposition of disposed
wastes.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That Bryan A. Stirratt and Associates (BAS) provides services for
the installation of gas monitoring probes; pursuant to this determination the Purchasing
Manager is hereby authorized to increase Purchase Order No. 996700 to BAS by
$41,400 for a total not to exceed $66,167 for services to include the cost of the

20 SECTION 2. The Purchase Order shall reference this Resolution No. 2003-
21 and shall read, Bryan A. Stirratt P.O. No. 996700 not to exceed $66,167 and
22 shall incorporate the terms and conditions of the Contract, which is on file in the City

SECTION 3. The authorization to execute the above referenced Purchase
Order is rescinded if not issued within sixty (60) days of the passage of this resolution.

SCOPE OF WORK
INTRODUCTION
The scope of work presented herein is intended to provide a satisfactory response to the
Tentative Notice and Order (NAO) for the Waterman Landfill (SWIS#36-CR-0059)
issued to the City of San Bernardino (City) as Operator of the Waterman Landfill by the
County of San Bernardino Department of Environmental Health acting as theLocal
Enforcement Agency (LEA) dated January 9, 2003.
Several regulatory violations related landfill gas (LFG) migration are cited in the NOA,
and the Owner and Operator are ordered to take action to remedy the violations.
SCOPE OF WORK
The following scope of work is intended to address the NAO.
TASK 1 - PROVIDE DESCRIPTION OF REGULATORY REQUIREMENTS
In this task, BAS will provide to the City a concise description of the federal, state, and
local regulatory requirements for methane monitoring at closed landfill sites. This will
assist the Operator in understanding the nature of the violations.
BAS proposes to complete Task I within 10 working days of receiving authorization to
proceed from the City.
TASK 2 - REVIEW BACKGROUND DOCUMENTS
In this task, BAS will review historic data related to the installation and monitoring of
LFG soil gas probes particularly as it relates to state and local regulatory requirements.
Following data review, BAS will submit to the City a memorandum describing the
findings of the review. Findings will include, at a minimum, the adequacy of the probe
design and construction, the locations of the probes, the probe sampling protocols in use
to date, and the probe data reporting. The review will also include recommendations for
bringing the probes, sampling protocols, and reporting into compliance with regulatory
requirements.
BAS proposes to complete Task 2 within 10 working days of receiving complete
background documents from the City.

TASK 3 -UPDATE DESIGl'i OF SOIL GAS PROBES
In this task. BAS will provide plans and specifications for the construction of soil gas
probes that will meet regulatory requirements. Unless site conditions allow for an
alternative design, the probes will comply with the following prescriptive standards:
· Located at the site boundary (property line)
· Spaced 1000 fect apart
. Three nested probes in each borehole at shallow, intermediate, and deep
elevations unless site conditions allow for an alternative design
The drawings and specification for the above compliance probes will be submitted to the
LEA for review and approval, prior to construction of the probes.
In addition to the compliance probes described above, BAS proposes to install several
shallow gas monitoring probes into and through the landfill cover in order to help
quantify the gas pressure and methane concentration in the landfill. This information, in
conjunction with data obtained in Tasks 4 and 5, will help BAS to determine the potential
for gas migration, and possible solutions to the migration issue. Note that the shallow
probes are not for the purpose of regulatory compliance, and the data obtained from the
probes will be kept confidential.

authorization to implement recommendations from Task 2.
TASK 4 - CONSTRUCT SOIL GAS PROBES
In this task, BAS will construct the probes described in Task 3. The cost of this task will
be determined following approval of the design by the LEA.

The estimated time for completion of construction of the probes is 20 working days from
receipt of work authorization from the City.
TASK 5 - TRAINING AND SOIL GAS PROBE MONITORING
In this task, BAS will train City staff to monitor the boundary and surface probes. The
City will monitor the probes weekly in order to determine the severity of the LFG
migration. Prior to monitoring, BAS will submit a monitoring work plan to the LEA for
approval. The work plan will describe sampling equipment and protocols, sampling
interval and reporting details. BAS proposes that the City monitor the probes weekly for
a period of 4 months, or until sufficient data are gathered on which to make a final
determination of the extent of the gas migration problem.

of the probes. Training will be done concurrently with the 4 month monitoring by the
City.
TASK 6 - LANDFILL SURFACE SAMPLING
In this task, BAS will perform a one-time landfill surface sampling for methane in order
to determine the extent of surface emissions from the landfill. This information, in
conjunction with data obtained in Tasks 3 and 4, will help BAS to determine the potential
for gas migration, and possible solutions to the migration issue. Note that the surface
sampling is not for the purpose of regulatory compliance, and the data obtained will be
kept confidential.

BAS proposes to complete the monitoring work plan within 10 working days after
completion of Task 3. This work be performed concurrently with the construction of the
probes.
TASK 7 - FINAL REPORT

In this task, BAS will analyze the data, and submit a report of findings summarizing the
work performed in previous tasks, including recommendations for mitigation of the gas
migration problem. This report mayor may not be submitted to the LEA at the option of
the Owner.
BAS proposes to complete Task 7 within 10 working days after completion of the
4-month probe monitoring by the City.

GAS BOUNDARY PROBES AT THE WATERMAN LANDFILL
Dear Mr. Merrill:
Bryan A. Stirrat & Associates (BAS) is pleased to present this proposal to the City of San
Bernardino (City) for the installation of fifteen (15) landfill gas (LFG) monitoring probes at
the Waterman Landfill in accordance with the attached drawing prepared by BAS and
approved by the Local Enforcement Agency (LEA). The following scope of work and
lump sum cost are intended to satisfy the requirements of the City and LEA for the
complete turn-key probe installation project.
SCOPE OF WORK
Task 1 - Surveying
In this task, BAS will direct it's surveyors to stake the probe locations in accordance with
the approved conceptual drawing. Following the staking, (or during the staking) BAS and
City staff will visit the site for the purpose confirming that the probe locations are
acceptable, and to adjust the locations as may be required. The final staked locations will
be recorded on a record drawing prepared and submitted by BAS.
Task 2 - Probe Installation
In this task, BAS will install the fifteen (15) probes at the approved staked locations
including drilling, completing, and logging each probe location. The probes will be
completed with monument style boxes and gas-tight sample valves in accordance with
the approved plans. It is assumed that no permits are required for this work and no
permitting or permit costs are included. As stated on the approved plans, if refuse is
encountered in drilling any of the probes, that probe will be properly abandoned.

In this task, BAS will write and submit a letter report to the City containing a summary
description of the construction performed, well logs, and record drawings.

$41,331.
