Renewal of the Citv's Participation in the
Al!ua Mansa Recvclinl! Market Development Zone (RMDZ)
BACKGROUND:
California Senate Bill 1322 created the Recycling Market Development Zone (RMDZ) Program
(Program) in 1990. The Program was established to provide low-interest loans to businesses that use
recycled materials for processing or manufacturing new products. These businesses must be located
within a designated zone. The boundaries of each zone are determined by jurisdictions participating
in the Program and are based on existing local development zones and the availability of waste
material feedstock for manufacturing. The California Integrated Waste Management Board
administers the Program to assist local agencies in complying with loan program goals. The State
established a limit of forty (40) zones statewide. Each zone was established through a competitive
process that concluded in 1995.
The Agua Mansa RMDZ was established on August 31, 1993, to include commercial and industrial
areas within the cities of Colton, Rialto, Riverside and San Bernardino, and within the counties of
Riverside and San Bernardino. The RMDZs are established for a term of ten (10) years and will be
dissolved in August 2003. The Economic Development Agency of Riverside County administers the
Agua Mansa RMDZ under the direction of the Agua Mansa Industrial Growth Association (AMIGA)
Executive Board and the guidance of the Agua Mansa RMDZ Subcommittee. The AMIGA Executive
Board approved representation of the City of San Bernardino on the RMDZ Technical Subcommittee
as designated by the San Bernardino Economic Development Agency in 1999.
The RMDZ area within the City of San Bernardino includes designated light and heavy commercial
and industrial land use zones. A map delineating the boundaries of the zone is included. Since the
inception of City's participation, two businesses, BAS Tire Recycling located at 1400 N. "H" Street
($250,000 low-interest loan) and EMS Holding Concept located at "H" and 16th Streets ($250,000
grant), have benefited from the RMDZ receiving a combined loan and grant of $500,000. These
loans are made and funded with the State Industrial Development Bonds and tipping fees collected
from the landfill dump (these fees are independent of the State budget). In addition, other incentives
such as Small Business Administration loans, employer hiring credits, sales and tax credit, and nontax
investments that allow businesses to receive free tax on interest earned on investment, are available to
businesses. The loan assistance can be used for equipment purchase, leasehold improvements,
recycled raw materials and inventory purchase, and owner-occupied real property acquisition.
CURRENT ISSUE:
The RMDZ has a ten (10) year term designation. The Agua Mansa RMDZ designation is expected to
expire in August 2003. As a result, an extension of the term of the zone is required. In order to
extend the term of the zone for another ten (10) years, each participating jurisdiction is required to

"The only change to the current year estimates is to reflect the loss of VLF revenue to
the State in the amount of $3,548,500. This loss of revenue reduced the budget reserve
from $6,761,700 to $3,213,200. Other adjustments will be done after the mid-year
process is complete.

WHEREAS, the California Public Resources Code Section 42010 provides for the
establishment of a Recycling Market Development Zone (RMDZ) Program throughout the State which
7

provides incentives to stimulate development of secondary materials market for recyclables ; and
9
WHEREAS, the cities and counties must meet 50 percent reductions in landfill waste disposal as
mandated in the California Integrated Waste Management Act; and,

WHEREAS, the State established the Agua Mansa RMDZ in August 1993 that includes
12
designated areas in the cities of Colton, Rialto, Riverside, and San Bernardino and the counties of
Riverside and San Bernardino; and,

WHEREAS, the redesignation of the Agua Mansa RMDZ to include the City of San Bernardino
14
is essential to developing local secondary materials market and to assist in meeting the landfill reduction
15
goals; and,
16
WHEREAS, the City of San Bernardino has adopted, and the California Integrated Waste
Management Board has approved, a Source Reduction and Recycling Element (SRRE) administered by
17
18
the Public Services Department that identifies an RMDZ as a viable program consistent with the City's
goal to encourage local businesses to use recycled materials in manufacturing and to reduce the volume
19
20
and toxicity of waste generated; and,
21
WHEREAS, the City of San Bernardino generates an adequate feedstock of marketable
22
recyclable materials for processing and manufacturing, maintains a municipal waste collection fleet, and
23
has a developed transportation network that will contribute to the success of the RMDZ program in the
24
proposed expansion area; and,

WHEREAS, the Agua Mansa RMDZ Board has agreed to a ten (10) year extension of this
Recycled Market Development Zone to the California Integrated Waste Management Board to include
the City of San Bernardino.

NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND ORDERED
BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, AS
FOLLOWS:

Section 1.
The Mayor and Common Council hereby approve renewal of the City's

participation in the Recycling Market Development Zone for the Agua Mansa RMDZ to include the
City of San Bernardino.

Section 2.
The Mayor and Common Council hereby agree to the designation of the
10
11
Econornic Development Agency of Riverside County as the lead agency to coordinate, process, and
execute all contracts, agreements, amendments, and ancillary documents within the scope of the
12
renewal.

Section 3.
The Mayor and Common Council hereby designate the City of San Bernardino
14
Development Services Department Planning Division, to be the lead agency for completing and
15
authorizing all necessary documentation and public notices in order to comply with the California
16
Environmental Quality Act (CEQA) as required by the California Integrated Waste Management Board
17
to include the proposed areas within the City of San Bernardino, if applicable.

Section 4.
The Mayor and Common Council hereby find and determine that the RMDZ
19
renewal is necessary to assist in attracting private sector recycling business investments to the area.
20
Section 5.
The Mayor and Common Council hereby find and determine that the current
21
and proposed waste management practices arid conditions are favorable to the development of post-
22
consumer waste materials markets.

This Resolution shall take effect upon its adoption and execution in the
