Synopsis of Previous Council Action:
7/15/02 Allocation of $600,000 in the 2002/03 Capital Improvement Program (CIP) budget for
Hospitality Lane Pavement Rehabilitation from Carnegie Drive to Tippecanoe Avenue (Account No.
129-367-5504-7302) .
Recommended Motion:
1. Adopt Resolution.
2. That the Mayor and Common Council authorize the Director of Finance to amend the FY 2002/03
budget to create Account No. 248-368-5504-7302 (Phase I Pavement Rehabilitation on Hospitality
Lane between Carnegie Dr. and Gage Canal) for $123,000 from the unappropriated Storm Drain
Construction Account.

Subject:
Resolution awarding contract to KC Construction for Phase I Pavement Rehabilitation on Hospitality
Lane from Carnegie Drive to Gage Canal, per Plan No. 10571.
Background:
This project was approved in the FY 2002/03 Capital Improvement Program (CIP). The project was
split into two phases, Phase I is to help prevent water damage to the asphalt pavement and Phase II is
the summation of the project and completes the pavement rehabilitation of Hospitality Lane as
described in the CIP. Phase I, in general, consists of the construction of a localized drainage facility
including additional catch basins and 24" reinforced concrete pipe connecting to the existing storm
drain system in Carnegie Drive. New development along the Hospitality Lane corridor between
Carnegie Drive and Tippecanoe A venue has resulted in an increase in surface water drainage runoff,
resulting in a localized flooding problem which appears to be damaging the existing pavement. The
City has received complaints regarding flooding during rain storms and staff has monitored the
increased frequency of flooding at this location and confirmed a very real problem exists.
Staff, therefore, recommends the installation of the storm drain improvements to mitigate the
flooding problem and to protect the City's investment in the upcoming Pavement Rehabilitation
Project.
It has been recommended that the funding for the Phase I Project should come out of the Storm
Drain Construction Account. It should be noted that although sufficient funds are available in this
account today, there will be an additional shortfall of funding for proposed future CIP storm drain
projects (i.e., State Street Storm Drain, annual cross gutter repair and failed box culvert repair).
Currently, the city has signed agreements for participating and providing local funds to the Route
301210 "State Street Storm Drain. "
Phase II is to follow shortly after the completion of Phase I and is to include not only the pavement
rehabilitation but also the reconstruction and removal of the median on Hospitality Lane to a point
east of the intersection of Carnegie Drive and Hospitality Lane. The median modifications are to
facilitate dual westbound left-turn lanes to the 1-10 freeway ramp and to improve access to the local
businesses along Hospitality Lane.
Plan and specifications for this project are complete and it is ready to be awarded. The estimated
project costs are as follows:

Financial Impact:
Funding for this project in the amount of $123,000 is to be made available from the unappropriated
Storm Drain Construction Account. All costs incurred will be charged to Account No. 248-368-
5504-7302 (Hospitality Lane Pavement Rehabilitation from Carnegie Drive to Tippecanoe Avenue).
Recommendation:
I. Adopt Resolution.
2. That the Mayor and Common Council authorize the Director of Finance to amend the FY 2002/03
budget to create Account No. 248-368-5504-7302 (Phase I Pavement Rehabilitation on
Hospitality Lane between Carnegie Dr. and Gage Canal) for $123,000 from the unappropriated
Storm Drain Construction Account.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AWARDING A CONTRACT TO KC CONSTRUCTION FOR PHASE I
PAVEMENT REHABILITATION ON HOSPITALITY LANE BETWEEN CARNEGIE
DRIVE AND GAGE CANAL, PER PLAN NO. 10571.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. KC Construction is the lowest responsible bidder for Phase I Pavement

9 Rehabilitation on Hospitality Lane between Carnegie Drive and Gage Canal, per Plan No.

10571. A contract is awarded accordingly to said bidder in a total amount of $94,500.00, with

a contingency amount of $14,250.00, but such award shaH be effective only upon being fuHy
executed by both parties. AH other bids, therefore, are hereby rejected. The Mayor is hereby
14 . authorized and directed to execute said contract on behalf of the City; a copy of the contract is

on file in the office of the City Clerk and incorporated herein by reference as fuHy as though
set forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shaH be

20 obligated hereunder until the time of such full execution. No oral agreements, amendments,

modifications or waivers are intended or authorized and shaH not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
within sixty (60) days of passage of the resolution.
