Staff Report
SUBJECT:
Authorization to Proceed -Sale of City property located at the southwest comer of 7th Street and
Harris Street (APN 0138-071-06).
BACKGROUND:
In February 1992, the City acquired the property previously owned by the New Hope Church of
God in Christ, located at the southwest comer of 7th Street and Harris Street, also known as
Assessor's Parcel No. 0138-071-06. The parcel is approximately 7,500 square feet area.
The church was assessed with several abatement liens that were unsettled and the building was
ultimately demolished. The property was then quitclaimed to the City by the Church, as part of a
court settlement proceedings to recover costs incurred by the City for demolition and abatement
fees. The total costs incurred by the City for abatement and demolition was $21,061.
In October 2002, the City received an inquiry from Mr. Kenneth Owens, an individual interested
in purchasing this lot. Mr. Owens presently owns the second lot to the west of the City parcel
and indicated that he is in the process of acquiring the lot immediately adjacent to the City's
property. He indicated that he is acquiring these parcels for residential development. Mr. Owens
is proposing a single family development, which is consistent with the City's General Plan land
use designation for this parcel and the surrounding area. Although the City has owned this
parcel since 1992, there have been no previous attempts to sell this parcel. If authorization to
proceed is given, City departments will be contacted for possible future need of this parcel by the
City.
The City's Municipal Code states that property valued at less than $25,000 may be sold for fair
market value without obtaining bids. If no conflicts by City departments are noted, an appraisal
and title report will be obtained. Mr. Owens will pay for the costs of the appraisal and title
report. If a sale is successfully negotiated between the City and Mr. Owens, subject to Mayor and
Council approval, the cost for the appraisal and title report will be reimbursed to Mr. Owens
from the sale proceeds.
FINANCIAL IMPACT:
Costs for the appraisal and title report will be paid by the potential buyer. Revenue to the City
from the net proceeds of the sale is unknown at this time.
RECOMMENDATION:
Staff recommends that authorization to proceed with the proposed sale be given.
