California Highway Patrol and the San Bernardino Police Department regarding the Cargo Theft
Interdiction Program.
Backeround:
In recent years the Inland Empire has experienced an increase in warehousing business and can
anticipate significant growth in the cargo industry. The San Bernardino station of the Burlington
Northern and Santa Fe Railway yard is continuously expanding and is currently the fourth largest
shipping container transfer station in the United States. With the anticipated development of the
Inland Valley Development Agency (IVDA) and the San Bernardino International Airport
Authority (SBIAA), San Bernardino hopes to increase activity in this area. The City can
anticipate that a by-product of this expansion will be an increase in cargo theft.
Cargo theft has been increasing in recent years. Nationwide, cargo thieves will steal $ I 2 Billion
to $20 Billion in goods this year, ratcheting up insurance premiums for businesses, and
ultimately the prices consumers pay for everything from toilet paper to electronics. In Southern
California alone, cargo theft is a $600 Million annual enterprise. The largest increases have been
seen in Ontario, Fontana, Rialto, San Bernardino and the High Desert.
In January of 1994, the State Assembly passed Assembly Bill 813, which mandated the
California Highway Patrol (CHP) to implement and maintain an ongoing statewide cargo theft
suppression effort. In compliance of this directive the CHP established the Cargo Theft
Interdiction Program (CTIP). The mission of CTIP is to reduce the incidence of cargo theft
related crimes and increase the identification, apprehension, and prosecution of professional
thieves and their receivers. In January 1995 the CHP initiated the Southern Division CTIP team
specifically focusing on Los Angeles and the Inland Empire. In January 1997 State Assembly
Bill 1683 was enacted which created funding for the enhancement of CTIP.
The attached Memorandum of Understanding proposes the formal establishment of the Inland
Division CTIP. Initial participants will include the CHP, Ontario Police Department, National
Insurance Crime Bureau (NICB), and the San Bernardino Police Department. An Executive
committee comprised of members from the participating agencies will act as the board of
directors.
The Inland Division CTIP will be overseen by the CHP Inland Division Investigative Services
Unit Coordinator, a Lieutenant. A CHP Sergeant will actively participate in team operations and
provide immediate supervision. The remainder of the team will be made up of two CHP
investigators and four participating agency investigators to include NICB. San Bernardino will
provide one police officer investigator. The officer will be reassigned from the department's
current staff.
The CHP has agreed to provide office space at the Rancho Cucamonga CHP office. Office space
will include all necessary furniture, associated office equipment, communication equipment, and
a cellular phone. CHP will also provide access to office clerical staff. The assigned SBPD officer
will continue to utilize the police department's current support staff. No increase in SBPD
clerical or support staff is anticipated. NICB will provide vehicles. The San Bernardino Police
Department will provide maintenance for the NICB vehicle, a pager, and a lap top computer for
our investigator. CHP requires that the police department enter into an agreement to formalize
the relationship between the two agencies. The length of the agreement is indefinite and all
participating agencies may terminate their involvement with a thirty-day notice. The agreement
covers policies and procedures, utilization of resources, and operations.
To test the effectiveness of the CTIP program the police department temporarily loaned an
officer to CTIP on October I, 2002. Over a period of 60 days that officer has been involved in
numerous investigations. Specifically he is responsible for four investigations where stolen
cargo from outside of the city was recovered in San Bernardino:
. Valley and G Street, recovery of a stolen trailer containing televisions valued at
$750,000 - six suspects in custody.
. 275 S. G Street, warehouse containing ten trailer loads of property valued at
$1,500,000 - two suspects in custody.
. 2200 block of Del Rosa, recovery of $150,000 worth of stolen toys - one suspect in
custody.
. Commercial Boot Warehouse, truck containing stolen boots valued at $200,000 - five
suspects in custody.
Financial Impact:
Initially all salaries and benefits for all members of the Inland Division CTIP will be at the
expense of the participating agencies. The CTIP fund established under AB 813 and AB 1683 is
already designated for the Golden Gate, Southern, and Border Division CTIP. Initial funding for
the Inland Division CTIP is dependent upon the participating agencies. The City of San
Bernardino will be responsible for the salary and benefits of one police officer. This officer will
come from the department's current staff. The City is also responsible to provide maintenance,
including fuel for the NICB vehicle assigned to our officer. Vehicle maintenance will be charged
to the asset forfeiture account.
Participation in CTlP is a priority to the police department. Cargo theft is one of the fastest
growing crimes in the nation. In 2002 the Inland Division CTIP recovered $7.5 Million in
vehicles and $12 Million in cargo. Cargo theft investigations are time consuming, complicated,
cover a wide geography, and often require significant resources to conduct surveillance or sting
operations. The department currently does not have these resources and will not have them in
the foreseeable future. A task force concept where multiple agencies share resources to combat
common issues is the practical method to impact this crime. The San Bernardino investigator
assigned to CTIP assumes investigative responsibility of all cargo thefts occurring in the city
relieving the department of that responsibility.
Should State funding become available, reimbursement for salaries and benefits will be at the
discretion of the eRP Enforcement Service Division. Overtime reimbursement will be a
maximum of 30 hours per month.
