STAFF REPORT
Subject:
Resolution awarding Public Works contract to Essex Construction, Inc. for the Upgrade
Playground Equipment and Surfacing at Fourteen (14) Park Sites project, per Plan No. 10595.
Background:
As part of the 2001/02 Capital Improvement Program, the Mayor and Common Council
Allocated $739,300.00 in Park Bond Funds for the Upgrade of Playground Equipment and
Surfacing at eleven (II) park sites. The Finance Department advertised and received bids for the
design-build project in February of 2002. However, the Council ultimately elected to reject the
initial bids and directed Development Services staff to rebid the project. At the end of
November, 2002 Parks and Recreation staff submitted the technical specifications to staff for the
citywide Playground Equipment/Surfacing at the eleven (II) original park sites plus three
additional park sites to incorporate into a Public Works bid package. Staff also created an
Additive Alternate for the benches and signs, indicated on the original bid as optional items.
After re-writing the bid specifications to meet our typical contract bid guidelines, the project was
advertised on 12/17/02 and staff received bids on 2/6/ 2003.
The Parks Department Identified 14 Parks which are in need of playground equipment upgrades
and resurfacing. They are:

STAFF REPORT
The plans and specifications for this Public Works Parks project are complete. The Public
Works Parks project is ready to be awarded. The estimated project costs are as follows:

This Public Works project was advertised locally in the San Bernardino County Sun Newspaper,
F.W. Dodge, Construction Data Hot Sheet, Daily Construction Service and, Bid America,
Construction Bid Source, the City's web sites, and with the San Bernardino Area Chamber of
Commerce. The following seven companies responded:

After the bid opening, Essex Construction, Inc. was the apparent low bidder in the amount of
$641,100.00. Essex Construction, Inc. is the lowest responsible bidder, and has met the minimum
requirements of the specifications and bid guidelines, and therefore staff recommends that the
Mayor and Common Council award the referenced contract accordingly.
Financial Impact:
Sufficient funding for this project was allocated in the FY 2001/02 Capital Improvement
Program (CIP) budget ($739,300). Payments to the contractor and staff time associated with
administration and inspection of the contract will be charged to Account No. 243-363-5504-7264
Park Bond Funds.
Recommendation:
Adopt resolution.

SECTIO~ I. Essex Construction, Inc.12335 Santa Monica Blvd. # 432 Los Angeles.
California 90025 is the lowest responsible bidder for the Upgrade Playground
10 Equipment/Surfacing at Fourteen (4) Park Sites project. per Plan No. 10595. A contract is
11 a\\arded accordingly to said bidder in a total amount of 5641.100.00. with a contingency
12 amount of 53-1.100.00, but such award shall be effective only upon being fully executed by
13
both parties. All other bids. therefore. are hereby rejected. The Mayor is hereby authorized
14
and directed to execute said contract on behalf of the City: a copy of the contract is on file in
15
16 the office of the City Clerk and incorporated herein by reference as fully as though set forth at
17 length.

SECTIO~ 2. This contract and any amendment or modifications thereto shall not take
19
effect or become operative until fully signed and executed by the parties and no party shall be
20
21
obligated hereunder until the time of such full execution. No oral agreements. amendments.
22 modifications or wai\ers are intended or authorized and shall not be implied from any aCl or
23 course of conduct of any party.

SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it

within sixty (60) days of passage of the resolution.

Our office has not received the executed contract with Essex Construction, Inc., for the upgrade
playground equipment/surfacing at fourteen (14) park sites project, per Plan No. 10595. This
agreement was approved at the Mayor and Common Council meeting held on March 3, 2003,
and will be null and void if not executed and returned to the City Clerk's Office by May 2,
2003.
Please forward the executed agreement to the City Clerk's Office, to my attention, as soon as
