Synopsis of Previous Council Action:
1/22/01 - An Ordinance amending section 6.24.130 of the Municipal Code
regarding designated off-leash areas for dogs in public parks was approved.
4/22/03 - Legislative Review Committee recommended that revisions to the ordinance be
approved by the Mayor and Common Council.
Recommended motion:
That said Ordinance be laid over for final adoption.

Subiect:
Ordinance of the City of San Bernardino amending section 6.08.140 (C)(2) ofthe Municipal
Code relating to animals.
Backaround:
The Parks and Recreation Commission asked the Animal Control Commission to review and
revise as appropriate Municipal Code Section 6.08.140 relating to animals.
Section 6.08.140 paragraph Cline 2 reads as follows:
All dogs must be at least four months of age, vaccinated for rabies, and currently licensed
by the City's Animal Control Division. No dog that is sick, in heat, injured, or less than
four (4) months of age, or which displays aggressive behavior towards other dogs or
humans is permitted in any off-leash area.
The concern of the Parks and Recreation Commission is that people are using the "dog park" at
Wildwood Park who do not have their dogs licensed through the City of San Bernardino Animal
Control Division and the municipal code as referenced above is not being enforced by the City's
Animal Control Department.
The problem lies in that people from other cities periodically use the dog park and although their
dogs are properly licensed in their own cities they are in violation of the above municipal code as
they are not licensed by the City of San Bernardino Animal Control Department.
This provision is awkward and contradictory to the City's efforts of being a friendly community.
There will be occasions when friends, relatives or other visitors may be visiting or passing
through who wish to bring their dogs to the dog park. The way the municipal code reads now
they would have to be licensed through the City of San Bernardino.
After further review of this section of the municipal code the Animal Control Commission
unanimously voted to recommend amending the municipal code Section 6.08.140 paragraph C
line 2 as follows:

The Legislative Review Committee reviewed the Ordinance amendment at their meeting of
April 22, 2003 and recommended it to the Mayor and Council for approval.
